STORM SEWER - PERMANENT Space above reserved for Washington County Recording Information
Carol A. Simpson hereinafter called the Grantor, grant and convey unto the City of Tigard a perpetual easement for constructing,
reconstructing, operating, maintaining, inspecting, and repairing of a public storm sewer and appurtenances, together with the right
to remove, as necessary, vegetation, foliage, trees, and other obstructions on the parcels of land described in Exhibit "A", situated
in the City of Tigard, Washington County, State of Oregon. In addition, Grantor will permit passage through Grantor's land to
access the easement.
THE TRUE CONSIDERATION for this conveyance is $ 0.00 However, the actual consideration consists of or includes other
property or value given or promised which is the whole consideration.
IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right, title, or interest except those expressly-stated
in this easement, nor otherwise prevent Grantor from the full use and dominion thereover; provided, however, that such use shall
not interfere with the uses and purposes of the intent of the easement. The Grantor, their heirs, successors, assigns or
representative shall not construct or maintain any building or other structure upon the real property describe in Exhibit "A" prior to
receiving written approval by the City Engineer or his or her designee. The Grantor, their heirs, successors, assign or
representatives shall not in any way alter the configuration of the material forming the slope, including alteration by addition or
removal of material, without prior written approval by the City Engineer or his her designee.
IN CONSIDERATION of the premises, Grantee agrees that if said Grantee, its successors or assigns should cause said easement
to be vacated, the right of the Grantee in the above-described easement will be forfeited and shall immediately revert to the
Grantor, their successors, and assigns in the case of such event. The instrument does not grant or convey to the Grantee any right
of title to the surface of the soil except for the purpose of constructing, inspecting, maintaining, and replacing the slope as above
stated.

A tract of land located in the Northeast One-Quarter of Section 36, Township 1 South, Range 1
West, of the Willamette Meridian; City of Tigard, Washington County, Oregon, described as follows:
Beginning at the Northeast corner of the land deeded to Simpson in Deed Book 794 Page 602 of
the Washington County Deed Records; thence S 01 ° 31'37" W, along the easterly line of said land,
a distance of 15.12 feet to a point 15.00 feet southerly of the north line of said deed; thence S 48°
10' 07" W,. parallel to and 15.00 feet from said north line, a distance of 51.55 feet to a non_tangent
curve to the left; thence along said curve to the left with a radius of 35.00 feet, a central angle of 25°
19.' 58" (a chord which bears N 06° 20' 19" E, 15.34 feet) and a length of 15.47 feet to the northwest
corner of said deed; thence N 84° 10' 07" E, along the north line of said deed a distance of 50.25
feet to the point of beginning.
