Gentlemen and Ladies:
The Oregon State Highway Division (State) . and the City of Tigard
(City) entered into Local Agency , Agreement No. 8876, dated October
18, 1986, concerning the installation of traffic control signals and
a . left-turn refuge at the. intersection of Beaverton-Tualatin Highway
at Burnham Street (project).
It has now been. determined by State and City that the aforemention-
ed agreement, although remaining in full - force and effect, shall be
supplemented by this agreement in order to update the funding structure
of the project. Any .further reference to the October 18, 1986 agreement
shall include the following provisions:
The project will be funded with a combination of City and State
funds on the following formula:
A. City shall provide funds to acquire necessary right-of-way.
B. City shall provide funds for construction costs in excess
of $130,000.
C. City's payment of $4,603.60 to their consultant for preliminary
signal design shall be deducted from their maximum contribution
of $32,690.59, leaving an obligation not to exceed $28,086.99.
D City shall also provide $31,713 of Interstate Transfer (e)4-
federal funds. for construction of the Beaverton-Tualatin
Highway at McDonald Street project.
E. State shall be responsible: for all preliminary engineering
costs except the payment 'by City listed under OBLIGATION .C.
F. State shall be responsible for all construction costs up
to an amount not to exceed $130,000.

City shall adopt a resolution authorizing its designated City
Officials to enter into .and execute this agreement.
IN WITNESS WHEREOF, the parties hereto have -set their hands and
affixed their seals as of the day and year hereinafter written.
This project was approved by the State Highway Engineer on October
18, 1986, under delegated authority from the Oregon Transportation
Commission.
The Oregon Transportation Commission, by a duly adopted delegation
order, authorized the State Highway Engineer to sign this agreement
for an on behalf of the Commission. Said authority is set forth in
the Minutes of the Oregon Transportation Commission.

A RESOLUTION OF THE TIGARD CITY COUNCIL AUTHORISING THE MAYOR AND CITY RECORDER
TO SIGN AN AMENDMENT TO AN EXISTING AGREEMENT WITH THE 'OREGON DEPARTMENT OF
TRANSPORTATION FOR TRAFFIC IMPROVEMENTS: AT THE INTERSECTION OF BEAVERTON-
TUALATIN HIGHWAY AND BURNHAM STREET.
WHEREAS, Resolution No. 86-111 was approved by. the Tigard City Council on
September 22, 1986; and
A
WHEREAS, Resolution No. 86-111 authorized the Mayor and City Recorder to sign,
on behalf of the City, an agreement with the Oregon Department of
Transportation identifying their' respective obligations relative ' to
improvements to the intersection of Beaverton-Tualatin Highway (Hall Boulevard)
and Burnham Street; and
WHEREAS, a similar agreement exists between the City and the State Department
of Transportation relating to improvements at the intersection of Beaverton-
Tualatin Highway and McDonald Street; and
WHEREAS, due to -recent changes in regulations regarding Federal funding, it
appears that Federal funding originally intended for the Burnham Street project
should be used on the McDonald Street project, with comparable. adjustments' to
be made in the State funding on the two projects so that the maximum total City
share of the two projects will not change; and
WHEREAS, an amendment has been prepared for the agreement approved by
Resolution No. 86-111 to authorize the revised funding described above.
NOW THEREFORE, BE IT RESOLVED by the Tigard City Council that: .
Section 1: The Council hereby authorizes, the Mayor and City Recorder to sign,
on lbehalf of the City, .an amendment to the. agreement previously
approved by Resolution No. 86=111 in order to authorize use of
$31,713 of Federal funds for construction of the Beaverton-Tualatin
Highway at McDonald Street project.

COOPERATIVE IMPROVEMENT AGREEMENT
PRELIMINARY ENGINEERING AND CONSTRUCTION-FINANCE
THIS AGREEMENT is made and entered into by and between the STATE OF
OREGON, acting by and through its Department of Transportation, Highway
Division,"hereinafter referred to as "State"; and the CITY OF TIGARD, a
municipal corporation of the State of Oregon, acting by and through its
City Officials, hereinafter referred to as "City".
RECITALS
1. Beaverton-Tualatin Highway is a part of the State. Highway System
under the jurisdiction and control of the Oregon Transportation Commission, -
and Burnham Street is a part of the City street system, under the juris-
diction and control of the City of Tigard.
2. For the purpose of providing acceptable traffic circulation
patterns on public highway, the State and City plan and propose to install
traffic control signals and a left turn lane at the intersection of
Beaverton-Tualatin Highway and Burnham Street, hereinafter referred to as
"project". Location of the project is approximately as shown on the sketch
map attached hereto, marked Exhibit "A", and by this reference made a part
hereof.
The project will be funded with a combination of City, State, and
Federal funds on the following formula:
a. City shall contribute $70,000 which will include a combination
of Interstate Transfer(e)(4) funds and City match.
b. City's payment ($4,603.60) to their consultant for preliminary
signal design shall be deducted from their total $70,000
obligation.
c. State shall match Federal Title II funds for a contribution of
$60,000.
d. State shal'l provide the unfunded balance, estimated to be $15,000.
3. By the authority granted in. ORS 366.770, the State may enter into
cooperative agreements with the cities for the performance of work on
certain types of improvement projects with the allocation of costs on terms
and conditions mutually agreeable to the contracting parties. Traffic
signal work on the project shall conform to the current state standards and
specifications. .
4. By the authority granted in ORS 481.850, State is authorized to
determine the character or type of traffic control signals to be used, and
to place or erect them upon State highways at places where State deems
necessary for the safe and expeditious control of traffic. No traffic
control signals shall be erected or maintained upon any State highway by
any authority other than State, except with its written approval .
NOW, THEREFORE, the premises being in general as 'stated in the fore-
going RECITALS, it is agreed by and between the parties hereto as follows:
STATE OBLIGATIONS
1. State shall , at City expense, conduct the necessary traffic
investigations, identify and obtain the required permits, arrange for
relocation of adjustment of any conflicting utility facilities, perform
necessary preliminary engineering and design work required to produce
plans, specifications and estimates., let the contract, furnish all
construction engineering, material testing, technical inspection and
project manager services.
. 2. State shall , upon completion of construction, perform and pay for
all necessary maintenance for operation of the traffic signal at no expense
to the City and shall retain complete jurisdiction and control of the
timing established for operation of the traffic signals.
3. State shall compile accurate cost accounting records and furnish
City with an itemized statement of actual costs to date, for :periodic
billings or at the completion of the project. The itemized statement will
include charges for State services including plans and specifications
review, project monitoring and material testing.
CITY OBLIGATIONS
1. City shall , upon completion of this agreement, deposit with State
its estimated share of the cost of preliminary engineering services to be
provided by the State.
2. City shall , prior to the State advertising for bids, forward to
the State an advance deposit equal to the total estimated project cost less
the amount of the initial advance deposit..
Upon completion of the project and receipt from State of an itemized
statement of the actual total. cost of the project, City shall pay any
amount which, when�ded to City's advance deposits, will equal 100 percent
of the City's share of the actual cost of the project, including

preliminary and construction engineering, and all contingency items
attributable to the project. Any portion of said advance deposits which is
in excess of' the City's share will be refunded or released to City.
3. City shall forward to State partially completed traffic signal
plans for State's use in designing the signals.
4. City shall, upon completion of the project, pay for 100 percent of
the power consumed in the annual operation of the signal .
5. City hereby grants the State the right to enter upon and occupy
City street right-of-way for the performance of necessary maintenance of
the traffic signal equipment, including vehicle detector loops.
6. " City shall maintain the asphaltic concrete pavement surrounding
the vehicle detector loops installed in City street in such a manner as to
provide adequate protection for said detector loops., and shall adequately
maintain the pavement markings hnd signing installed in accord with the
plans and specifications.
7. City shall , without cos:t -to the State, relocate, or cause to be
relocated , all City-owned utility conduits, lines, poles, mains, pipes, and
other such facilities located within or upon the right-of-way of a State
highway under a permit issued by the Oregon Transportation Commission upon
condition that the permittee will bear the cost of any relocation.

8. City shall ..adopt a resolution authorizing its designated City
Officials to enter Into and execute this agreement, and a copy of such
resolution shall be attached hereto and become apart hereof.

acted in this matter pursuant to Resolution No.
adopted by its City Council on the day of 1986.

install the desired signal and left-turn lane improvements and providing for
the allocation of project costs between the City and. the- State; and.
WHEREAS, the City has the required funds available in its adopted capital
improvement budget.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that:
Section 1: The Council hereby authorizes the Mayor and City' Recorder to sign,
on behalf of the City, an agreement with. the Oregon Department of
Transportation identifying their respective obligations relative to
