Dear Ms. Sheehan:
Your letter dated January 10, 1999 to the City Attorney was forwarded to me. It has also
been received by the City's Community Development Director, Jim Hendryx.
We understand the issues you are concerned with relating to a small number of clients.
When the City Council reviewed the appropriateness of allowing limited business in
residential areas, there was significant concern relating to allowing any business operation in
residential neighborhoods. As a result, standards and requirements were adopted by the City
Council to allow limited business operation in residential neighborhoods. The least impact
(Type I Home Occupations) were allowed outright as long as the requirements are followed.
No notice is required.
Businesses without customers usually create little impact on neighbors. Customers can
create impacts that are not of a residential nature. This requires a Type II Home Occupation
application where notice is sent to neighbors within 500 feet of the subject site. This is sent
to notify the neighbors so that they are aware of potential impacts. There is no licensing
involved with either a Type I or Type II Home Occupation, however, there is a business tax
required to be paid prior to conducting business within the City limits. The fee for both the
Type I and Type II business tax is the same regardless. A Type II land use approval
application requires a higher application fee because of the need for notice, the need for a
written decision including the possibility of conditions of approval and the increased potential
for code enforcement activity. To try to regulate a varied number of trips for each business
would tend to create a more costly enforcement process.
Home occupation requirements are quite specific to ensure there are fewer impacts on
neighbors. They apply to all areas of the City and reflect the needs of the majority of those
affected. Enforcement of the requirements comes through complaints by neighbors.
To change the code provisions requires an amendment of the development code. This
involves preparation of an application, two public hearings to determine if the change should
be made and fees of $240 for a pre-application 'conference and a fee of $1415 to consider
the amendment.

Dear Sir;
I am writing to protest the limitation of no visits from clients to my home-based secretarial
service, I work pain time, and there will be times, probably throe or four times a, year, and a visit
of up to a maximum of 30 minutes, when it is more convenient for clients to come to my home. It
will be very awkward for me to say to them that 1 cannot allow them to come, as the City of
Tigard will penalize me and bump me up to a more expensive license fee,
I am told there is no provision for part time vs. full time, and that the license is very restrictive, in
that no one is permitted to come to my home, Such a condition is very unfair, and 1 am surprised
that such a harsh statute was written, An increased number of visits by clients would soon
become apparent, and then there could be a penalty or increased rate imposed,
Could there be an amendment enacted that would put a limit on the number of visits by clients,
say, 10 a year, or even less?
