Andrews Management Limited, an Oregon Corporation, hereinafter called "Grantor", grant,_ _ - - -
convey, and transfers to the City of Tigard, Oregon, a municipal corporation of Washington
County, Oregon hereinafter referred to as "Grantee", its successor and assigns forever, a
permanent, nonexclusive easement over and across the following described real property, to wit:
Attached Exhibit "A": Legal Description and Legal Description Sketch
This easement shall be for the construction, maintenance, and repair of a public water system for
the purpose of supplying water to the hereinabove described real property, and shall include the
right to enter upon said real property. This easement also provides the right to remove all
obstructions unreasonably interfering with the location, construction, and maintenance of said
water system.
The true consideration for this conveyance is $_.Q.00 . However, the actual consideration consists
of or includes other property or value given or promised which is the whole consideration.
It is expressly understood that this easement does not convey any right, title, or interest except
those expressly stated in this easement, nor otherwise prevent Grantor from the full use and
dominion thereover; provided, however, that such use shall not interfere with the uses and
purposes of the intent of the easement.
In consideration of the. premises, Grantee agrees that if Grantee, its successors or assigns should
cause said easement to be vacated, or fail to use the easement for a continuous period of two (2)
years, the rights of the Grantee in the above-described easement will be extinguished, and shall
immediately revert to the Grantors, their successors and assigns.
This easement shall run for the benefit of the Grantee, its successors, and assigns.
Grantee agrees to defend, indemnify; and hold Grantor harmless from any and all claims, liabilities
and damages relating in any manner to Grantee's activities connected with the easement.

An easement is hereby granted to the City of Tigard and their successors and assigns for
ingress, egress, emergency use, operation and maintenance and repair of any public
waterline facilities constructed on those properties as described in deed recording No. 94-
095985; and 95-074966, Parcels 1 and 2, over, under and across all of the vehicular
driving aisles and maneuvering areas as well as any landscaped areas adjacent to the public
facilities as may be required operate those facilities.
