4439 EASEMENT
KNOW ALL MEN BY THESE PRESENTS, That FLOYD W. BROWN,
et ux, hereinafter referred to as"Grantor", for and in
consideration of the sum of ONE AND N01100 Dollars, the
receipt of which is hereby acknowledged' to us paid by
TIGARD WATER DISTRICT, a municipal,corporation of Washington
County, Oregon, hereinafter refeered to as "Grantee", do
hereby grant, bargain, sell, convey and transfer unto
Grantee, its successors and assigns forever, a.permanent
easement over and upon the following described real property,
to-wit:
Beginning at the Southwest corner of Lot
1, Block 3, Fairhaven Court and running
thence N 89° 42t 35" W 10.x.$„feet; thence
on a 282.94-foot radius curve left (the
long chord of which bears S'780 351 42" W
114.71 feet') 115.52 feet; thence, on a
294.90-foot radius curveright (the long
chord of which bears S 780 241 W 117.59
feet) 118.38 feet to the West line of said
Brown tract; thence, S 000 241 W along
said West line, 50.0 feet; thence N 890
541 E 0.44 feet; thence on x.344.90-foot
radius curveleft N 780,241 E(137.52 feet)
138.45 feet; thence on a 232.94-foot curve
right (the long chord of which bears N 780
35t 42" E 94.44 feet) 95.09 feet; thence
S 89 421 35" E 9.98 feet to the South-
west corner of Lot 1, Block 4, Fairhaven
Court; thence N 000 521 E 50.0 feet to the
point of beginning.
This easement shall be for the construction,
maintenance and repair of an underground pipeline and/
or mains for the purpose of conveying water over, across,
through and under the hereinabove described real property and
shall include the perpetual right to enter upon said real
property at reasonable times, together with the right to
excavate and refill ditches for the location of said pipe-
lines and/or mains and the further right to remove all
obstructions interferring with the location, construction
and maintenance of said pipelines and/or mains.
Grantors, their heirs, executors, administrators
and assigns, do further covenant that in the event they are
responsible for destruction of said water line or interruption
to the water service, they hereby agree to pay the reasonable
cost of repairing same.
Grantee, its successors and assigns, does hereby
conversant that it shall restore said real property to its
original condition as nearly as is practical upon the com-
pletion of construction and upon completion of any subsequent
maintenance and repair wor.k.

439 TO HAVE AND TO HOLD said easement and right of way
unto Grantee and unto it's successors and assigns forever.
This easement is ,a covenant running with the land.
