1706 1746 EASEMENT KNOW ALL MEN BY THESE PRESENTS, that S.E. LASSELLE and MARJORIE J. LASSELLE, husband and wife, hereinafter referred to as "GRANTORS", for and in consideration of the sum of $10. 00, and other good and valuable consideration, the receipt of which is hereby acknowledged, to us paid by TIGARD WATER DISTRICT, a municipal corporation of Washington County, Oregon, hereinafter referred to as "GRANTEE", do hereby grant, bargain, sell, convey and. transfer unto Grantee, its success rs and assigns forever a. permanent easement over and upon the North . r feet of the following described real property, to-wit: Beginning at an iron pipe on the. North line of Section 9, Township 2, South, Range 1 West, V illamette Meridian, in Washington County, Oregon, which pipe is located 383.75 feet Westerly from the quarter corner of said >o~ Section 9; thence from said beginning point easterly along h~ the North line, of said Section 9, 170 feet to a point; thence South Oo 35' East to a point in the center of Bull Mountain Road; thence Westerly along the center of said Road to a nail set therein; which point is the most Southwesterly point of the tract of land set forth and described in the second description contained in that certain Deed recorded in Deed Book 231, page 673, record of deeds of Washington County, Oregon; thence from said point North Oo 35' West 1, 099.46 feet to the point of beginning. This easement shall be for the construction, maintenance and repair of an underground pipeline and/or mains for the purpose of conveying water over, across, through and under the hereinabove described real property. It shall include the perpetual right to enter upon said real property at reasonable times, together with the right to excavate and refill ditches for the location of said pipelines and/or mains, and the further right to remove all obstructions interferring with the location, construction and maintenance of said pipeline and/or mains. Grantors, their heirs, executors, administrators and assigns, do hereby covenant with Grantee that they are lawfully seized and possessed of the hereinabove described real property and that they have a lawful right to convey the same, and that they will warrant and forever defend the title thereto against the lawful claims of all persons whomsoever. Grantors, their heirs, executors, administrators and assigns, do further covenant that in the event they are responsible for destruction of said water line or interruption to the water service, they hereby agree to pay the reasonable cost of repairing same. Grantee, its successors and assigns, does hereby covenant that it shall restore said real property to its original condition as nearly as is prac- tical upon the completion of construction and upon the completion of any sub- sequent maintenance and repair work.
