KNOW ALL MEN BY THESE PRESENTS, That ARTHUR G. AMES
and ELSIE W.' AMES, husband and wife, hereinafter referred to as "Grantors",

hereby grant, bargain, sell, convey and transfer unto Grantee, its successors
and assigns forever, a permanent easement over and upon the following des.•

The North 10 feet of a tract of land in Section
10, Township 2 South, Range 1 West, of the
Willamette Meridian, Washington County,
Oregon, more particularly described as
follows:
Beginning at the Northwest corner of that
tract of land conveyed to Arthur G. Ames
by deed recorded January 27, 1960, in Book
426, Page 597, Washington County, Oregon
Deed Records; thence South along the West
line of said Ames tract 800 feet, more or
less, to the Northwest corner of that tract
of land conveyed to Marion.M. Knight by
deed recorded August 18, 1958, in Book 408,
Page 163, said deed records; thence East
along the North line of said Knight tract 120
feet to the Northeast corner thereof; thence
South along the East line of said Knight tract
40 feet, more or less, to the Northwest cor.
ner of that tract of land conveyed to Westley
C. Geer by deed recorded February 13, 1962,
in Book 457, Page 404, said deed records;
thence East along the .North line of said Geer
tract 137.02 feet to the. Northeast corner
thereof; thence South along the East line of
said Geer tract, 214.66 feet to the Southeast
corner thereof, which point is on the South
line of said Ames tract; thence Easterly along
the said South line and the North line of Bull
Mountain Road 680 feet, more or less, to the
Southwest corner of that tract of land conveyed
to The Diocese of Oregon by deed recorded
January 27, 1960, in Book 426, Page 598, said
deed records; thence -North along the West line
of said Diocese of Oregon tract 1017.02 feet to
the Northwest corner thereof, which point is on
the North line of said Ames tract; thence West
along the North line of said Ames tract 936.76
feet, more or less, to the place of beginning.
This easement shall be for the construction, maintenance and repair
of an underground pipeline and/or, mains for the purpose of conveying water
over, across, through and under the hereinabove described real property and

shall include the perpetual right to enter upon said real property at reasonable
times, together with the right to excavate and refill ditches for the location of
said pipelines and/or mains and the further right to remove all obstructions
interferring with the location, construction and maintenance of said pipelines
and/or mains.
Grantors do hereby grant, ' bargain, sell, convey and transfer
unto Grantee a temporary easement for an additional five-foot strip of land
which is adjacent to the south and parallel to the hereiuabQve.. described x.eal_
property during the ..period. of initial construction only, and in all events to
terminate absolutely one year after the date of execution of this document.
Grantors, their heirs, executors, administrators and assigns,
do hereby covenant with Grantee, that they are lawfully seized and possessed
of the hereinabove described real property, and that they have a lawful right
to convey same, and that they will warrant-and forever defend the title there-
to against the lawful claims of all persons whomsoever,
Grantors, their heirs, executors, administrators and assigns,
do further covenant.that in the event they are responsible for destruction of
said water line or interruption to the water service, they hereby agree to pay
the reasonable cost of repairing same.
Grantee, its successors and assigns, does hereby covenant
that it shall restore said real property to its original condition as nearly as
is practical upon the completion of construction and upon completion of any
subsequent maintenance and repair work;
TO HAVE AND TO HOLD said easement and right of way unto
Grantee and unto its successors and assigns forever. This easement is a
covenant running with the land.
