This memorandum is to document the fact that the City, who owns Tax Lot 201, Tax Map 2S1
05DC, will permit the installation of a new public storm drainage line to serve pending
development on Tax Lot 1201, Tax Map 2S1 08AB. Specific terms of this allowance are
contained within a letter agreement, dated August 4, 2003.
Since the City is the owner of the property, no formal easement dedication is necessary.

This letter agreement will define the specific proposal from LanDynamics LLC, and will list
the various expectations of the City of Tigard.
The parties agree to the following:
1. LanDynamics LLC is acting as the developer representative.
2. The proposal is for the installation of a 12 -inch public storm line across the
City parcel described above.
3. The developer is responsible for obtaining the necessary offsite easement
from the property owner of Tax Lot 00600, 2S1 05DC, where the public storm
line is proposed for termination into an existing drainage way. This drainage
way may be subject to sensitive land regulations in the City's development.
code, Clean Water Services standards and other regional and state agencies.
4. The developer will be responsible for obtaining any and all approvals for work
in the sensitive land area prior to construction.
5. The storm line will be installed by way of a boring operation, shown in the
LanDynamics LLC letter, dated July 14, 2003.
6. Because the subject site lies outside of city limits, the detail design of this
storm line and boring operation must be reviewed and approved by Clean
Water Services via a formal plan review process. This review would take
place at the time the infrastructure improvement design for the developer's
subdivision is conducted. No work shall be done until such time that this
approval is obtained.
7. The detail design shall also be reviewed and approved by the City, since the
affected parcel of land is City- owned.

Dear Dan:
This letter is to-follow up on our recent meeting regarding our request
for a storm sewer easement from the City of Tigard. Pursuant to your
request, the following is being submitted for your information to help
address your concerns regarding potential impacts to adjacent trees
and city property:
• A work plan and schedule of equipment for the proposed boring
operation from Gonzales Boring & Tunneling, Inc.
• A site plan showing the location of the proposed bore and storm
sewer line.
• A profile showing the depth of the proposed 12" (not 15 ") PVC
storm sewer line and casement.
It is our intent to construct the bore pit on the adjacent property
owned by out client. This will limit any impacts on city property to the
bore itself.
We are currently in the process of assembling our preliminary plat
application and anticipate submitting to the City in approximately one
month.

feet in length and 12 feet wide.

Work Plan / Boring Procedure
The steel casing will be jacked and bored simulttineously. A 30 inch Micro Tunneling
Steering_ Head will be used to steer and Maintain the elevation and alignment of the casing.
The cutting head shall be kept inside the Micro Tunneling Steering Head at all times to
prevent over excavating of soils. M no time will excessive soil be allowed to enter the Micro
Tunneling Steering Head. A continuous Monitoring of elevation and alignment will be done.

A lead 20 foot section of casing will have the Micro Tunneling Steering Head welded to one
end. the lead section along with the Micro Tu Steering Head will be installed. Once
the section of casing is installed, another 20+ foot section of casing will be continuously
welded at the joint of the lead section This process will continue until the crossing has been
completed.
All materials will be conveyed through the casing with augers and ejected out onto the left
side Of the jacking pit Once the material is ejected from the casing a hydraulic clam bucket
will remove all excavated materials from the bore pit and stock piled or loaded into dump
trucks.
All welds shall be full circumference, watertight welds. All casing joints shall be
continuously welded for the circumference of the joint. Welders that have 225 amps will be
used to fuss the joints together. Flux on the welding rod is &garlic. Rod type will 6010
electrodes. All welding will meet or exceed the requirements Of AWS1-A 5.1-81.
The support system behind the jack will consist of a 6 foot by 8 foot by 1 inch thick steel
sheet placed at the rear of the jacking pit and will set scant a vertical shored wall of the
support system wider the jack and at the bottom of the pit The bottom of the pit will be
graded to the Correct depth and slope as required, if the bottom of the pit is unstable, 1
2 inch crushed rock will be placed until a stable base is established. Once the bottom is
graded, 4 inch by 10 foot planks will be installed the full length of the pit. The jacking unit
will be set cat the planks.
A Bentonite slurry may be used to provide a lubricate to the exterior of the casing. All
Bentonite ports are located within the Micro ?Mewling Head.
Once the crossing is completed, the Mao Tunneling Steering Head will be removed
from within a termination pit (approximately 8' X 12'). A full size diameter auger will
them be lowered into the termination pit and attached to existing convey auger. Once the
auger is attached, then the casings will be cleaned of all soils. Upon completion of the
using being cleaned out, all augers will be removed through the jacking pit area The 15

casing will be fabricated out of new steel plate, meeting the requirements of ASTM A

RE: Request for Easement Along Parks Property — Impact Request

Dear Mr. Roy:
Per your direction the following is our formal request for a public utility easement along the Park
Districts Property located in the Southeast Quarter of Section 5 and the Northeast Quarter of Section 8,
�, Township 2 South, Range 1 West, Willamette Meridian, Washington County, Oregon. The meeting. on

April 15, 2003 with Steve Martin, Sean Foushee, and myself concluded with a meeting with you and
z a Steve Martin. Mr. Martin requested that we write a formal letter and note the impacts of the requested
z storm drainage easement on the City of Tigard Park's land.
t ` On May 16, 2003 a field survey was completed of the subject area. It was found to have a total of five
• (5) existing trees within the proposed easement. Three (3) of the trees were evergreen trees varying in
diameter and two (2) were deciduous trees. The grade of the area was 14% to 15%, sloping towards the
Northeast. Please review the attached drawing for exact location and area surveyed.
From the information gathered, the impact of the proposed storm drainage and easement would be
minimal. It does not appear that any significant trees will be affected by the proposed storm sewer line.
The proposed easement is 15 feet wide and runs along the entire 135 feet of the northern portion of the
site A 12 or 15 inch storm drain pipe will be running through the proposed easement and drain
approximately 200 feet to the east of the Park District's land. The design slope of the proposed storm
drain pipe will be 14.72% and will have an energy dissipater at the end of the pipe. The impact to the
Park District's land will mainly be during construction and project closeout. The affected area will be
�t s returned to its original state, or better, upon completion of the development
In conclusion, a formal request for your review and direction to this matter is herein requested. I look

attorney, it was decided to deny your request for an easement which would require
trenching to install a storm drain line.
As you know, the property in question is City- owned, and is designated as a "nature
park ". For this reason, and the fact that the requested easement will adversely impact
the 5 trees noted in your letter and another 10 trees identified by the City Forester.
Impacts, primarily as a result of trenching, to the root systems of the 15 trees will be
severe and may lead to the destabilization and /or demise of the trees.
Please be aware that the city would consider an easement on the property if the storm
drain line is installed by directional boring.

Attached is Matt's assessment of Pacific Civil Design's (PCD) request for
an easement across the southern portion of the city -owned Cache Property
on Bull Mountain.
Matt's assessment is more detailed than PCD's. Based on Matt's
assessment I propose the following recommendations:

Earlier today Steve Martin and I visited a souther portion of the city -owned Cache
Property on Bull Mountain. Our visit was in reference to a letter addressed to John Roy
dated June 4, 2003 from Erik Esparza of Pacific Civil Design (see attached). Mr.
Esparza's letter was requesting that the City of Tigard allow a fifteen foot easement and
the installation of a storm drain across a southem portion of the Cache Property. Mr.
Esparza indicates that the impact of the proposed storm drain line would have minimal
bearing on the existing trees. He also indicates that only 5 of the existing trees would
be impacted.
At your request, I measured the distance from the outside of the trunk of each tree to
the existing wire fence. I referenced the trees and the fence that are shown on the
plans supplied by Pacific Civil Design. I also recorded the diameter at breast height
(DBH- four and a half feet from the ground on the uphill side as per the Tigard Tree
Manual) of each tree specified on the plans. The amount of live trees that will be
directly and substantially impacted by the installation of a storm drain is 15. I only
recorded a tree if its DBH was larger than 6 ". The diameters range from 7" up to 39" at
breast height. The closest distance to the fence line of any tree that would be
significantly affected, is approximately 10 feet. The furthest distance is approximately
22 feet.
I feel that the installation of a storm drain would have very detrimental and severe
impacts on the 15 trees. The most significant impact will be cutting of the critical root
systems of the trees. Cutting the roots to the point of being able to install a storm drain
line will destabilize the trees and severely effect the trees' abilities to take up and store
water and nutrients from the soil. Although the storm drain will not be installed closer
than approximately 10 feet from any of the trees, the root systems for these large trees
extend out well beyond the 10 and even 22 foot distance. These trees are growing
together as a system, and allowing such an extensive impact to occur will also have
adverse repercussions to a number of the surrounding trees.
One solution that may be considered is directionally boring the storm drain line
underneath the trees. As long as the boring occurs more than four feet deep then the
impact to the trees should be minimal. The only other option to minimize the effects on
the trees would be to completely stay off of the Cache Property. If trenching for the
storm drain line does occur then the developer would be required to mitigate for each
tree that was adversely impacted on an inch for inch basis.

1 am considering an easement: request from a developer across a portion of the Cache Property. I have
required that they use the boring method to install a storm sewer line. There will be no impact to the
surface of the property.
I understand that the property was purchased by Metro and deeded to the City. My question is can the
city allow an underground easement on the property. /)
