Tigard-Tualatin School District 23J hereinafter called the Grantors,
grant and convey unto the City of Tigard a perpetual easement for constructing, reconstructing, operating, maintaining,
inspecting, and repairing of public utilities and appurtenances, together with the right to remove, as necessary, vegetation,
foliage, trees, and other obstructions on the parcel of land described in Exhibit "A", situated in the City of Tigard,
Washington County, State of Oregon.
THE TRUE CONSIDERATION for this conveyance is $ 0.00 . However, the actual consideration consists of or includes
other property or value given or promised which is the whole consideration.
IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right, title, or interest except those expressly
stated in this easement, nor otherwise prevent Grantors from the full use and dominion thereover; provided, however, that
such use shall not interfere with the uses and purposes of the intent of the easement.
IN CONSIDERATION of the premises, Grantee agrees that if said Grantee, its successors or assigns should cause said
easement to be vacated, the right of the Grantee in the above-described easement will be forfeited and shall immediately
revert to the Grantors, their successors, and assigns in the case of such event.
TO HAVE AND TO HOLD the above-described and granted premises unto said Grantee, its successors, and assigns forever.

EASEMENT DESCRIPTION
PUBLIC UTILITY EASEMENT
OCTOBER 13, 2005
A strip of land, variable in width, situated in the Northeast one-quarter of Section 14,
Township 2 South, Range 1 West, Willamette Meridian, City of Tigard, Washington County,
Oregon described as follows:
Commencing at the Northeast corner of said Section 14, thence tracing the North line of
said section and the centerline of S.W. Durham Road S.89°58'48"W., 719.64 feet; thence
S.00°01'12"E., 45.00 feet to a point on the southerly right of way line of S.W. Durham Road
and the TRUE POINT OF BEGINNING of the herein described strip; thence, from said
point of beginning, said strip being 15.00 foot in width and lying 7.50 feet on each side of
the following described centerline, S.00000'34"W., 300.75 feet; thence, said strip being 2750
feet in width and lying 7.50 feet to the right (South) and 20.00 feet to the left (North) of the
following described centerline, S.89°13'27"E., 20.00 feet.
The side lines of said strip shall be lengthened or shortened as required to intersect with the
southerly right of way line of S.W. Durham Road.
