This. matter :having been considered by the Board of County Commissioners
at its regular meeting of April 14, 1987; and
It appearing to the Board that the City of Tigard, Oregon has requested
of this Board its surrender of jurisdiction of a portion of County Road No.
429 (S.W. Durham Road) lying within the corporate limits of the City of
Tigard, said road being now under the jurisdiction of Washington County,
Oregon; and
It appearing to the Board that said road lies within the boundaries of
the City of Tigard and that jurisdiction over and across said road should be
transferred properly to the City of Tigard; and
It appearing to the Board that by its Resolution and Order No. 87-44
dated March 3, 1987, it duly required the setting of a time and place of
public hearing on said request and required that notice of said hearing be
posted pursuant to law; and
It appearing to the Board that in accordance with said Resolution and
Order, notice was duly given and a public hearing was held on this matter on
the 14th day of April , 1987, at the hour of 10:00 a.m. in Room 402 of the
Washington County Administration Building, Hillsboro, Oregon; and
It appearing to the Board that at said public hearing the Board heard
the matter and considered objections and testimony offered by all persons
interested in the proposed surrender of the jurisdiction, and the Board having
considered this matter found that the best interests of Washington County
would be served by granting said request; and
It appearing to the Board that it has, by Minute Order No. 85-451,
adopted a policy on transferring jurisdiction of collector and arterial
streets which establishes conditions which must be met prior to transfer; and
It appearing to the Board that an intergovernmental agreement, ensuring
the conditions established by the Board's policy, has been approved by the
City of Tigard; the Board hereby
FINDS AND DETERMINES that it is necessary, expedient and in the best
interests of Washington County to surrender jurisdiction to the City of
Tigard, Oregon, the following described road:

County Road No. 429: (S.W. Durham Road lying between S.W. Serena
Court and Pacific Hwy. ) That portion of County Road No. 429 lying
between the easterly right-of-way of Oregon State Hwy. 99W (S.W.
Pacific Hwy. ) and the centerline of S.W. Serena Court as established
by "Kenwood Estates", a subdivision of record in Washington County,
in Sections 11 and 14, T2S, R1W, W.M.
and it is therefore
RESOLVED AND ORDERED that the jurisdiction of the County over said road
as hereinabove described and responsibility for the maintenance, construction
and repair and the full and absolute jurisdiction over said road for all
purposes of repair, construction, improvement and levy and collection of
assessments thereof shall vest in the City of Tigard, Oregon, and the City
shall then have the same control , power and jurisdiction of said road as are
by its Charter and the laws of the State of Oregon given or granted over any
of the public streets and alleys of said City; and it is further
RESOLVED AND ORDERED that the Director of Land Use and Transportation of
Washington County, Oregon, be, and hereby is ordered to amend as necessary,
the official records of Washington County, Oregon, to indicate the surrender
of jurisdiction as herein above described ; and it is further
RESOLVED AND ORDERED that the Clerk of the County Board of
Commissioners, be, and hereby is authorized and directed to forward a
certified copy of this Resolution and Order to the City of Tigard, Oregon, as
due notice of the surrender jurisdiction.

SUBJECT: Durham Road Jurisdiction
Attached please find the paperwork which we received from Washington.County
concerning the recent surrender of jurisdiction of Durham Road. Please note
that the jursidiction shift was effective April 14.
The Operations staff will be taking steps to--mow the roadside prior to the
May 2 clean up day. Within the next three weeks, Washington County crews
will spray the roadside to retard plant growth. The effort by Washington
County is part of an agreement which we negotiated with them last year.

The City of Tigard has, by City Council action, reqquested the transfer of
jurisdiction of a portion of County Road No. 429 (S.W. Durham Road) from the
County to the City. The Boa_rd_, by Resolution and Order No. 87-44, set April
14, 1987 as the time for the Public Hearing on this matter. Notices were
posted as required by State law, and an affidavit was filed.
The. Board, by Minute Order No. 85-451, previously established a policy on
transferring jurisdiction of collector and arterial streets which establishes
conditions that must be met prior to transfer. These conditions were detailed
in an intergovernmental agreement that has been approved by the City of Tigard.
