Carlson hereinafter termed grantor(s) hereby grant, bargain, and convey unto the CITY OF TIGARD, a municipal corporation of Oregon, hereinafter termed the City, a perpetual right-of-way, and easement as hereinafter described, together with. a temporary right-of-way and easement to use an additional area hereinafter described and designated temporary easement, for the following uses and purposes: 1. Perpetual easement: An unencumbered perpetual right-of-way and easement for the purpose of constructing, reconstructing, operating, maintaining, inspecting and repairing of an underground storm drainage line and appurtenances, together with the right to remove, as necessary, vegetation, foliage, trees and other obstructions within the ease- ment area, but reserving to the grantors the title to the lands, subject to the easement, and the right to make such use thereof, except to construct buildings, as will not interfere with the uses and purposes of the easement; said easement being described as follows; That certain strip of land 20.0 feet wide lying contiguous to the northerly line of Lot 11 of Fanno Creek Acre Tracts in the S.E. 1/4 of Section 12, T.2S., R. 1W., W.M., Washington County, Oregon. Beginning at the northeast corner of Lot 11, thence South 20 feet along. the westerly right-of-way line of S.W. 74th Avenue to a point, thence 58.81' 29'35" W. 160 feet to a point, thence North parallel with S.W. 74th Avenue 20 feet to a point, thence N88029'35"E. 160 feet to the point of beginning. Temporary easement: Together with the temporary right of ingress, egress, and regress, and use for storm drainage construction purposes of additional lands lying parallel to, along the south side and within 30 feet, when measured at right angles, of the above described perpetual easement area, excepting and reserving to grantors the unencumbered enjoy- ment, use and preservation of all structures present upon the premises. This temporary easement shall terminate upon completion of the storm drainage construction work, at which time, upon request of the owner, the City will issue a written release thereof. Should it be necessary to cut and remove any brush, trees, or other matter or materials from the easement area, said brush, trees, or other matter and materials shall be removed and disposed of by the City and the City shall leave the easement area in a neat and workmanlike condition. The City agrees that in connection with its use of the perpetual easement area and in inspecting, repairing, maintaining, or replacing said storm drainage line, the City will leave the premises in a neat and workmanlike condition and as nearly in the pre-existing state as practicable. Box 23397 Tigard, Oregon 97223 Dear Aldiee Attached is an easement for the proposed storm drain system to serve our Tigard Industrial Part: on 72nd Avenue. The document has been executed by Harding G. and Anita L. Carlson and grants a perpetual easement to the City. I would appreciate a telephone call'from you when the easement. has been formally accepted by the City, so that I can pay Mr. and Mrs. Carlson the consideration involved. I would also appreciate receiving two copies of the easement after it has been recorded. I understand from our consulting firm that-the ease- ment will now allow the City Engineer to release the approved construction drawings so that we may proceed with construction.
