HomeMy WebLinkAboutApplication_TCOB Application Narrative_NEW CODE_06.16.25 Tigard's Carts on Broadway Proposal Narrative: It is our understanding that the proposed Tigard's Carts on Broadway meet all approval criteria, regulations and development standards that pertain to the City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards. A. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section A: The food cart pod must be located in a base zone that allows Indoor Sales and Services uses. The food cart pod is located at 11847 SW Pacific Hwy. which is a MU-CBD zoned lot that is slated for non-residential use and is the location for Broadway Furniture. The cart locations on the property meet the minimum setback standards for the building which is in a MU-CBD zone. B. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Cart Pod Standards, Section B: The food cart pod must include at least one permanent building on the property that provides public restrooms. There is an ADA accessible restroom available to patrons of Tigard's Carts on Broadway located inside of the main building at 11847 SW Pacific Hwy. Visible signage and directional arrows will be installed to assist in directing the public to the restroom(s). C. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section C: Any new building of more than 800 square feet must meet the minimum and maximum setback standards for the base zone. There are not any new permanent structures being added to the site. Existing structure(s) do not exceed 800ft2 and therefore will not be subject to setback standards. D. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section D: The food cart pod must not include more than 20 food cart stalls. Tigard's Carts on Broadway proposes a food cart pod with 6 cart stalls with one cart occupying each stall. E. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section E: Each food cart stall must be a maximum of 375 square feet and contain no more than one food cart. Each food cart stall is 300ft2 as shown in the site plan and will be marked on the ground in paint. F. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section F: All food cart stalls must be located on paved areas and all stall locations must be demarcated on the pavement in a permanent manner. The entire proposed pod area is fully paved, and once the utility boxes and hookups have been secured, each spot will be clearly marked in a permanent manner with paint on the asphalt as shown on the site plan. G. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section G: All food cart stalls must meet a minimum six-foot setback along all street property lines. The entire pod is located a significant distance from any road, meeting the 6ft. minimum requirement. H. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section H: All food cart stalls must meet the minimum setback standards along all other property lines that apply to a new nonresidential building in the base zone in which it is located. Where a property is adjacent to a residential zone, the food cart stall must meet a minimum 20-foot setback. The entire pod is setback a minimum of 7' from any property line, meeting the minimum requirement. I. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section I: All food cart stalls must be separated from other stalls by a minimum of five feet. All stalls are separated by 5 ft. and are marked by paint on the ground as shown in the site plan. J. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section J: The food cart pod must include centralized on-site facilities for the collection and removal of fats, oils, and grease, as approved by the city engineer. We have secured a designer and excavator to implement an approved FOG management system. We are requesting this to be considered as a condition of approval. K. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section K: Utility connections, including electricity, potable water, and water disposal must be provided at each stall in the form of temporary connection assemblies, such as those used in recreational vehicle parks. Permanent utility connections to carts are not allowed. Water disposal connections must be connected to the required centralized fats, oils, and grease management system. All proposed utility connections and connection assemblies meet these criteria. L. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section L: The site must be arranged and demarcated in a manner to ensure that food cart stalls do not obstruct or otherwise make unsafe any areas designed for pedestrian or vehicle movement to, from, or through the property. The proposed food cart pod layout does not obstruct pedestrian or vehicle movement in any way. Pavement markings will be applied to show the vehicular traffic flow as well as pedestrian areas. M. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section M: All food cart stalls and any associated temporary or permanent structures must not be located within any public access or utility easement. The proposed food cart pod is not located on and does not obstruct any utility easements or public road access in any way. N. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section N: All food cart service windows must be oriented such that customer queueing areas do not extend into vehicle maneuvering areas, pedestrian paths, or public rights-of-way. The positioning of each window will allow for 6 individuals to stand 3ft. apart in a row before the line would be within perceived pedestrian and vehicle traffic areas. Pavement markings will be applied to show the vehicular traffic flow as well as pedestrian areas. O. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section 0: Any canopies, awnings, or other attachments to any food cart must maintain a minimum of seven feet of vertical clearance and be entirely supported by the cart. Canopies, awnings and other attachments will maintain at least 7 ft. of vertical clearance and are supported by the cart. P. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section P: Temporary awnings or membranes may be used for weather protection over seating areas, provided they are: 1. 200 square feet or less in area, 2. 15 feet in height or less, as measured to the highest point, and 3. Adequately anchored to prevent windthrow. The awning in place is llft.l0in. in height when measured to the highest point, and is 108sqft. in area; The awning will be anchored semi-permanently with bolts into the ground. Q. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section Q: Accessory structures such as covered seating areas must meet the minimum setback standards that apply to a new nonresidential building in the base zone in which it is located. The awning(s) is 108sgft and is located 35 Ft. away from the property line, meeting the setback standards. The awning will be centered away from public road access and utility easements. R. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section R: Temporary storage containers are prohibited on the property. All storage must be located in permanent buildings and structures. Temporary storage is not provided on the food cart grounds; All storage is located within the confines of an existing structure. S. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section S: Any associated signs must meet the regulations for the base zone as provided in Chapter 18.435, Signs We currently do not possess any signage; When we do get signage made, those assets will meet the regulations for the base zone provided in Chapter 18.435, Signs. T. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section T: Off-street parking areas must meet the applicable provisions of Chapter 18.410, Off- Street Parking and Loading. All off-street parking meets the criteria and applicable provisions laid out in Chapter 18.410, Off-Street Parking and Loading. U. City of Tigard, OR Code of Ordinances, Title 18 Development Code, Part 18.700 LAND USE APPLICATIONS AND REVIEW TYPES, Chapter 18.750.070 Food Cart Pod Standards, Section U: The food cart pod must meet all other applicable standards of this title.
