MMD2002 00020 LINCOLN CENTER CITY OF TIGARD August 9, 2002 OREGON Collins-Woerman Attn: Barbara Anderson 777 108 Avenue NE, Suite 400 Bellevue, WA 98004 RE: Lincoln Center Minor Modification Request, Case File No. MMD2002-00020 Dear Ms. Anderson: This letter is in response to your request for a Minor Modification (MMD2002-00020) of the existing Lincoln Center site development located at SW Greenburg and SW Locust, WCTM 1S135AB, Tax Lots 00700, 00900, 01002, 01003, 01004, 01006, 03400, 04400, and 04500. You have requested several site modifications including realigning the entry road from SW Greenburg, changing the on site circulation for vehicles and pedestrians, improving the accessibility of certain building entrances, and modifying the landscaping. The submitted site plans reflect the current conditions as well as the proposed modifications. Analysis of Modification Request: Section 18.360.060 of the Tigard Development Code Site Development Review chapter, states; "any modification which is not within the description of a major modification as provided in section 18.360.050 shall be considered a minor modification." Section 18.360.050 states that the Director shall determine that a major modification(s) has resulted if one (1) or more of the changes listed below have been proposed: 1. An increase in dwelling unit density or lot coverage for residential development. The proposal does not involve residential property. Therefore, this standard does not apply. 2. A change in the ratio or number of different types of dwelling units. This criterion is not applicable, as this request does not involve a residential development. 3. A change that requires additional on-site parking in accordance with Chapter 18.765. The proposal includes eliminating some parking from certain areas and adding more parking to other areas of the site. The required parking for 708,911 square feet of office is 1,914 stalls, and for the 17,050 square feet of restaurant use, an additional 260 spaces are needed for a total parking requirement of 2,174 spaces. The site will provide 13125 SW Hall Blvd., Tigard, OR 97223 (503)639-4171 TDD(503)684-2772 :. • 2,369 parking spaces, in compliance with this standard. Therefore, additional on-site parking is not required. 4. A change in the type of commercial or industrial structures as defined by the Uniform Building Code. No change in the structural occupancy type of the buildings is proposed. Therefore, this criterion is not applicable. 5. An increase in the height of the building(s) by more than 20 percent. The applicant has not proposed any changes to the existing building that will affect the height. Therefore, this standard is met. 6. A change in the type and location of accessways and parking areas where off-site traffic would be affected. This application does propose fairly substantial changes to accessway configuration and parking lot layout, however, these changes are internal to the site and serve to facilitate better movement through the site. The applicant has included written sign off from Waste Management Company and from Tualatin Valley Fire and Rescue demonstrating that the site will remain serviceable and will not cause off site traffic impacts. Since off site traffic will note be affected, this standard is satisfied. 7. An increase in vehicular traffic to and from the site and the increase can be expected to exceed 100 vehicles per day. There is no change to the type or intensity of use proposed. The modification request is for site and landscaping improvements. This modification will not generate significant additional vehicle trips. Therefore, this criterion does not apply. 8. An increase in the floor areas proposed for a non-residential use by more than ten percent excluding expansions under 5,000 square feet. The proposal will not increase the square footage of the building. Therefore, this standard is met. 9. A reduction in the area reserved for common open space and/or usable open space that reduces the open space area below the minimum required by the code or reduces the open space areas by more than ten percent. The proposal will enhance existing open space areas and add a total of 23,892 square feet of landscaping to a total of 26.8% of the site area, in compliance with code requirements. 10. A reduction of project amenities (recreational facilities, screening; and/or, landscaping provisions) below the minimum established by the code or by more than ten percent where specified in the site plan. The proposed modifications to the site will not reduce or eliminate project amenities, and will replace trees that are removed. This project also seeks to improve disability access to several buildings on site. Recreational facilities, screening, and landscaping will not be detrimentally affected. Therefore this criterion is met. 11. A modification to the conditions imposed at the time of Site Development Review approval that is not the subject of criteria (B). 1 through 10 above. The City has reviewed numerous land use applications for the area known as the Lincoln Center. The site was annexed to the City of Tigard in 1987 at which time it received the City's Commercial Professional (C-P) zoning designation. The 12-story Lincoln Tower was approved later in 1987 (SDR 87-08/V 87-07) along with a variance to the maximum building height standard of the C-P zone. In 1988, a Conditional Use Permit was approved allowing a heliport on top of the Lincoln Tower. In 1989, the City gave Site Development Review approval for the Lincoln V building (SDR 89-12/V 89-17) with a variance to the maximum building height requirements Page 2 of 3 and parking dimensional standards. In 1990, SDR approval was granted for a 7-story office building and 3-level parking structure (SDR 90-0022NAR 90-0033). A variance to the maximum building height standard was also approved. In 1999, a proposal for two new buildings was approved, however, this approval was never acted on, and has since expired. On March 28, 2002, the Washington Square Regional Center Plan was adopted, and the zoning designation of the property changed to MUE-1. A review of these previous decisions reveals that compliance with specific conditions of approval will not be affected. THIS REQUEST HAS BEEN APPROVED BY THE PLANNING DEPARTMENT SUBJECT TO THE FOLLOWING LIMITATIONS. PLEASE SUBMIT A COPY OF THIS LETTER WITH YOUR BUILDING PERMIT APPLICATION. Limitations on Minor Modification Approval This approval is based on the plans and drawings submitted, as well as the statement provided by the applicant. Deviation from these documents, except as required by Tualatin Valley Fire and Rescue, shall render this decision void. This request is determined to be a minor modification to an existing site. The Director's designee has determined that the proposed minor modification of this existing site will continue to promote the general welfare of the City and will not be significantly detrimental, nor injurious to surrounding properties provided that, development which occurs after this decision complies with all applicable local, state, and federal laws. Attached are an additional 5 sets including: the Overall Site Plan and the Existing vs. Proposed overlay. The Landscape Plans will be coming to you directly under separate cover. Also attached are the application form and check. 1. The scope of the project is summarized as follows: 1. Realign the main road into the campus from Greenburg Road, by removing the traffic circle near the main entrance and straightening the road. The intersection at Greenburg and the traffic lights will remain untouched. 2. Create traffic circles at the entrance to Lincoln Tower and between Lincoln Two and Lincoln Three. 3. Create new loading/drop off zones on the east side of Lincoln Two&Three and Five. 4. Close the road between Lincoln Tower and Lincoln One to provide an at-grade pedestrian link from Lincoln One to Lincoln Tower. 5. Add hard and soft landscaping to create a Central Plaza in front of Lincoln Building. 6. Adjust parking by adding parking to west side of Lincoln One, adding parking to the north side of Lincoln Tower, removing parking from the south side of Lincoln Building. 7. Realign sidewalks from Greenburg Road to Lincoln One,and between the buildings on site to maintain barrier-free access over the site. 8. Rebuild north and south sidewalk entrances into Lincoln One. 9. Provide loading docks by Lincoln Building (1), Lincoln One (1), Lincoln Five (1) and Lincoln Two, Three and Lincoln Tower(1). 10. Impact Study The proposed improvements at Lincoln Center have either no, or have a positive, impact on the public facilities and services. No impact on transportation system—No increase in vehicular traffic as there is no increase to building area and therefore to the number of tenants. No impact on the intersection at SW Greenburg Road, as this intersection has not been modified. No change to public transit locations near site. (Not affected) No change to adjacent bikeways. (Not affected) On site the amount of soft landscaping is increased by 2.33% in the proposed improvements, from 250,322 s.f. to 274,214 s.f. (The amount of hard landscaping is decreased by the same percentage). Positive impact on existing drainage system. No change to adjacent park systems. (Not affected) No change to impact on water system. (Area of existing buildings not changed) No change to impact on sewer system. (Area of existing buildings not changed) No anticipated change to on-site noise levels. (New central courtyard could provide venue for occasional gatherings). 3. Access Minimum number of accesses required: 2 Number of accesses provided: 8 Minimum access width required: 32' Minimum access width provided: All existing accesses remain as is. The smallest existing accesses are the two accesses on SW Oak Street at 32'-2". The largest existing access is on SW Greenburg Road at 40'-4". Minimum pavement width, required: 24' Pavement width for proposed roads: Central site road 38' (including a 5' median) Road south of Lincoln One 28'-6" 4. Walkway Requirements Walkways There will be new walkways to the north and south entrances to Lincoln One. The south entrance to Lincoln One complies to ADA standards, and is adjacent to the barrier-free parking. The north walkway-has stairs (as does the existing),with new handrails and surface finishes. Entrances into Lincoln Tower, Lincoln Two &Three, and Lincoln Five have all been modified and maintain barrier-free access to the main doors of each building. Crosswalks With the realignment of the central site roadway, we have added two new pedestrian crossings over this road. We have also modified the crossing which leads from SW Greenburg to Lincoln One, and the two crossing with the road widening on the south end of Lincoln One, which lead to the parking structure. In addition, we have closed Page 3 the road between Lincoln One and Lincoln Tower and provided an (still undesigned) on-grade pedestrian link between the two buildings. The crossing closest to SW Greenburg is 8'wide, not raised, has curb cuts at each end and is delineated by using stamped concrete. The road, at this point is 38'wide, therefore a 5' median provides an area of refuge while crossing the road. The main crossing over the new road is an 8'wide, raised crossing also delineated with stamped concrete. It has a winged curb ramp at each end, complying with ADA standards. It is 8'wide and 3"high. The modified crosswalk traveling from SW Greenburg to Lincoln One is 8'wide, not raised, has curb cuts at each end and is delineated by using stamped concrete. The two existing crosswalks at the south side of Lincoln One will remain 6'wide, but will be 4' longer due to road widening. They will be re-striped. The road between Lincoln One and Lincoln Tower will be closed to accommodate a 10'wide at-grade pedestrian link between the two buildings. This link will require modifications to the interiors of both Lincoln One and Lincoln Tower to link with the main lobby of each building. 5. Special Setbacks Front Yard Required: 30'from centerline of Greenburg Road Provided: 70'from centerline of Greenburg Road Side Yard Required: 10' Provided: north side yard - 15'from 1'-6" high concrete wall curving around the north edge of the pedestrian and vehicular access to Lincoln Five. Buffering and Screening Street Trees No street trees are affected by the proposed changes to site circulation. Buffering and Screening The only area of the site where the existing buffering is affected is on the north side of Lincoln Five, next to SW Locust Street. We are removing one existing tree to improve the vehicular drop-off at the entrance to Lincoln Five. We will replace the tree (trees are at 20' spacing)and plant shrubs and ground cover to improve on the existing buffering condition. 8. Landscaping Street Trees We are planting street trees along the new realigned street through the Lincoln Center site. In addition, we have relocated trees (typically 6"caliper)from the plaza to the new median down the center of the street, to keep the street well treed. Spacing is typically 25'. We have maintained, or in instances where drives have been modified, replaced the street trees over the remainder of the site. Parking We have modified parking in 4 main locations Main entrance to Lincoln Five- the number of stalls decreased and we are planting two additional trees, Rear entrance to Lincoln Tower- now 8 stalls(reduced from 18)with 5 new trees, South entrance of Lincoln One-6 modified stalls with 6 new trees, and Parking lot just to the south west of Lincoln One-with 7 new stalls and 2 new trees. We have exceeded the requirement of one tree for every seven stalls. 9. Recycling Steve Wolfe at Waste Management has approved the proposed site changes for Lincoln Center. A letter will be sent directly to you under separate cove. 10. Parking Office = 708,911 s.f. Parking required 2.7/1,000 = 1,914 stalls Restaurant = 17,050 Parking required 1/370 =46 stalls Provided 2,369 stalls of which 58 are handicapped parking. Of these, 19 are new parking stalls we are providing, all standard size of 8'-6"x 18'-6". Page 5 Handicapped As noted above, there are 58 handicapped stalls on site. Of these we have modified the size of 19 handicapped stalls to comply to current standards, and have provided 3 new van stalls. Bicycle Racks We have relocated the existing bicycle rack at the south entrance of Lincoln One to within 38 ft. of the entrance. New bicycle racks will be provided within 34 ft of the Lincoln Tower, 27 ft. of the Lincoln Two, Three entrance, and 40 ft of the Lincoln Five entrance. 11. Loading Currently there are no designated loading zones at Lincoln Center. We are providing designated loading zones at the following locations: Lincoln One: provided at the curb on the west side of Lincoln One. Lincoln Building: provided in parking lot north of the building. Lincoln Tower: an area is designated in the parking lot east of the building. Lincoln Two and Three: we are providing a new loading/delivery pull-off zone adjacent to the east entrance. Lincoln Five: we are providing a new loading/delivery pull-off zone adjacent to the east entrance. 12. Bicycle Racks Lincoln One—one rack for approximately 8 bikes. Lincoln Tower—one rack for approximately 8 bikes. Lincoln Two, Three —one rack for approximately 8 bikes. Lincoln Five—one rack for approximately 8 bikes. 13. Sensitive Lands Not applicable. No change to existing buildings. 14. Steep Slopes Not applicable. No change to existing buildings. 15. Cleanwater Services We are currently working with Clean Water Services to ensure that the proposed site changes do not affect the water quality of this or adjacent sites. They are in receipt of our site evaluation, and we expect a response by August 1st 16. Signs Exterior signage will be submitted for permit under separate cover. Page 6 17. Tree Removal Plan Requirements We are removing a total of 13 trees that are 12 inches in caliper or larger. There are approximately 57 trees remaining on site with 12 inch or larger caliper. In particular, we are retaining the three large sequoias located just inside the main entrance from Greenburg. We have retained an arborist, who assisted with the location of the new curbs to avoid trauma to the one sequoia, and who will be on site during construction to monitor construction around the trees. We have retained 81% of the large trees on site. We are mitigating the removal of the trees. Overall,we have relocated 10 trees, removed 50 trees, and replaced 92 trees. 18. Mitigation We are removing 173"caliper of 12"or larger trees. We are replacing with 205" caliper of trees, as follows: In Phase 1 we are planting a total of 73 cal inches: 14—2"cal. trees (Yashino Cherry, Easter Red Bud) =28" 7—3"cal. trees (London Plane Trees) =21" 6—4"cal. trees (Red maple)=24" Not figured in calculations 11 trees under 2". In Phase 2 we are planting a total of 132 cal inches: 16 -2"cal. Trees = 32" 16—3"cal. trees (London Plane Trees) =48" 11 —4"cal. trees (Red maple) =44" Not figured in calculations 7 trees under 2". 19. Clear Vision Area At all road to road intersections we are maintaining a vision triangle in compliance with Code Chapter 18.795. You will note that we typically have grass or low ground cover at the intersections. 20. Fire Marshal The Fire Marshal has reviewed our plans, and approved with road closure with three conditions, which are reflected on the attached plans. Also attached, is the letter from Eric McMullen regarding his review. Page 7 Engineering 1. Water Quality We have increased the amount of landscaping with the new design, and decreased the amount of impervious material by 2.33%. Therefore, no site water mitigation is required.
