PERMANENT STORM DRAINAGE EASEMENT
KNOW ALL MEN BY THESE PRESENTS THAT JOHN W. SETNIKER AND BARBARA A. SETNIKER
hereinafter called the Grantors, in consideration for the sum of ONE AND
NO/100 dollars ($1.00 ) from the City of
Tigard, hereinafter called Grantee, grant and convey unto the City of Tigard a
perpetual easement for constructing, reconstructing, operating, maintaining,
inspecting and repairing of an underground storm drainage line and
appurtenances, together with the right to remove, as necessary, vegetation,
foliage, trees and other obstructions on the following described parcel of
land, situated in the City of Tigard, Washington County, State of Oregon:
See Exhibit A & Exhiibt B hereto attached.
IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right,
title or interest except those expressly stated in this easement, nor
otherwise prevent Grantors from the full use and dominion thereover; provided,
however, that such use shall nat interfere with the uses and purposes of the
intent of the easement.
IN CONSIDERATION of the premises, Grantee agrees that if said Grantee, its
successors or assigns should cause said easement to be vacated, the rights of
the Grantee in the above-described easement will be forfeited and shall
immediately revert to the Grantors, their successors and assigns in the case
of such event. '
TO HAVE AND TO HOLD the above-described and granted premises unto said
Grantee, its successors and assigns forever.

LEGAL DESCRIPTION
A tract of land being a portion of that tract of land as conveyed
to Roland and Mary Ingalls, recorded in Book 270, Page 455,
Washington County deed records, situated in the S.W. 1/4, Section
2, T.2S., R.lW., W.M., City of Tigard, Washington County, Oregon,
being more particularly described as follows:
A 20.00 foot wide strip of land being 10.0 feet on each side of
the following described centerline:
Beginning at a point on the southwesterly line of said Ingalls
tract that is North 50028148" West, 85.00 feet from the southeast
corner of said Ingalls tract;
thence, North 15°30'00" East, 75.00 feet to the terminus point of
said centerline.
The sidelines of said 20 foot wide strip are subject to
lengthening and/or shortening so as to terminate upon the proper
boundaries.
