5683 5683a EASEMENT KNOW ALL MEN BY THESE PRESENTS, that GENERAL SAW COMPANY, an Oregon Corporation, hereinafter referred to as "Grantors", for and in consideration of the sum of One Dollar ($1.00), the receipt of which is hereby acknowledged, to us paid by TIGARD WATER DISTRICT, a municipal corporation of Washington County, Oregon, hereinafter referred to as "Grantee", do hereby grant, bargain, sell, convey and transfer unto Grantee, its successors and assigns forever, a permanent easement over and upon the following described real property, to wit: The North 20 feet of the following described property: Parcel I: A 30 foot parcel of land 30 feet wide in Section 13, Township 2 South, Range 1 West of the W.M., Washington County, Oregon; beginning at a point on the North line of said Section 131 31 rods East of the Northwest corner of said Section 13; thence South parallel with the West line of said Section 53 rods. Parcel II: Beginning at a point on the North line of Section 13, Township 2 South, Range 1 West, W ,..Washington County, Oregon; at the Easterly line of that certain 30 foot right-of-way as excepted in deed recorded June 3, 1943, in Book 218, Page 337, Deed Records; thence Easterly along the section line to the North- west corner of that certain tract conveyed to Donald Leslie Moore, et ux, by Deed recorded June 18, 1948, Book 286, Page 351; thence South along the West line thereof 440 feet to the Southwest corner thereof; thence East along the South line thereof 142 feet; thence continuing East along the South line of that certain tract conveyed to Harold L. Edwards, et ux, Recorded September 20, 1949, in Book 299, Page 158, Deed Re- cords to the Northwest corner of that certain tract conveyed to Durham School District #82, by deed recorded July 10, 19519 'in Book 322, Page 470; thence south along the West line there- of 434.5 feet, more or less, to the South line of that certain tract conveyed to Fred R. Harrison, et ux, by deed recorded in Book 218, Page 336; thence West along said South line there- of to the East line of that certain tract conveyed to Marion M. Maxwell, et ux, by deed recorded June 25, 1951, in Book 2759 Page 501, Deed Records; thence North along the East line thereof 312 feet; thence West along the North line thereof to the East line of that excepted right-of-way as herein above stated; thence North along the East line of said right-of-way to the place of beginning; excepting therefrom a 20-foot strip along the entire north side for public road (S.W. Durham Ave.). This easement shall be for the construction, maintenance and repair of an underground pipeline and/or mains for the purpose of con. veying water over, across, through and under the hereinabove described real property and shall include the perpetual right to enter upon-said real property at reasonable times, together with the right to excavate and refill ditches for the location of said pipelines and/or mains and the further right to remove all obstructions interferr' with the loca- tion, construction and maintenance of said pipelines and/or mains. Grantors, their heirs, executors, administrators and assigns, do hereby covenant with Grantee that they are lawfully seized and pos- sessed of the hereinabove described real property, and that they have a lawful right to convey same, and that they will warrant and forever defend the title thereto against the lawful claims of all persons whomsoever. PAGE I EASEMENT 800 6 PAGE - - - 5683 EASK40T (Continued) Grantee, its successors and assigns, does hereby covenant that it shall restore said property to its original condition as nearly as is practicable upon the completion of construction and upon completion of any subsequent maintenance and repair work. Grantors, their heirs, executors, administrators and assigns, do further covenant that in the event they are responsible for destruction of said water line or interruption to the water service, they hereby agree to pay the reasonable cost of repairing same. TO HAVE AND TO HOLD said easement and right-of-way unto Grantee and unto its successors and assigns forever. This easement is a covenant running with the land.
