ODOT - Cook Park River Edge Plaza SECE1VE® AGREEMENT OCT aiE�TE 'i;b��'a DIVIS101I THIS AGREEMENT, made and entered into this 25th day Of er- , 19_g_, by and between the STATE OF OREGON, by and through its Department of Transportation, Parks Division, hereinafter called "State," and: City of Tigard a municipal corporation of the' tate' of regon, hereinafter called ' ponsor WITNESSETH: WHEREAS, under Oregon Laws 1979, Chapter 405, State and Sponsor may enter into an agreement concerning rehabilitation of local parks, hereinafter called "Project," and State may make grants of money to assist Sponsor in such projects; and WHEREAS, State and Sponsor desire to make improvements as hereinafter described in the project application for the Cook Park River Ed a Plaza Project, O.P. 2326 maimed "Exhibit A"; NOW. THEREFORE, the premises being in general as stated in the foregoing recitals, it is agreed by and between the parties hereto as follows 1. State hereby approves the project described in the proposal attached hereto, marked "Exhibit A," and by this reference made a part hereof. The total value of the project .estimated to be $ 10,000.00 2. Upon completion of the project, State shall pay Sponsor $3,248.00 but not more than 50 of the total project costs. Advance payments, not to exceed 75% of the State Grant-In-Aid amount, may be made by the State. Final payment will be made upon completion of the project and audit by State of Sponsors records pertaining to the project. 3. Sponsor hereby warrants that it has sufficient financial resources to enable it to develop, operate and maintain the facility for public recreation, that the land shall be used only for park or recreational purposes, that control of the land shall be held by Sponsor, and that Sponsor shall not sell or otherwise dispose of the land except upon approval and consent of the State. 4. Sponsor shall have until May 1 , 1991 to complete the project and bill the State. Failure to meet such deadline shall terminate this agreement without obligation on the part of State to make any payment to Sponsor. However, this deadline may be extended by State for such a period of time as State may consider necessary where there are sufficient grounds, in State's opinion, to warrant such extension. Such extension shall be approved in writing. 5. Sponsor shall approve this agreement during a duly authorized session of its governing body. IN WITNESS WHEREOF, the parties hereto have set their hands and affixed their seals as of the day and year first written above. STATE GRANT-IN-AID FUNDS PROJECT NARRATIVE Cook Park, located along the Tualatin River between Tigard High School and the Tualatin Country Club, is the largest and the only regional park in the City of Tigard park system. Its some 51 acres include both natural and developed areas. The proposed project would improve an existing river front portion of the park, now overgrown .with bushes and canary grass, with a 300 square foot paved river edge plaza. The specific work to be done includes grading a 100 foot linear foot portion of the bank and installing grass crete brick pavers to expand and improve river access for bank fishing and non-motorized boats. As one of the few public park sites located along. the Tualatin River, the project would improve visual and recreational access to the river. The proposed improvement is in accordance with the adopted master plan for Cook Park. other proposed improvements include pathways, a handicapped viewing/fishing. area, and landscaping additions. The project addresses the specific need for water-based recreation facilities identified in the Washington County Comprehensive Framework Plan. With regard to the issue of wetlands, it is important to note is that, although the river overtops the bank for approximately one week per year, no portion of the site appears to be wetland in terms of federal guidelines. This assertion is supported by a preliminary site inspection and an examination U.S. Fish and Wildlife Service National Wetland Inventory Maps and Washington County Soil Survey Maps by the Corps of Engineers Permit Evaluation Section. PLANS AM SPSCIFICATICKS A prelimary site plan is attached. As shown,, a 300, square foot portion of the river front will be re-graded. To stabilze the bank and provide a hard surface for water-related recreational activities, brick pavers will be installed within the area. The cost of the grading the 100 cubic yards of material is estimated at $1,000. The per foot cost of installing the pavers is approximately $3.00.
