GARY L. HAAGEN and CANDACE C. HAAGEN, Trustees of the Gary L. Haagen Revocable Trust
U/A Dtd. 3/29/90 and GARY L. HAAGEN and CANDACE C. HAAGEN, Trustees of the Candace C.
Haagen Revocable Trust U/A Dtd. 3/29/90, each as to an undivided one-half interest as tenants in
common, Grantors, convey, warrant, and dedicate to the City of Tigard, Grantee, for the purpose of road and
utility improvements, for public road right-of-way, the following described real property free of encumbrances
except as specifically set forth herein, situated in Washington County, Oregon, to-wit:
See Attached Exhibit "A"
The true consideration for this conveyance is $49,000.00.
PARCEL I - FEE
The said property is free from all encumbrances, except for easements, conditions and restrictions of record.
PARCEL 2 - SLOPE EASEMENT
Including the right to construct and maintain slopes necessitated by the construction, operation, and
maintenance of the public road, all public facilities, and improvements in the adjacent right-of-way. Grantee
shall never be required to remove the slope materials placed by it on said property, nor shall Grantee be
subject to any damages to Grantors by reasons of any change of grade of the roadway abutting on said
property.
PARCEL 3 - TEMPORARY CONSTRUCTION EASEMENT
A temporary easement for constructing public improvements associated with the above mentioned project,
together with the right to remove, only as necessary, vegetation, trees, pavement, and other obstructions within
and adjacent to the public right-of-way on the parcel of land located at 12000 SW Main Street and described in
the attached Exhibit "A", situated in the City of Tigard, Washington County, State of Oregon.
THIS TEMPORARY EASEMENT allows the contractor access to the property for the sole purpose of
constructing the improvements. The contractor shall not be permitted to store materials or equipment with this
easement.
IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right, title, or interest except
those expressly stated in this easement, nor otherwise prevent Grantors from the full use and dominion
thereover; provided, however, that such use shall not interfere with the uses and purposes of the intent of the
easement.
The rights granted by this easement shall terminate at the end of the project or two (2) years, whichever is later.
