I searched our planning records and we have two Conditional Use Permit modification land use cases from 1991 (CUP1991-00005) and 1995 (CUP1995-00005). I've uploaded the documents for the two land use cases in the folder below, please let me know if you have any issues accessing it. El 11305 SW Bull Mountain Road Our records indicate the property was annexed into the city in 1983. If the church was built before the property was annexed, it is possible the original CUP was issued by Washington County. Even so, per Tigard Development Code 18.765.020, a modification is required for "all proposals to modify an existing development that was not subject to city approval when developed but would be subject to city approval, through one of the land use applications listed in Paragraph 18.765.020.A.1 through 4, if proposed for development under current city regulations." I previously spoke with Pastor Dorothy regarding the reported concerns involving your property. During our conversation, Pastor Dorothy refuted the concerns regarding the nuisance code 1 violations and indicated that your property is being utilized for commercial use involving the Harvest Hosts program. At that point, I accepted Pastor Dorothy's statements as being made in good faith and indicated that if she obtains land use approval from the City's Planning Division for the commercial use of your property under the Harvest Hosts program, I would close the associated code compliance case. Subsequent to that discussion, Planning contacted Pastor Dorothy and explained the land use approval process and what is required to continue engaging in the commercial use of your property for the Harvest Hosts program (see attached email). As per our typical protocol, once we receive confirmation that a party has entered into the land use approval process with Planning,we typically suspend enforcement during that process. Please follow Planning's guidance regarding the necessary land use approval steps. If you have any questions, please feel free to call me at 503-718-2581.
