5798 5 7 9 8 EASEMENT KNOW ALL MEN BY THESE, PRESENTS, that ALEXANDER R. BASTRON and INEZ MAY BASTRON, husband and wife, hereinafter re- ferred to as "GRANTORS", for and in consideration of the sum of $10.00 and other good and valuable consideration, the receipt of which is hereby acknowledged, to us paid by TIGARD WATER DISTRICT, a municipal corporation of Washington County, Oregon,. hereinafter referred to as "GRANTEE", do hereby grant, bargain, sell, convey and transfer unto Grantee, its successors and assigns forever, a permanent easement over and upon the North 15 feet of the following described real property, to-wit: Beginning at a point 194 feet North of the Southwest corner of Government Lot 2 in the Northeast quarter of Section 1, Township 2 South, Range 1 West of the W. M., in Washington County, State of Oregon, thence running East 660 feet, . thence North 400 feet; thence West on a line South of that tract described in deed recorded in Deed Book 353, page 643, to Lloyd A. Anderson, 660 feet; thence South 400 feet to the place of beginning, excepting therefrom the South 70.0 feet. This easement shall be for the construction, maintenance and repair of an underground pipeline and/or mains for the purpose of convey- ing water over, across, through and under the hereinabove described real property and shall include the perpetual right to enter upon said real -property at reasonable times* together with the right to excavate and re- :.:filY:ditches for the location of said pipelines and/or mains and the further a rig hi to remove all obstructions interferring with the location, construction maintenance of said pipeline and/or mains. Grantors do hereby grant, bargain, sells. convey and transfer unto Grantee a temporary easement for an additional ten foot strip of land which is adjacent to the south and parallel,to the hereinabove described real property during the period of initial construction only, and in all events, to terminate absolutely one year after date of execution of this document. Grantors, their heirs, executors, administrators and assigns, do hereby covenant with Grantee that they are lawfully seized and possessed of the hereinabove described real property, and that they have a lawful right to convey same, and that they will warrant and forever defend.the title thereto against the lawful claims of all persons whomsoever. Grantors, their heirs, executors, administrators and assigns, do further covenant that in the event they are responsible for destruction of said water line or interruption to the water service, they hereby agree to pay the reasonable cost of repairing same. Grantee, its successors and assigns, does hereby covenant that it shall restore said real property to its original condition as nearly as is practibie upon the completion of construction and upon completion of any subsequent maintenance and repair work.
