My name is Roger Potthoff. I recently called into a City Council meeting to express my concern relating
conditions on properties immediately adjacent to my home at 11710 SW Ann St., which are proving attractive
to rats. Indeed, infestation is not an exaggeration, when viewed through the lens of public health and safety
and peace of mind. This email is in follow-up to those concerns.
Attached to this email is my written statement (in letter format) addressed to the COT elected officials and
staff. The attachment is titled "3-4-22 Ltr to Cncil", and is intended to provide context for what has been
happening on SW Ann Street over the past seven years, and the what residents in this neighborhood have
been complaining, but doing nothing about - except for me, but that is changing now as others are fed-up and
starting to do something about it.
I ask that you read my letter before viewing the supporting documents and photos which are attached
to/imbedded in this email. The letter will make clear my motivation in bringing this compound set of problems
to your attention - again. The letter will also make clear the three properties at issue and help you understand
the organization of the photos and documents which relate separately and severally to the three subject

You can expect that I and others from this neighborhood will be available to discuss with you and COT staff the
broad range of concerns and possible remedies that relevant to this matter. I know there is a lot to review
here and think about, but as warm weather returns and rodents become more active in breeding and feeding,
remedying these conditions becomes extremely important and urgent. It really is a public health and safety
matter, and from my evidence it has been getting worse. The 15 rat photos of dead rats are not even close,
not at all close, to a full accounting of this infestation.

My name is Roger Potthoff. I, along with my wife Marky, live at 11710 SW Ann Street in Tigard. This
has been our home for over 22 years. We have a nice home, and we are inspired to keep it that way.We
are both retired. I am 73,and Marky is 70.We are physically healthy, socially responsible,prudent in
following Covid pandemic protocols, and thus far, financially secure.Nonetheless,we have growing and
long festering concerns about the livability and character of the deteriorating condition of three properties
on SW Ann Street- 11650, 11770 and 11890 SW Ann St. The overarching concern we have relates to the
risk to public health and safety, and indeed our own health and peace of mind. The source of our concerns
is the willful neglect,and open contempt for COT ordinances, specifically TMC Chapter 6,by
the owners and occupants of said properties. This neglect includes intentional engagement in non-
conforming uses, lack of maintenance,and most seriously allowing or even creating conditions attractive
to insects and rats at these properties,i.e. food and habitat,putting the health and safety of all living in
and near this neighborhood at risk. I have included documents and photos as evidence of these conditions.
My efforts to remedy them dating back to May,2015,when I first filed a Nuisance Code Compliance
request relating to what was then the early stages of degeneration at 11650 SW Ann St.
The date of my first email to the City of Tigard(COT)is May 11,2015. The COT acted on that email and
the photos attached thereto by issuing Code Compliance Request(CCR),with a case number of
NCC2015-00053 on May 28,2015.Which case was erroneously closed on false information given to the
COT by the homeowner at 11650 Ann St. Councilor Newton may have some recollection of those
events. That original complaint was reopened on June 25,2015 with a case number of NCC2015-00076.
The status of that case is now, seven years later, still listed as"Pending Compliance."The photo evidence
of those 2015 conditions,along with photos from 2018,2021 and 2022 are all included with this
transmittal via URL links found at the end of this written statement. Those photos show the worsening
conditions over time,as nonconforming uses, storage of junk and disregard for proper maintenance
creating attractive habitat for rats are evident. I think you will agree these conditions remain and present
a grossly unacceptable risk to public health, and the livability and character of this neighborhood.
I ask that my emphasis on public health and safety be kept in mind as you read this statement and view
the photos. I want to be clear to all of you reading this letter that my concern is not centered on aesthetics.
It is NOT about an un-mowed lawn,peeling paint, loud late night parties or engine noise, etc.NO! This
letter is, as I just stated, about public health and safety and the livability and character of this
neighborhood. Specifically, it is about TMC, Chap. 6.02.15 "Storage of any materials including wastes or

maintaining any grounds in a manner that may attract or aid the propagation of insects or rodents or
create a health hazard is declared to be a public nuisance in violation of this title. (Ord. 12-02§1)"
My wife and I realize fully that there is a lot of discomfort,pain and suffering happening in the world,
beyond Ann Street, indeed in and beyond Portland. We are no less affected than others by the stressful
circumstances roiling society-the economy,homelessness, Covid's impact on education,child care,
health care,the impact of extreme weather events, a war in Europe,the disheartening property damage
and violence that has ravaged downtown Portland—which, once upon a time was vibrant and more artful
than it was weird and violent. So please don't think of us as not having contextual awareness of what is
going on in the world. Rather think of where we, any of us,you included,go to find sanctuary from all
this stress,pain and suffering in the world?Where does one find a safe harbor?Where indeed-if not at
one's home?
What I have offered thus far is context for why I am moved to file CCRs and to write this letter. I address
it to you individually and collectively as persons in positions of public trust,because the subject of this
letter as noted above is the Tigard Municipal Code,Nuisances Affecting Public Health, Safety and Peace.
You know as well, or better than I that in these times,"Public Health, Safety and Peace"are such
important subjects. Subjects which require that all of us—people in government,and people living and
working in Tigard-come together to safeguard the Public Health, Safety, and Peace of this place we all
call home.
Those of us living in Tigard should upon reflection have little doubt that we are fortunate to be living here
and in this wonderful place called Oregon. Tigard neighborhoods differ somewhat from one another, as
architecture and zoning laws change,but to my eye- and I walk and bike the neighborhoods of Tigard a
lot-there is little if any evidence of blight engulfing these neighborhoods,whether they were built 60 or 6
years ago. The tell-tale signs of blight—deferred maintenance,unsightly dis-repair, decay and
abandonment—are rare exceptions,very rare. There are no clusters of yards overflowing with junk,with
evidence of broken promises and dreams,of lives in distress. It does happen here,but not at scale—not
where the character of an entire neighborhood,or street is made to appear as degenerating. It is rare, even
"shocking"to see anything close to such neglect in the neighborhoods of Tigard,neglect that leaves one
to wonder aloud in disbelief"what is going on... who lives there?"
You will see from the photographic evidence attached,or otherwise digitally provided,that after walking
and biking around Tigard,returning to my home on Ann Street,to this Laron Heights neighborhood, and
there is a difference here on SW Ann Street, a shocking difference. The truth is that for too long there has
been trouble here. As noted above, I have been sounding the alarm and supplying the COT with evidence
since 2015. Code Enforcement Officer Ken Ross,who is included in this transmittal,has been attentive in
addressing elements of those CCRs from me and others on Ann Street, and no doubt from elsewhere
across this City of over 50,000 people. But the glaring and some even less obvious but more threatening
conditions which pose the greatest risk to public health and safety remain. Indeed, over the considerable
time before Ken Ross assumed his role as enforcement officer,attention to CCRs was an even less urgent
matter. I direct your attention to the"Pending Compliance"status stated clearly on COT's Complaint
Search page at the web site for all of the CCRs noted in this statement. I have included copies of those
current status reports in the attached documents for each of the three properties that are at the center of
my concern. You will see in the photos that conditions have grown worse. And as far as I can tell from
my personal experience in these matters,Ken Ross is working his tail off—he is not the problem, indeed
not. I mean even the Lone Ranger had a wise and sage-like companion in Tonto! And even a"silver
bullet", so I complain not about Ken Ross,neither his efforts or his resolve. He is not the offending party
here on Ann Street.
I have an archive of photos supplementing my original May,2015 complaint, and those I filed in June,
and August,2021,all of which cases are still pending. I want you to see those photos. Because the public

health, safety,peace and yes, even the prosperity of Ann Street is unraveling like you won't believe. At
long last, I am no longer alone in my concerns. Over the past 24 months other neighbors have come to
realize that"hoping for the best"is not a winning strategy.Neighbors have expressed not only support for
my enforcement actions,but have shown their own willingness to file complaints, if that will help.
Indeed,on Ann Street the credo of good governance and responsible citizens, living with the motto"A
Place to Call Home"is alive(!),but it is being threatened and we collectively want the threat to public
health threat and safety abated.
Specifically,on Ann Street two non-owner-occupied residences(11650 and 11770 SW Ann St.),whose
occupants are the adult children of the owners,are properties that are located immediately adjacent to my
and my wife's property, one on the East and the other on the West property lines.I have active complaints
"pending compliance"on both properties. These adult children of non-occupying owners have not only
failed to maintain the homes and yards they occupy as tenants,but their failure falls squarely within the
prohibited range of neglectful, offensive maintenance contemplated in the language of TMC Chap.
6.02.15,as quoted above.Again,the photo evidence,past and present,that I have included with this
letter, or otherwise will digitally provide,is irrefutable in showing how conditions at these properties have
negatively impacted the health, safety and peace of this neighborhood.Add to these errant"tenants"on
either side of our home,there is three houses to the west on Ann Street, an eccentric,non-threatening,yet
not-so-charming fellow, seemingly adamant that along with his eccentricities comes an inalienable right
to offend all or anyone—if only through neglect.Add all this together and you have The Nightmare on
Ann Street.
I realize this must be hard to believe,but look at the attached photos of conditions at 11650 SW Ann
Street, 11770 SW Ann Street and 11890 SW Ann Street. All three of these properties currently have
unresolved Compliance Code Requests and the corresponding Nuisance Code Compliance(NCC)case
listing online shows a status of"Pending Compliance."The"Pending Compliance"case numbers for
11650 SW Ann St. are: NCC2015-00076,NCC2021-00116 and NCC2021-00203. The case numbers for
11770 SW Ann St. are: NCC2021-00055 and NCC2021-00211. The case number for 11890 SW Ann St.
is: NCC2021-00054.
There are non-exculpating back-stories for two non-owner-occupied properties that provides important
context,but that additional information can wait.Now I want to help you gain perspective by inviting you
to open the photographic evidence. You will see what is driving my and my wife's concerns regarding
these offending occupants(I hesitate to refer to them as neighbors)and their willful acts and omissions
resulting in devastating negative impact on this neighborhood. You may recall Mayor Snider used the
word"shocking"in describing the condition he saw and photographed at 11650 SW Ann Street. You'll
see.
Of course, given the circumstances we are confronted with(which you will soon see),we have contracted
with two pest/rodent control services: Axiom Pest Control; and Nature First Pest Control.Of course,under
the circumstances (which you will soon see),we have contracted with two pest/rodent control services:
Axiom Pest Control; and Nature First Pest Control. The latter service is Tigard based and specializes in
rat control. See the attached file labeled, Tigard Man Develops Rat Control Device—Tigard Life. These
pest control services use what I refer to as"phantom"rat control tools. Phantom because there is no hard
evidence that rats have interacted with the tool.Axiom uses those black plastic boxes with poison bait
tucked securely inside so pets can't ingest the poison.Nature First does not use poison,Randy Witten,
Nature First founder, is very adamant about not putting poisons into the natural food chain. His device
dispenses a contraceptive that impedes or eliminates a rat procreation. I understand that the occupants at
11650 SW Aim St. only recently, in July,2021 or thereabouts, contracted with a pest control service,and
only after COT Code Enforcement Officer Ken Ross told them to get a regularly scheduled pest service,
so as to provide some evidence of efforts to mitigate the mountain of evidence I have provided to the
COT-photos of rats, open food sources,and habitat attractive to rats, i.e. feed for dozens of chickens,

ducks,two goats,and four dogs, open storage of junk,yard debris,etc. You will see those photos as many
of them are being submitted for your consideration as attachments to this letter.
As a final component in this the First Set of Attachments to this letter,which First Set is related to rats
rather than specific conditions at the three aforementioned properties on SW Ann Street, I am providing
for your consideration in amending the TMC regarding rodent control, copies of what I believe may be
the most relevant sections of the"Portland City Code—Title 8 Health& Sanitation, Chapter 8.40 Rodent
Control."This attachment is labeled,Portland Rodent Control Code Chap. 8.40 BinderFile. This
information on the City of Portland Chap.8.40 is only the beginning of what I can and will contribute to
the effort to revise the TMC. But in the mean time let's support Ken Ross in his very important work.

8.40.130 Demolition of Rat Infested Buildings.
City Code Section)
(Amended by Ordinance No. 176955, effective October 9, 2002.) It is unlawful to demolish, wreck or raze any
building in the City used for commercial purposes or as a warehouse, barn, or stable, under order of a department
of the City, until the Bureau of Health shall have certified that it is free from rodents. The certificate shall state that
the premises have been baited with rat poison in a manner approved by or under the direction of the bureau.
When such a building is vacated for the purpose of its being demolished, wrecked, or razed,the owner or person
having control of such premises shall report such vacation to the Bureau of Health within 3 days. The Bureau of
Health shall immediately cause an inspection to be made of the premises, and if the premises are found to be
infested with, or to be a breeding place for rodents, they shall be baited or treated under the direction of the
Bureau for a period not to exceed 30 days, at the expense of the owner or person having control of the premises.
Upon receipt of an application for a permit to demolish, wreck, or raze a building in the City, it shall be the duty of
the Bureau of Development Services to report such an application to the Bureau of Health. No permit for
demolition, wrecking, or razing shall be issued until the Bureau of Health certifies to the Bureau of Development
Services that the building for which the application is made has been found free of rodents or has been treated or
baited in the manner herein stated.
In the case of demolition, wrecking, or razing by the City under authority of an ordinance, the City shall be entitled
to recover the cost for baiting or treating such premises in the same manner as it recovers other expenses incident
to such demolition, wrecking or razing.

set in an approved manner. Any person who shall have caught a rat shall inform the sanitary division of the
Bureau of Health and keep such rat until disposed of under direction of the Health Officer, if he shall have been
instructed by the officer so to do.

feeders. These have long been seen as a prime attractant for unwanted
rodents. But instead of removing backyard feeders, the dome is simply placed underneath them,where seed
dropping to the ground provides additional bait. If a feeder is not present, one containing specially baited
seed can be installed inside the dome.
"That's my target market," he says. "Because instead of quitting feeding wild birds,why don't we just put my
unit underneath that bird feeder?We let the wild birds scatter some seed around it every day where the rats
can find it next to my unit."
The dome is the result of trial and error over the past several years, and Witten intends to introduce the
finished product to the public only in Tigard at first in a sort of proof-of-concept program. He plans to
crowdfund money for manufacture and distribution at first,while equity investors are already waiting in the
wings.
Witten is so confident of success he isn't even worried about the inevitable knock offs that are sure to follow
if his product works as intended.
"I'm offering it to Tigard first, as we prepare for a national launch" he said. "I'm on a mission,we will
change how rats are managed or how pests are controlled in an urban environment. We will change the
world."

I submit for your review the attached video and photos (date stamped 6-19-2015) which provides evidence
that my neighbor Michael Sprague is allowing the 18 or more chickens kept on his property to run free in an
area that is closer than 100' to the footprint of my house. The link to the video appears below, the video file

I feel this represents a willful breach of Sprague's commitment to keep/confine the chickens to the coop and
thereby maintaining the 100' minimum. Please note that when I was standing on 116th Ave. shooting the
attached video and photos, Michael M. Sprague, the homeowner, was himself standing in the side-yard taking
a photo of me(!) as I was photographing the chickens. There is no doubt he was aware of
the chickens running free. This was not a case of the kids or someone inadvertently leaving the gate open and
allowing the chickens to escape. In fact in reviewing the attached photos you will see that the door of the
coop is not merely ajar, but fully opened(180 degrees) and secured against the frame of the coop.
I have also attached photos, again date stamped 6-19-2015, that show several 3' diameter stainless steel duct
connecting collars being stored on the property and as such is evidence that Sprague remains out of
compliance and thus the NCC was closed prematurely. The NCC case should remain open for enforcement
pending meaningful ACTION(!) on the part of Sprague, not idle self-serving comments about "repurposing"
this scrap metal - someday somehow.
I also have photo evidence of the four dead rats but I will hold that evidence pending the meeting at my home
with Nature First Pest Control, scheduled for tomorrow, Tuesday, 6/23 at 3:00pm. I do hope that Tim will be
able to attend that meeting.
I appreciate the attention that both of you and the COT is giving to our concerns.

Mr. Lehrbach,
This email correspondence is in follow-up to our brief meeting last Friday (May, 8th)
regarding the City of Tigard-Code Compliance Request(COT-CCR) that I submitted
along with photographs showing possible code violations at the residential property
located 11650 SW Ann St., Tigard, OR (owner Michael Sprague, Sr.). Please note
that the property which is the subject of my CCR is immediately adjacent to my
residence at 11710 SW Ann St., where I and my wife Mary Potthoff have made our
home since August, 1999.
As you suggested at the conclusion of our meeting, I am submitting this written
narrative to provide context to the photos in order that your office may better
understand the situation and whether action on the part of City of Tigard is legally
warranted and what remedies are appropriate. As you know from having seen the
photos, I have several areas of concern as to the manner in which the subject property
is being occupied, maintained and used. On the evidence at hand I am concerned that
the subject property may be out of compliance with elements of the COT Building
Code(Septic Drainage; Business License), Development Code (Home Occupation

Permits), Nuisance Code (Attractive Nuisance in the form of large sections of scrap
metal tubing stored openly in side yard accessible from the street on 116th Ave. ;
Debris, Rubbish, Refuse; Fence in disrepair constructed and owned by homeowner;
Livestock and Poultry, a pig and approximately 18 chicken hens, being kept in
insufficiently fenced areas that are less than 100' from the nearside exterior wall of
my home; Odor that is periodic, highly offensive, which I believe to be related to the
condition of septic system drain field being in a state of collapse.)
Beyond these points just described I think it important that your office know that I
come to the decision to file a COT-CCR only after both my wife and I have discussed
our concerns with the homeowner Michael Sprague, Sr. and also his adult son who is
also named Michael Sprague. Clearly these people know that the fence and the
animals have been a concern, one that they admit is valid. The fence is falling down
and is an issue related to but separate from the fact that the manner in which they are
keeping the pig and chickens is out of compliance with the Tigard Municipal Code. In
fact, the Sprague's told us last autumn, as the rains were about to begin, that they
would have to attend to fixing or replacing the fence in the spring. And we said that
we would participate in getting that done. Well, as this mild spring has been with us
for a couple or three months, there has been no action or suggestion coming from
them. I informed them of my having obtained cost estimates from two highly
reputable fence contractors (Creative Fencing & Decks and Superior Fence) for
pricing on a new wood privacy fence($5,000) and a steel wire cyclone fence($1,300).
I made clear my strong preference for a privacy fence and cited the condition of their
backyard as fueling my resolve and my sense of urgency to get going with the privacy
fence. There has been hemming and hawing around the subject of the fence, but no
action and no agreement as to how and when to proceed.
Please note that over the past few months things have deteriorated further in regard to
all of my concerns and last week I made a non-emergency call to the Tigard Police to
come to my home and as a matter for the record to assist me in removing (again) the
Sprague pig from my backyard as it rutted thru the garden. Tigard Police Officer Eric
Enzenberger responded, we returned the pig to the Sprague's and Officer Enzenberger
stayed to moderate a conversation between myself and Michael Sprague and his son.
I expressed all of the concerns that are outlined in this message to you. In that
discussion, I made clear that my preference for a wood privacy fence (written bid of
$5,000 including removal and disposal of the existing old privacy fence) , while
acknowledging Sprague's preference for a lower cost cyclone fence (estimated cost
from Superior Fence being $1,300.) I then directly proposed to Michael Sprague with

Tigard Police Officer Eric Enzenberger present, that if Sprague would contribute
$1,300 toward the $5,000 cost of the clear cedar wood privacy fence I would assume
cost responsibility for the $3,700 cost balance and take ownership responsibility of the
new fence. Sprague refused to accept or decline my offer, responding with, "I am not
going to say yes, or no. I don't make snap decisions. I made a snap decision once,
and I regretted it."
At this point Michael, the son, asked me, "If we agree to pay the $1,300 does that
mean that we can keep the pig and chickens as they are now."
In response to the son's question, I said, "I do not have authority to grant waivers to
anybody in regard to being in compliance with the City Code or any City ordinance.
The rules apply to everybody in the City and we all are going to abide them. That's
the way it is when you live in a City."
Finally, based on comments from Michael Sprague, Sr. I believe that he is: i) loath to
spend or contribute money to resolve the fence matter; ii) unwilling to spend money to
connect to the City sanitary sewer (as he also refused in 2008-2010 missing the City
incentives )and to thereby correct the then predictable, and presumably now, failing or
failed condition of his 50 year old septic system; iii) unmoved by any suggestion that
by ignoring or postponing any remedial action that qualifies as "prudent" in managing
the health, environmental and livability risk that his septic system presents; iv)
unwilling to accept the current low market price applicable to the scrap metal he is
storing in his backyard, visible from 116th Ave., and by such sale cause the scrap
metal to be removed from the property; v) unwilling to pay the business license fees
and the home business occupancy permits for the two businesses they have registered
with the OR Secretary of State(SOS) showing 11650 SW Ann St. as the business'
location, copies of the OR SOS business registrations were provided to you with my
CCR; and last or not, vi) Michael Sprague appears convinced that he has the right to
ignore his increasingly deleterious impact on the quality of life and the character of
this community, and to ignore his responsibilities to become aware of and comply
with the Tigard Municipal Code, et al.
So as the residential real estate market continues to recover in Portland and Tigard,
and our job market and economy improves, the excuses that may have been acceptable

during the low ebb of the recession for home owners deferring maintenance and less
stringent code enforcement must be now and again much more carefully balanced
with the overall character of our neighborhoods and from a financial perspective the
City Code recognizes and protects the interdependent nature of home valuations
within these neighborhoods. I and my neighbors need some protection, take another
look at the photos.

violation of the following TCDC provisions. The list below does not include the noise complaint relating to the roosters crowing
loudly beginning at 4:30am. That concern/complaint, as you explained, is already in process as NCC2021-00116.
The TCDC references below include a numeric reference to the attached zip file photo(s). You will find the appropriate photo
numbers at the end of each 8 TCDC references I have given. Here goes. (Let me know if you have difficulty opening the zip
file, as it is approximately 70mb. I will come up with a work-around if necessary.)
1. TCDC Chap. 5.04.050 One Act Constitutes Doing Business (Photos 002, 003,005,006,007,008,009)
2. TCDC Chap. 6.02.120 Vision Clearance Requirements (Photos 006, 007, 008, 009)
3. TCDC Chap. 6.02.140 Accessory Structures (Photos 012, 014) Note: TCDC 18.290.050 provides, "The maximum size of
Accessory Structures is 528 sq. ft. on lots less than 2.5 acres...." It is unclear as to whether the 528 sq. ft. limit is per
structure, or is a limit on the cumulative area of multiple structures.)
4. TCDC Chap. 6.02.150 Insects and Rodents. (Photo 018) Note: The backyard of the property, clearly visible along 116th
Ave. and from my property, serves as an open area for the commingled habitation of 2 goats, at least 10 ducks, and
approximately 10 chickens (including 2 roosters). The area also includes a chicken coop, feed storage, a water pool for the
ducks, et al. Small area lots of animals, lots of feces. Rodents? I have those photos too. I also pay$104/qtr. to Axiom Pest
control who maintain 4 rodent industry compliant poison feed boxes along my property line.
5. TCDC Chap. 6.02.220 Open Storage of Junk (Photos 010, 011, 012, 013, 014, 015, 016, 017, 018, 019).
6. TCDC Chap. 6.02.230 Scattering Rubbish (Photos 010, 011, 012, 013, 014, 015, 016, 017, 018, 019).
7. TCDC Chap. 6.02.050 Offensive Wastes Prohibitive (Photos 010, 011, 012, 013, 014, 015, 016, 017, 018, 019).
8. TCDC Chap. 10.28.030 Parking: ...Trailer...Restrictions (Photo 004) Note: I could not find specific language requiring a
utility trailer that is parked on public street to have a vehicle license plate properly displayed, but I assume such a parking
code provision exists.)
I realize that this is a lot of stuff. You may or may not find that all or any one of these TCDC references apply. Maybe I do not
understand the TCDC, or maybe this neighbor believes that the rules don't apply to them. And just so you know, in the past,
2015 and 2018, I have offered to seek resolution through the collaborative process that is available to Tigard residents
through the Beaverton dispute resolution service. The answer was then "NO," I will through your office make the same offer to
this neighbor. Who knows... and so here I am again, as if we all don't have something better to do.
