PERMANENT STORM DRAINAGE EASEMENT
KNOW ALL MEN BY THESE PRESENTS THAT Portland Fixture Limited
Partnership, an Oregon Limited Partnership
hereinafter called the Grantors, in consideration for the sum of -0-
dollars (t -0- ) from the City of
Tigard, hereinafter called Grantee, grant and convey unto the City of Tigard a
perpetual easement for constructing, reconstructing, operating, maintaining,
inspecting and repairing of an underground storm drainage line and appurtenances,
together with the right to remove, as necessary, vegetation, foliage, trees and
other obstructions on the parcel of land, described in the attached Exhibit "A",
situated in the City of Tigard, Washington County, State of Oregon.
IT IS EXPRESSLY UNDERSTOOD: That this easement does not convey any right, title
or interest except those expressly stated in this easement, nor otherwise prevent
Grantors from the full use and dominion thereover; provided, however, that such use
shall not interfere with the uses and purposes of the intent of the easement.
That. any trees, shrubs, plant materials, ground cover and other improvements of
the Grantor.`disturbed or damaged by the operations of the City shall be restored, at
the egpense',of,, the City, to a condition similar or equal to that existing before'
such disturbaiic'e or damage was done.
IN-_-CON iDERATION of the premises, grantee agrees that if said Grantee, its
successors Mgr-assigns should cause said easement to be vacated, the rights of the
Grantee in'.0.6 above described easement will be forfeited and shall immediately
revert to-the Grantors, their successors and assigns in the case of such event.
TO HAVE AND TO HOLD the above-described and granted premises unto said Grantee,
its successors and assigns forever.

LEGAL DESCRIPTION
A tract of land situated in the S.W. 1/4 of Section 2, T2S, R1W,
W.M., City of Tigard, Washington County, Oregon, Being more
particularly described as follows:
A 15.0 foot wide strip of-land being 7.5 feet on each side-of the
following described centerline:
Beginning at a point on the northeasterly line of that tract of
land as conveyed to Caron Kubin, recorded in Book 831, Page 415,
.Washington County-deed.records, that is South 53°38152" East,
435.88 feet from a point on the vacated southeasterly right-of-
way line of Taylors Bridge Road (C.R. 477), said point being
46.55 feet from the centerline of S.W. Pacific Highway, when
measured at right angles;
thence, North 36°21'08" East, 7.50 feet to the true point of
beginning of said centerline;
thence, parallel with the northeasterly line of said Kubin tract,
South 53°38'52" East, 133.00 feet to the terminus point of said
centerline.
