Venture Properties Inc., an Oregon Corporation, hereinafter called the "Grantors", grant, convey,
aM and transfer unto the City of Tigard, a municipal corporation of Washington County, Oregon
E I. hereinafter referred to as "Grantee", its successor and assigns forever, a permanent easement over
and upon the following described real property, to wit:

This easement shall be for the construction, maintenance, and repair of an underground pipeline
and/or mains for the purpose of conveying water over, across, through, and under the hereinabove
described real property and shall include the perpetual right to enter upon said real property at
reasonable times, together with the right to excavate and refill ditches for the location of said
pipelines and/or mains, and the further right to remove all obstructions interfering with the
location, construction, and maintenance of said pipeline and/or mains.
The true consideration for this conveyance is $ 0.00 . However, the actual consideration consists
of or includes other property or value given or promised which is the whole consideration.
It is expressly understood that this easement does not convey any right, title; or interest except
those expressly stated in this easement, nor otherwise prevent Grantors. from the full use and
dominion thereover; provided, however, that such use shall not interfere with the uses and
purposes of the intent of the easement.
LEGAL DESCRIPTION
EXHIBIT "A"
March 29, 1996
PURPOSE: TO DESCRIBE A 20 FOOT WIDE STRIP OF LAND FOR A WATER LINE
EASEMENT. IN FAVOR OF THE TIGARD WATER DEPARTMENT. THE
UNDERLYING LAND WILL IN THE ~ FUTURE BECOME A PUBLIC
ROADWAY KNOWN AS FIRTREE DRIVE.
The following described strip of land being located within the boundary of that land in deed to Venture
Properties, Inc., an Oregon Corporation, being recorded as deed recording No. 96021188; and being
situated in the S.E. Quarter of Section 5, Township 2-South, Range 1-West of the Willamette
Meridian, Washington County, Oregon. Said strip of land being 20 feet in width, 10.00 feet on each
side of the following described centerline.
Beginning at the centerline of the easement on the East boundary of the "Roundtree Estates" plat
S 00°14'49" W 3.00 feet from the centerline terminus of S. W. Firtree Drive as set forth in said plat
thence along the easement centerline S 89°45'11" E 39.43 feet; thence S 66°55'11" E 127.84 feet;
:thence S 89058'53" E 153.01 feet to the westerly boundary of the duly recorded plat of "Mayvew" and
the. terminus of this easement, said terminus being located S'00014'4911 W 5.00 feet from the westerly
centerline terminus of S.W. Firtree Drive as set forth in the "Mayview" plat.
It shall be understood that a 20 foot wide temporary construction easement is provided herewith,
adjacent to and'parallel with the north boundary of the easement. Upon completion and acceptance of
the construction this temporary easement shall self extinguish.
In consideration of the premises, Grantee agrees that if said Grantee, its successors or assigns
should cause said easement to be vacated, the rights of the Grantee in the above-described
easement will be forfeited and shall immediately revert to the Grantors, their successors and
assigns in the case of such event.
To have and to hold the above-described and granted premises unto said Grantee, its successors,
and assigns forever.
