Relinquishment Deed
STATE OF OREGON, by and through its Department of Transportation, hereinafter
called "State", does hereby relinquish unto CITY OF TIGARD, a municipal corporation
of the State of Oregon, by and through its Elected Officials, hereinafter called "City",
all of State's right, title and interest in the connecting streets or portions thereof as
described in the legal description and accompanying map, marked Exhibit"A" and
Exhibit "B", attached hereto and by this reference made a part hereof. Any right-of-way
being conveyed in which State has any title shall be vested in City ONLY SO LONG AS
USED FOR PUBLIC ROAD PURPOSES. IF SAID RIGHT OF WAY IS NO LONGER
USED FOR PUBLIC ROAD PURPOSES, IT SHALL AUTOMATICALLY REVERT TO
STATE.
AS SHOWN ON THE ATTACHED EXHIBIT MAP, HEREIN AND MADE A PART OF
THIS DOCUMENT AS SET FORTH ABOVE, THAT IN THE EVENT OF A CONFLICT
OR DISCREPANCY BETWEEN THE EXHIBIT MAP AS SHOWN AND THE WRITTEN
LEGAL DESCRIPTION EXHIBIT"A", THE WRITTEN LEGAL DESCRIPTION
EXHIBIT "A" SHALL PREVAIL.
The property above described is transferred subject to the rights of any utilities located
within said property and further subject to the rights of the owners of said existing
facilities if any there be, to operate, reconstruct, and maintain their utility facilities
presently located within said property.

The City, Grantee, for themselves, their heirs, personal representatives, successors in
interest, and assigns, as a part of the consideration hereof, does hereby covenant and
agree as a covenant running with the land that in the event facilities are constructed,
maintained, or otherwise operated on the property described in this deed for any activity,
facility or program, the City, Grantee will maintain and operate such facilities and
services in compliance with all federal and state requirements such that no person on
the grounds of race, color, or national origin, will be excluded from participation in,
denied the benefits of, or be otherwise subjected to discrimination in the use of said
facilities.
The Oregon Transportation Commission, by a duly adopted Delegation Order OTC — 01,
dated July 1, 2019; Delegation Order No. DD 03, Item No. 19, dated July 1, 2019;
Delegation Order No. HWY 04, Paragraph No. B-4, dated April 1, 2018; and Delegation
Order No. EB-05, Paragraph No. B-2, dated April 1, 2018, authorize the State Right of
Way Manager to sign this Relinquishment Deed for and on behalf of the Commission.

A parcel of land lying in the James Hicklin D.L.C. No. 43, Township 2 South, Range 1
West, W.M., Washington County, Oregon and being a portion of that property described in
that Warranty Deed to the State of Oregon, by and through its Department of
Transportation, recorded March 12, 1975 in Book 1013 Page 923, Deed Records of
Washington County, and that Warranty Deed to the State of Oregon, by and through its
Department of Transportation, recorded September 21, 1973 in Book 946 Page 33, Deed
Records of Washington County, and that Warranty Deed to the State of Oregon, by and
through its State Highway Commission, recorded October 27, 1972 in Book 894 Page 360,
Deed Records of Washington County, and that Warranty Deed to the State of Oregon, by
and through its State Highway Commission, recorded February 7, 1953 in Book 341 Page
273, Deed Records of Washington County, and that Final Judgement, recorded December
2, 1974, Case Number 33547, the said parcel being that portion of said property described
as follows:
Commencing at Engineer's center line Station "Bonita Road" 23+05.83, said point being
marked by a 5/8" Iron Rod with an Aluminum Cap stamped "David Evans & Assoc." in a
monument box, thence South 71°06'44" West 74.90 feet to the Point of Beginning thence
North 22°13'30" East 53.78 feet, thence South 89°23'29" East 25.00 feet along the
Northerly right of way of Bonita Road, thence North 01°23'50" East 20.00 feet; thence
North 80°27'11" East 262.41 feet; thence South 01°29'39" West 155.17 feet; thence
parallel, and 60 feet southerly, with the center line of Bonita Road North 88°25'40" West
186.07 feet; thence parallel, and 45 feet easterly, with the center line of Southwest
Sequoia Parkway South 01°14'19" West 104.39 feet; thence on a non-tangent 100.00 feet
radius curve right (the long chord of which bears North 35'45'28" West 116.99 feet) 124.98
feet, thence North 88°45'41" West 14.60 feet; thence North 01"14'18" East 15.45 feet;
thence on a non-tangent 30.00 feet radius curve left (the long chord of which bears North
44°04'34" West 42.66 feet) 47.45 feet to the point of beginning.
