NOTICE OF TYPE I DECISION MINOR MODIFICATION MMD2023-00005 RIVER TERRACE TOWN CENTER MODIFICATION TIGARD 120 DAYS = July 4, 2023 SECTION I. APPLICATION SUMMARY FILE NAME: River Terrace Town Center CASE NO.: Minor Modification (MMD) MMD2023-00005 PROPOSAL: The applicant proposes a modification to re-design the drive aisle within the mixed- use area of the River Terrace Town Center Planned Development (Case No. PDR2021-00004/SUB2021-00006).The applicant proposes a change in the material used for the drive aisles and will use asphalt rather than the specialty concrete finishes as approved within PDR2021-00004. APPLICABLE REVIEW CRITERIA: Community Development Code (CDC) Chapter 18.765. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request.The findings and conclusions on which the decision is based are noted in Section IV. MMD2023-00005 River Terrace Town Center 1 SECTION III. BACKGROUND INFORMATION Site Information: The 40.10-acre site is located within the River Terrace Community Plan area east of Roy Rogers Road, south of East River Terrace, north of Roshak Ridge, and west of unincorporated Washington County. The site is zoned RES-B, RES-C, RES-E, and C-C—residential zones of varying density and housing type and community commercial. The site was zoned R-7, R-12, and CC at the time of the original approval. The Planned Development and Subdivision for River Terrace Town Center (Case No. 2021- 00004/SUB2021-00006) was approved by the City of Tigard on February 4, 2022 for the development of 491 residential units with 25,716 square feet of commercial/retail space. There are wetlands located within the center of the subject site and additional wetlands located at the northwest and northeast corners of the site. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.765 Modifications: 18.765.060 Minor Modifications A. Definition.A minor modification has the following characteristics: 1. It has minimal impacts on surrounding properties, sensitive lands, or public facilities; and The applicant is requesting a modification to the approved plan set for the planned development PDR2021- 00004. The approved plan was to construct the entire drive aisle within the mixed-use area including the intersection and pedestrian crossing areas with specialty concrete finishes. The applicant now proposes a change in the material for the drive aisles and will use asphalt rather than the specialty concrete finishes.The proposed modification has minimal impacts on surrounding properties because the modification only proposes a change in material used for the drive aisles internal to the site and does not impact or alter any drive aisles near adjacent properties, does not change the configuration of parking spaces, or modify pedestrian access. Construction of the specialty concrete finishes will be focused only within the pedestrian crossing area which will increase pedestrian safety through the contrast of materials used between the drive aisles and pedestrian crossing area. The contrast in materials will promote higher visibility at high-traffic pedestrian crossing areas rather than utilizing the same concrete finish throughout the central plaza as originally proposed.The updated plans, Sheets L2.01,L2.04,and L2.05,are provided in Exhibit D. Detail of the specialty concrete finish is provided on Sheet L4.05 in Exhibit D. There are sensitive lands on the site in the form of wetlands and a vegetated corridor present within the subject property towards the center of the site and additional wetlands are located at the northwest and northeast corners of the site. The proposed modifications will have minimal impacts on sensitive lands because the applicant is only proposing a change in the materials used and no additional changes within the previously approved planned development PDR2021-00004 are proposed. Impacts to sensitive lands from the proposed development have been assessed within the wetland delineation report submitted with PDR2021-00004 and addressed as part of the original planned development review approval.The proposed modification does not affect the previous approval in any way. The proposed modifications will not affect the existing public facilities because there is no change proposed to the public utilities as approved in the original decision,which were determined to adequately serve the subject site as part of that decision. 2. It does not cause the development to go out of conformance with any applicable standard MMD2023-00005 River Terrace Town Center 2 or further out of conformance if already nonconforming, except where an adjustment has been approved. The proposed modification meets all of the applicable development standards and therefore,does not cause the development to go further out of conformance with the applicable standards. The proposal meets the definition of a minor modification as stated in 060.A.1. D. Approval criteria. The approval authority will approve or approve with conditions a minor modification application when all of the following criteria are met: 1. The proposed modification qualifies as a minor modification as defined in Subsection 18.765.060.A; As demonstrated in the findings above, the proposed modification qualifies as a minor modification as defined in CDC 18.765.060.A.This criterion is met. 2. If the proposal involves the modification of a condition of approval, at least one of the following criteria is met: a. The condition cannot be implemented for reasons outside the control of the applicant or property owner; b. The condition is no longer needed or warranted because circumstances have changed; or c. A new or modified condition better accomplishes the purpose of the original condition. The applicant is not requesting a modification of a condition of approval.This criterion does not apply. FINDING: These proposed modification qualifies as a minor modification to an existing planned development approval, as defined in CDC 18.765.060.A, and complies with all applicable standards of this Title.
