G PERMANENT STORM DRAINAGE EASEMENT
KNOW ALL MEN BY THESE PRESENTS, THAT Arlie L Nhwhirter, Trustee,
hereinafter referred to as Grantor(s), in consideration for the sum of Two Thousand and
No/100 DcMars, ($2,00000) from the City of Tigard, hereinafter called Grantee, grant and
convey unto the City of Tigard a perpetual easement for constructing, reconstructing,
operating, maintaining, inspecting and repairing of an underground storm drainage line and
appurtenances, together with the right to enter upon the Grantor's property for the above
mentioned purposes, and the right to remove, as necessary, vegetation, foliage, trees and
other obstructions on the following described parcel of land, situated in the City of Tigard,
Washington County, State of Oregon:
See Exhibit "A" attached hereto, incorporated by reference and made part of
this document
IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right,
title or interest except those expressly stated in this easement, nor otherwise prevent
Grantors from the full use and dominion thereover, provided, however, that such use shall
not interfere with the uses and purposes of the intent of the easement.
IN CONSIDERATION of the premises, Grantee agrees that if said Grantee, its
successors or assigns should cause said easement to be vacated, the rights of the Grantee
in the above described easement will be forfeited and shall immediately revert to the
Grantors, their successors and assigns in the case of such event.
TO HAVE AND TO HOLD the above described and granted premises unto the
Grantee, its successors and assigns forever.

DRAINAGE EASEMENT
A parcel of land situated in the Northwest quarter of the
Northeast quarter of Section 2, Township 2 South, Range 1 West,
Willamette Meridian, Washington County, Oregon, Said parcel being
more particularly described as follows:
A strip of land 5 feet each side of the following described
line:
Beginning at a point which is 1427.35 feet left of and at
right angles to Engineer's right of, way centerline station
104+85.65 of S.W. Greenburg Road as defined in City of Tigard
Ordinance No 90-01, dated January 22, 1990; said point also
referred to as Engineer's storm sewer centerline station 16+96.03
as illustrated in City of Tigard R/W-Easement Exhibits Sheet 7 of
8 dated 5-9-90; Thence bearing South 45°2711211 West a distance of
358.23 feet to an angle point; Thence bearing South 4504610011 West,
a distance of 192.00 feet to an angle. point; Thence bearing South
43011155" West, a distance of 187.00 feet, more or less, to Fanno
Creek.
Except any portion within existing structures* or public right
of way.
