1700 1700 EASEMENT KNOW ALL MEN BY THESE PRESENTS, That THE DIOCESE OF OREGON, an Oregon corporation, hereinafter referred to as "Grantor", for and in consideration of the sum of ONE AND no/100 Do ars, the receipt o which is ere y ac now e _ ge , to it paid By WATER DISTRICT, a municipal corp.. oration of Washington' County, Oregon, hereinafter referred_ to as "Grantee", does hereby grant, bargain, sell, convey and transfer unto Grantee, its successors and assigns forever, a permanent. easement over and upon the following described real property, to-wit; The North 10 feet of the following described real property situated in the County of Wash- ington, State of Oregon; Beginning at a stone monument marking the North quarter section corner of Section 10, Township 2 South, Range 1 West, W. M., and running thence South 00 051 East 660.0 feet along the North and South center line of said Section 10 to an iron pipe, said iron pipe marking the true point of beginning of this description; thence continuing South 0005' East 972.67.feet to a point in the North line of S, W. Bull Mountain Road, (County Road No. A-.147); thence :along said.North line South 780 13' West 232.06 feet to a point; thence North 00 05' West 1017. 02 feet to an iron pipe set in the Southerly boundary line of the North one-.half of the North one•• half of said Section 10; thence following said Southerly boundary line North 890 14' East 227.24 feet to the true point of beginning of this description. This easement shall be for the construction, maintenance and repair of an underground pipeline and/or mains for the purpose of conveying water over, across, through and under the hereinabove described real prop- erty and shallinclude the perpetual right to enter upon said real property at reasonable times, together with the right to excavate and refill ditches for the location of said pipeline and/or mains and the further right to remove all, obstructions interferring with the location, construction andmaintenance of, said pipeline and/or mains. Grantor does hereby grant, bargain, sell, convey and transfer unto Grantee a temporary easement for an additional five-foot strip of land which is adjacent to the south and parallel to the hereinabove described real property during the period of initial construction only, and in all events to terminate absolutely one year after the date of execution of this document. Grantor, its successors and assigns, does hereby covenant with Grantee that it is lawfully seized and possessed of the hereinabove des• cribed real property, and that it has a lawful right to convey same, and that it will warrant and forever defend the title thereto against the lawful claims of all persons whomsoever. BOOK U5 PAGE60%~ I EASEMENT 1700 Grantor, its successors and assigns, does further covenant that in the event it is responsible for destruction of said water line or inter. ruption to the water service, it hereby agrees to pay the reasonable cost of repairing same. Grantee, its successors and assigns, does hereby covenant that it shall restore said real property to its original condition as nearly as is practical upon the completion of construction and upon completion of any subsequent maintenance and repair work. TO HAVE AND TO HOLD said easement and right of way unto Grantee and unto its successors and assigns forever. This easement is a covenant running with the land.
