EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that LEONARD C. DONOVAN and
RUTH L. DONOVAN, husband and wife, hereinafter referred to as "Grantors",
for and in consideration of the sum of $1.00, the receipt of which is
hereby acknowledged, to us paid by TIGARD WATER DISTRICT, a municipal
corporation of Washington County, Oregon, hereinafter referred to as
"GRANTEE", do hereby grant, bargain, sell, convey and transfer unto
Grantee, its successors and assigns forever, a permanent easement over
and upon the following described real property, to wit
The North 10 feet of the two lots described as follows:
Beginning at an iron pipe at the southwest corner of that
certain tract of land in Section 15, Township 2 South, Range
1 West of the Willamette Meridian, conveyed to Leonard C.
Donovan et ux by deed recorded in deed book 356 page 562,
all in oashington.County, Oregon; said iron pipe being
south 0034' west 551.92 feet and north 89045' west 665.75
feet from the northeast corner of the Broader property. as
d8scribed.in deed book 124 page 334; running thence north
0 15' east.116.28 feet to an iron pipe on the southerly line
of a 30 foot wide roadway; thence north 89°45' west along
said roadway line 99;0 feet to the.easterly boundary line of
the north bgund lane of the relocated West Side Pacific Highway;
thence S. 3 36, west along said highway boundary line 116.48
feet to an iron pipe; thence south 89v451 east 105.8 feet to
the place of beginning.
Real property situated in Section 15, Township 2 South, Range
1 West of the W.M.; in the County of Washington and State of
Oregon, to wit: Beginning at an iron pipe, said iron pipe
being South 0°34' West 551.92 feet and North 89°45' West
550.75 feet from the Northeast corner of the Broader property
as described in Book 124, at page 334 Records of Deeds of
Washington County, Oregon, and thence continuing Borth 89°45'
West 115.00 feet to an iron pipe; thence Nogh 0 34' East
116.28 feet to an iron pipe; thence gouth 89 45' East 115.00
feet to an iron pipe; thence South 0 34' West 116.28 feet to
the place of beginning of this description.
This easement shall be for the construction, maintenance and
repair of an underground pipeline and/or mains for the purpose of conveying
water over, across, through and under the hereinabove described real property
and shall include the perpetual right to enter upon said real property at
reasonable times, together with the right to excavate and refill ditches for
the location of said pipelines and/or mains and the further right to remove
all obstructions interferring with the location, construction and maintenance
of said pipeline and/or mains.

Grantors, their heirs, executors, administrators and assigns, do
hereby covenant with Grantee 'Uhat they are lawfully seized and. possessed of
the hereinabove described real .property, and that they have alawful right
to convey same, and that they will warrant and forever defend the title
thereto against the lawful claims of all persons whomsoever.
Grantors, their heirs, executors, administrators and assigns,
do further covenant that in the event they are. responsible for destruction
of said water line or interruption to the water service, they hereby agree
to pay the reasonable cost of repairing same.
Grantee, its successors and assigns, does hereby covenant that it
shall restore said property to its original condition as nearly as is prac
tible upon the completion of construction and upon completion of any subse-
quent maintenance and repair work.
TO HAVE AND TO HOLD said easement and right-of-way unto Grantee
and unto its successors and assigns forever. This easement is a covenant
running with the land.
