Fmmmel, hereinafter called the Grantor, in consideration for the sum of One Thousand One Hundred Fifty and N01100 (1,15000) Dollars from the City of Tigard, hereinafter called Grantee, grant and convey unto the City of Tigard a perpetual easement for constructing, reconstructing, operating, maintaining, inspecting and repairing of public utilities, and appurtenances, together with the right to remove, as necessary, vegetation, foliage, trees and other obstructions on the following described parcel of land, situated in the City of Tigard, Washington County, State of Oregon: An easement for utility purposes over a portion of that certain parcel of land situated in the northwest quarter of Section 12, Township 2 South, Range 1 West, Willamette Meridian, Washington County, Oregon. Said easement being 7 feet wide and lying southerly and parallel to the following described line: Beginning at the point of intersection of the easterly property line of that certain parcel of land as described in Fee No. 87-016722 recorded April, 1987, Washington County deed records and the proposed southerly right-of-way line of S.W. Bonita Road, which is 30.00 feet right and at right angles to engineer's center line station 18+05.30, more or less, dated ;aaosr-y 14, ; thence westerly along said proposed southerly right-of=way line a distance of 13.0 feet, more or less, to a point which is 30.00 feet right and at right angles to engineer's center line station 17+92.30 and the terminus of this easement. The southerly line of said 7-foot easement being elongated or shortened to meet at said easterly property line and a line perpendicular to said station 17+92.30. IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right, title or interest except those expressly stated in this easement, nor otherwise prevent Grantors from the full use and dominion thereover; provided, however, that such use shall not interfere with the uses and purposes of the intent of the easement. The Grantors, their heirs, successors, assigns or representatives shall not construct or maintain any building or other structures upon the above described real property prior to written approval by the City as to conformance with City specifications regarding construction. TO HAVE AND TO HOLD the above-described and granted premises unto said Grantee, its successors and assigns forever. Together with a temporary easement for construction purposes as described in exhibit RFIURN REOORDED DOCUvEWT TO: CITY REOORDER, TIGARD J PO.BOX 23397 / TIGARD OR 97223 Utility(rempotaty Easement Fimmel.9 "B" incorporated by reference and made part of this document. This easement shall be effective from date of signature for one year for the purpose above described, or until completion of the project, whichever is first. Grantee agrees to hold Grantor harmless for all injury to person or property caused by Grantee's use of property for the purposes above described.
