EXPLANATION OF ISSUE
Council update of the Council Goal'Reduce Houselessness."The briefing includes the required bi-annual review of the
Time,Place,Manner ordinance.
ACTION REQUESTED
The presentation reviews progress on the five strategies that the Council adopted for the Council Goal,'Reduce
Houselessness".
There are four specific policy questions where direction from the Council will help form
houselessness-related workplans for the last six months of the year.
BACKGROUND INFORMATION
Dates of Previous and Potential Future Considerations
This briefing continues the regular series of briefings updating the Council on the City's response to houselessness.If
Council directs teammates to update Time,Place,Manner, then teammates will come back to Council with an
ordinance.
Public Involvement
Teammates asked CHART for feedback on the staff recommendations for the Time,Place,Manner ordinance and
CHART endorsed the proposal.
Impacts (Community,Budget,Policies and Plans/Strategic Connection)
This briefing is an update on progress to the Council Goal'Reduce Houselessness'.
ALTERNATIVES&RECOMMENDATION
Teammates recommend that Council direct staff to amend the Time,Place,Manner ordinance to prohibit camping on
paved areas of City property and restrict community members from leaving belongings on City property for more than
48 hours. Council may endorse this recommendation or direct staff to an alternative.
Teammates are interested in discussing Safe Rest Pod Villages in relation to the other services being provided now and
into the future in Tigard.

Shelter options in Tigard have expanded in the
last 1 .5 years
• Expanded to serve 70 families a night at Bridge to Home
Family shelter •Also provides wrap-around services: food and clothing closets, case
management, and more
•Just Compassion expanding from a 20-bed shelter to a 60-bed shelter
Adult shelter • Dedicated resource center space with expanded hours
• Inclement weather shelter available
• Opening Tigard's first location at City Hall later this year

Safe Rest Pod Villages: Background
Washington County has established three Safe Rest Villages in
Cornelius, Aloha, and Hillsboro.
Safe Rest Villages are managed by a shelter operator, Open Door
and shelter 30 households.
Established as a temporary solution as more permanent shelter
capacity is constructed.

Safe Rest Pod Villages: Background
The Safe Rest village in Hillsboro will close later this year. The site
is the location for Hillsboro's new year-round shelter.
Washington County is interested is moving the Safe Rest village
to SE Washington County

In July 2023 City of Tigard established rules about when, where, and
how people may camp.
• Time — Allowed between 7 p.m. and 9 a.m.
• Place — Not prohibited on downtown City-owned property and
limited other areas
• Manner — Rules prohibiting some behaviors to keep public property
maintained and available for public use

• Focuses on the 'Manner' portion of the ordinance — no time or place restrictions

Supreme Court: Johnson v. Grants Pass
• Whether the enforcement of generally applicable laws regulating camping on public property constitutes
"cruel and unusual punishment" prohibited by the Eighth Amendment.
• City argued ordinances merely bar camping on public property by everyone
• Appellants argue the laws effectively make it a crime to be homeless, which violates the Eighth Amendment
• Comparison to Robinson v. California (1962): law criminalizing being a drug addict violated Eighth
Amendment cruel and unusual punishment
