KNOW ALL MEN BY THESE PRESENTS, that Marie J. Collier,
hereinafter referred to as "Grantors", for and in consideration of
the sum of One Dollar ($1.00)9 the receipt of which is hereby
aelmovledged, to me-paid by TIGARD WATER DISTRICT, a municipal
corporation of Washington-County, Oregon, hereinafter referred to
as "Grantee",, does hereby grant, bargain, sell, convey and transfer
unto Grantee, its successors and assigns forever, a permanent ease-
meat over and upon the following described real property, to wits
The North 45 feet of the following described
property; included therein the north 20 feet which
now exists as a public right-of-way, S. W. Durham
Roads
Commencing at the northwest corner of Section 149
T2S9 R1W9 W. M., Washington County, Oregon; thence
south to the south line of the Solomon Richardson and
wife's D.L.C. 30 chains; thence east 26-23 rods;
thence north 30 chains; thence vest 26-23 rods.to
the place of beginning.
Except that part beginning at a point 22.5 chains
south of the northwest corner of said section; thence
south 7.5 chains to the south line of the D.L.C. of
Solomon and wife; thence east along the,south line of
said D.L.C. 6.66-2/3 chains; thence north 7.5 chains
to a point due east of the place of beginning; thence
west 6.66-2/3 chains to the place. of beginning.
This easement shall be for the construction, maintenance
and repair of an underground pipeline,and/or.mairls.for the purpose
of conveying water over, across, through andi_under the hereinabove
described real property and shall include the perpetual right to
enter upon said real property at reasonable times, together with the
right to excavate and.refill ditches for the location.of said pipe-.
lines and/or mains, and the.fnrther right to remove all 'obstructions
interferring with the location, construction and.maintenance of said
pipelines and/or mains.
Grantors, their heirs, executors, administrators and assigns,
do hereby covenant with Grantee that they are Tiiwful'ly seized a" pos-
sessed of the;hereinabove described real property, and that they have
a lawful right to convey same,) and that they w 'i,:varraat and forever
defend the title thereto against the lawful claims of all persons whom-
soever.
Grantee9.its successors and assigns, does hereby covenant
that it shall restore said property to its original condition as nearly
as is practicable upon the completion of construction and upon comple-
tion of aay.subsequent maintenance and repair work.

Grantors, their heirs, executors, administrators and assigns,
do further covenant that in the event they are responsible for destruc-
tion of said water line or interruption of the water service, they
hereby 4gree to pay the reasonable cost of repairing same.
TO HAVE AND TO HOLD said easement and right-of-way unto
Grantee and unto its successors and assigns forever. This easement
is a covenant running with the land.
