STORM SEWER-PERMANENT Space above reserved for Washington County Recording Information
James L.Corliss and Cora K.Corliss,husband and wife hereinafter called the Grantors,grant and convey unto the City of
Tigard a perpetual easement for constructing,reconstructing,operating,maintaining,inspecting,and repairing of an underground
storm drainage line and appurtenances, together with the right to remove, as necessary, vegetation, foliage, trees, and other
obstructions on the parcel of land described in Exhibit"A",situated in the City of Tigard,Washington County,State of Oregon.
THE TRUE CONSIDERATION for this conveyance is $53,406.00. However, the actual consideration consists of or includes
other property or value given or promised which is the whole consideration.
IT IS EXPRESSLY UNDERSTOOD that this easement does not convey any right,title,or interest except those expressly stated
in this easement, nor otherwise prevent Grantors from the full use and dominion thereover; provided, however, that such use
shall not interfere with the uses and purposes of the intent of the easement.
To the extent permitted by the Oregon Constitution and subject to the Oregon Tort Claims Act(ORS 30.260 to 30.300).Grantee
shall indemnify,defend and hold harmless the Grantors and their representatives,agents,successors,and heirs from and against
any and all claims, causes of action, losses, damages, suits, and liabilities of every kind, arising out of any use of the Grantor
Property by Grantee,including court costs and reasonable attorney fees,except to the extent caused by Grantor's negligence or
willful misconduct.
This Easement shall run with the land and be binding on Grantors' heirs, successors, and assigns.
TO HAVE AND TO HOLD the above-described and granted premises unto said Grantee,its successors,and assigns forever.
