EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that Raymond B. and Phyllis G. Ems,
hereinafter referred to as "GrantorP1, for and in consideration of-the sum
of One Dollar ($1.00), the receipt of which is hereby acknowledged, to.me
paid by TIGUM WATER DISTRICT, a municipal corporation of Washington
County, Oregon, hereinafter referred to as "Grantee", does hereby grant,
bargain, sell, convey and transfer unto Grantee, its successors and assigns
forever, a permanent easement over and upon the following described real
property, to wit:
The north 10 feet of the following described property:
A portion of that tract of land in the William Graham and
wife Donation Land Claim No. 39, in Section It T2S, R11f, W.M.,
Washington County, Oregon, conveyed to Raymond B. Ems, et ux,
by deed recorded December 2, 1952, in Book 339, Page 3249 Wash-
ington County, Oregon Deed Records, more particularly described
as follows:
Beginning at a stake on the S.E. corner of Lot 49, ROLLINQ
HILLS PLAT No. 2; thence Northerly along the East line of laid
Lot 49 a distance of 150 feet to the South line of S.W. Fir
Street; thence Easterly along the South line of S.W. Fir Street
a distance of 50 feet to the East line of S.W. 76th Avenue;
thence Northerly along the East line of S.W. 76th Avenue a dis-
tance of 25 feet to the North line of Parcel I in the afore-
mentioned Ems tract; thence N 890 561 E along the North line
of said Ems tract a distance of 162.36 feet to a marked stone
at the N.E. corner of said Ems tract; thence S 20 011 W along
the East line of said Ems tract a distance of 175 feet; thence
Westerly a distance of 210.8 feet, more or less, to the point
of beginning.
This easement shall be for the construction, maintenance and repair
of an underground pipeline and/or mains.for the purpose of conveying
water over, across, through and under the hereinabove described real
property and shall include the perpetual right to enter upon said real
property at reasonable times, together with the right to excavate and
refill ditches for the location of said pipelines and/or mains and the
further right to remove all obstructions interferring with the location,
construction and maintenance of said pipelines and/or mains.
Grantor, their heirs, executors, administrators and assigns, do
hereby covenant with Grantee that they are lawfully seized and possessed
of the hereinabove described real property, and that they have a lawful
convey same, and that they will warrant and forever defend the
title thereto against the lawful claims of all persons whomsoever.
Grantee, its successors and assigns, do hereby covenant that it shall
restore said property to its original condition as nearly as is practi6dble.
upon the completion of construction and upon completion of any subsequent
maintenance and repair work.

Grantor, their heirs, executors, administrators, and assigns, do
further covenant that in the event they are responsible for destruction
of said water line or interruption to the water service, they hereby
agree to pay the reasonable cost of repairing same.
TO HAVE AND TO HOLD said easement and right-of-way unto Grantee and
unto its successors and assigns forever.
