EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that WILLIAM and RUTH G AEPER,
as tenants in common; GLEN L. WIW Og and.LORRAINE WIIC Og, as tenants in
common; KENNETH J. BADOW and DALLAS W. KOM, as tenants in common; and
CHARLES L. SHEPHERD; dba CANTERBURY HEIGHTS, an Oregon Co-venture, here-
inafter referred to as "GRANTORS", for and in consideration of the sum of
$7.00, the receipt of which is hereby acknowledged, to us paid by TIGARD-
WATER DISTRICT, a municipal corporation of Washington County, Oregon, here-
inafter referred to as "GRANTEE", do hereby grant, bargain, sell, convey
and transfer unto Grantee, its successors and assigns forever, a permanent
easement over and upon the following described real property, to-wit:
A 10-foot wide strip of land beginning at the Southwesterly
corner, thence Easterly along the Southerly boundary line a
distance of 250 feet of the following described real property,
to wit:
A tract of land in the northeast quarter of Section 10, Town-
ship 2 South, Range l West of the Willamette Meridian, Washington
County, Oregon, being part of that certain tract conveyed to John
D. Annand et al by deed recorded June 22, 1967 in Hook 647 page
166 and more particularly described as follows:
Beginning at a point which.in the north line of the Southeast
quarter of the Northeast quarter of said Section 10 and 5 chains
West of the east line of said Section, and is the northeast
corner of said Annand Tract; thence West along the north line
of said Annand Tract 560.22 feet to a point; thence South along
a line parallel with the east line of said Annand Tract 400 feet
to a point; thence East along a line parallel with the North.
line of said Annand Tract.250.22 feet to a point; thence South
along a line parallel with the east line of said Annand Tract
20 feet to a point; thence East along a line parallel to the
north line of said Annand Tract 310.0 feet to a point in the
east line of said Annand Tract; thence North along the east
line of said Annand Tract 420.0 feet to the point of beginning.
This easement shall be for the construction, maintenance and
repair of an underground pipeline and/or mains for the purpose of conveying
water over, across, through and under the hereinabove described real property
and shall include the perpetual right to enter upon said real property at
reasonable times, together with the right to excavate and refill ditches for;
the location of said pipelines and/or mains and the further right to remove
all obstructions interferring with the location, construction and maintenance
of said pipeline and/or mains.
Grantors, their heirs, executors, administrators and assigns, do
hereby covenant with Grantee that they are lawfully seized and possessed of
the hereinabove described real property, and that they have a lawful right
to convey same, and that they will warrantand forever defend the title
thereto against the lawful claims of all persons whomsoever.

Grantors, their heirs, executors, administrators and assigns,
do further covenant that in the event they are responsible for destruction
of said water line or interruption to the water service, they hereby agree
to pay the reasonable cost of repairing same.
Grantee, its successors and assigns, does hereby covenant that it
shall restore said property to its original condition as nearly as is prac-
tible upon the completion of construction and upon completion of any subse-
quent maintenance and repair work.
TO HAVE AND TO HOLD said easement and right-of-way unto Grantee
and unto its successors and assigns forever. This easement is a covenant
running with the land.
