Dear City of Tigard, This letter is in response to the correspondence dated April 15, 2021 related to Code Compliance Record Number NCC2021-00064. Within the document, a compliant is outlined with several code violations cited. Our property is not out of compliance and we believe this was submitted as an effort of retaliation by a neighbor. We have outlined below the specific codes cited and our demonstrated adherence to each. • Blocking Street and Hindering Traffic Prohibited — we do not place items that block street or hinder traffic flow. Our only items we place on the street would be our garbage cans, which we place on the street, at our curb the evening prior to pick up and are retrieved upon collection. Per the garbage haulers direction, we place at the curb to ensure adherence to ADA requirements and placement on the sidewalks prohibits safe passage. • Nuisances Affecting the Public Health — the specific callouts o Accumulation of debris is not occurring on our property. All debris is stored in the proper receptacles and is not in a position to affect public health. o Any animal, substance, or condition causing an offensive odor or is insanitary. There is no animal, substance, or condition causing an offensive odor on our property and/or insanitary conditions. o Animals, including livestock or buildings for the purpose of maintaining livestock or animals that are offensive or annoying to residents. We do not have livestock nor do we maintain any buildings for livestock. • Insects and Rodents — We have never experienced either and we do not store any materials, including waste in a manner that may attract or aid in propagation of insects or rodents. • Scattering Rubbish - We do not deposit upon public or private property any kind of rubbish, trash, debris, refuse, or any substance that would mar the appearance, create a stench, or fire hazard. As mentioned, our garbage is stored in the appropriate receptacles provided by our garbage hauler. • Unauthorized Deposits Prohibited — We do not dispose of waste on public property or the private property of another. As aforementioned, all waste items coming from our home are placed in the appropriate receptacles provided by our garbage hauler. Regarding the call out in the letter related to feeding wildlife, which is creating a traffic hazard. Within our neighborhood, there is a green space that attracts local ducks. The ducks do wander throughout the neighborhood as a wild animal, their activities are not something that is managed or controlled by us and/or our property. Unfortunately, I believe these complaints were submitted in retaliation unrelated to any activities on our property and is wasteful of the city's time and resources. We have lived on this property for over 10 years, next to the same neighbor. There have been changes in the dynamics in that particular home and the behavior of that neighbor has become more inconsiderate and rude. There are several I opportunities to report city code violations as well as trespass activities which we had explicitly asked her to not do. We chose to not report these items as she is our neighbor and we did not want to deteriorate the relationship any further for something trivial. Given the efforts that we have had to extend in order to defend something that isn't occurring, would it be in our best interest to start reporting any and all inappropriate activity which violates laws and/or city code? z
