EASEMENT
KNOW ALL MEN BY THESE PRESENTS, the Tigard Lodge #207 A.F. & A.M.
of Oregon, an Oregon Corporation, hereinafter referred to as "Grantors",,.
for and in consideration of One Dollar ($1.00), the receipt of which is
hereby acknowledged, to us paid by TIGARD WATER DISTRICT, a municipal
corporation of Washington County, Oregon, hereinafter referred to as.
"Grantee", do hereby grant, bargain, sell, convey and transfer unto Grantee,
its successors and assigns forever, a permanent easement over and upon the
following described real property, to wit:
The West 10 feet of the following described parcel of land:
Beginning at a point on Section line between Sections 2
and 3, T2S, RiW, W.M.,'Washington County, Oregon, 9.09
chains north of the southwest corner of said Section 2;
thence north along said section.line 3.58 chains to center
of S. W. Pacific Highway; thence N 380 21' E 1.01 chains
to center of said road to an iron pipe at the most westerly
corner of the tract described in deed to-R.M. Brandhagen,
et ux, recorded in Book 166, Page.307, Deed Records, Wash-
ington County, Oregon; thence S 520 31' E 7.04 chains
along the southwesterly line of said Brandhagen tract to a
stake on south line of tract being a point on the north
line of Freleon Heights No. 2, a plat of record; thence
S 880 55' W along said northerly.line and a westerly ex-
tension thereof 6.24 chains to section line at place of
beginning; EXCEPTING therefrom that certain tract of tract
as more particularly described in Deed Book 128, Page 37 (a),
(to Charity Lodge No. 75, I.O.O.F. of Oregon), Record of
Deeds, Washington County, Oregon;.also EXCEPT that part
conveyed to the State of Oregon by deed recorded in Book
3349 Page 366, Deed Records, Washington County, Oregon.
This easement..shall be for the construction,.maintenance and
repair of an underground pipeline.and/or mains for the purpose of con-
veying water over, across, through and under the hereinabove described
real property and shall include the perpetual right to enter upon said
real property at reasonable times, together with the right to excavate
and refill ditches for the location of said pipelines and/or mains and
the further right to remove all obstractions.interferring.with the loca-
tion, construction and maintenance of said pipelines and/or mains.
Grantors, their heirs, executors, administrators and assigns,
do hereby covenant with Grantee that they are lawfully seized and pos-
sessed of the hereinabove described real property, and that they have
a lawful right to convey same, and that they will warrant and forever
defend the title thereto against the lawful claims of all persons
whomsoever.

Grantee, its successors and assigns, does hereby covenant that
it shall restore said property to its original condition as nearly as is
practicable upon the completion of construction and upon completion of
any subsequent maintenance and repair work.
Grantors, their heirs, executors, administrators and assigns,
do further covenant that in the event they are responsible for destruction
of said water line or interruption to the water service, they hereby agree
to pay the reasonable cost of repairing same.
TO HAVE AND TO HOLD said easement and right-of-way unto Grantee
and unto its successors and assigns forever. This easement is a covenant
running with the land.

undersigned, a notary public in the aforesaid county and state, personally
appeared the within named Russell L. Parker and
Harold A. Myers , who being eaeh duly sworn did say that the
former is the PRESIDENT and the latter is the SECRETARY of TIGARD LODGE #207
A.F. & A.M. of Oregon, a corporation; that the seal affixed to the foregoing
instrument is the corporate seal of said corporation, and that said instru-
ment was signed and sealed on behalf of said corporation by authority 6f its
Board of Directors; and they acknowledged said instrument to be its voluntary
act and deed.
