NCC2023-00074 from respondent 5-1-2023 From: Samantha Izatt <samantha.izatt@gmail.com> Sent: Monday, May 1, 2023 12:46 PM To: Code Compliance Subject: NCC2023-00074 IYou don't often get email from samantha.izatt@gmail.com. Learn why this is important Mr. Ken Ross, Hi there - I previously spoke with you a couple years back when dealing with two complaints at this property and am helping Sheri's family in handling this matter again. In regards to the complaints of "having multiple loud barking dogs creating excessive noise throughout all hours of the day" at property 10445 sw 67th ave tigard OR 97223 you have dealt with us before and in the complaints from a different neighbor over something else who had a hefty list of codes that she thought was not in compliance and she didn't hold anything back and never did it mention anything in regards to dogs barking. We havent had any complaints nor has anyone come to us regarding this "excessive noise". All of this has only come about since an incident that occured on March 18th when the neighbors dog was digging under our shared fence that resulted in it being attacked by a dog who's puppies were out in the backyard. Sadly the neighbor's dog ended up having to be put down due to her age and the extent of the injuries. All she asked was that we reinforce the fence from our side so nothing like that would happen again. Even though her dog had been digging on her side of the fence to get to our side we immediately did as she asked to ease her mind and give her a sense of security back. We understand the neighbor is grieving over the loss of her pet and know how hard that can be and are very saddened that this happened. Since this incident occurred the neighbor has provoked and harassed the dogs over our shared fence and coming from the curbside yelling and screaming at them to go back inside the house, that they are bad dogs and shouldn't be allowed outside, tells her daughter to bark when shes out front and in her backyard as to trigger the puppies knowing it gets them to start barking, Uses a dog whistle/clicker used in training dogs on her side of the fence that makes the dogs freak out along the fence line and has been recording over our fence. It is a terrible feeling thinking that your pups aren't safe to go play in their own completely fenced in backyard due to irrational and erratic behavior the neighbor has been showing. The fear that she is going to throw something over the fence that could kill these pup's is terrifying. Prohibition on excessive noise and noise limits - We are aware and understand the noise ordinances and make sure we are in compliance as best we can. With that being said we do have four puppies who at times can be a little rambunctious but have not barked continuously for 5 minutes in a 15 minute period. Open storage of junk (inoperable vehicles, Parts) - Items that some people feel is junk could be or is considered to be valuable to someone else. We do not feel that we are not in compliance with anything that was listed in the letter and hope that this issue can be resolved quickly. Sincerely, 1 10445 sw 67th ave. 2
