EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that GENERAL SAW COMPANY, an
Oregon Corporation, hereinafter referred to as "Grantors", hereby donates
to the TIGARD WATER, DISTRICT, a municipal corporation of Washington
County, Oregon, hereinafter referred to as "Grantee", do hereby grant,
bargain, sell, convey and transfer unto Grantee, its successors and
assigns forever, a permanent easement over and upon the following des-
cribed real property, to wit:
The North 15 feet of the following described property:
A part of Section 12, T2S9 RiW, W.M., more particularly
described as followss Beginning at a point 1320 feet
South and 1316.70 feet West of the Northeast corner of
Section 12, which point is also the Northeast corner of
the Southwest I of the Northeast I of said Section 12;
thence South 00 11' West 6.00 feet to an iron rod at
the intersection of the South line of Bonita Road (C.R.No-736)
and the West line of Red Rock Road (C.R. No. 126); thence
South 890 21' West 454.38 feet along the South line of
Bonita Road to an iron rod and true point of beginning
of the parcel herein described; thence continuing along
the South line of Bonita Road 250.00 feet to an iron rod
on the East line of the R/W of the S.P. Railroad; thence
South 17" 19' East 208.77 feet along said Easterly R/W
of the S.P. Railroad to an iron rod; thence North 890 21'
East 190.13 feet to an iron rod; thence North 00 39' West
200 feet to an iron rod on the South line of Bonita Road
and the true point of beginning.
This easement shall be for the construction, maintenance and
repair of an underground pipeline and/or mains for the purpose of con-
veying water over, across, through and under the hereinabove described
real property and shall include the perpetual right to enter upon said
real',property at nnsonable times, together with the right to excavate
and. refill ditches for the location of said pipelines and/or mains and
the further right to remove all obstruction interferring with the loca-
tion,_ construction and maintenance of said pipelines and/or mains.
Grantors, their heirs, executors, administrators and assigns,
do hereby covenant with Grantee that they are lawfully seized and pos-
sessed of the hereinabove described real property, and that they have a
lawful right to convey same, and that.they will warrant and forever defend
the title thereto against the lawful claims of all persons whomsoever.
Grantee, its successors and assigns, does hereby covenant that
it shall restore said property to its original condition as nearly as is
practicable upon the completion of construction and one year thereafter,
and upon completion of any subsequent maintenance and repair work.

Grantors, their heirs, executors, administrators, and assigns,
do further covenant that in the event that they are responsible for
destruction of said water line or interruption to the water service, they
hereby agree to pay the reasonable cost of repairing same.
TO HAVE AND TO HOLD said easement and right-of-way unto Grantee
and unto its successors and assigns forever. This easement is a covenant
running with the land.
