EXPLANATION OF ISSUE
Mental health is vital for overall well-being,yet billions around the globe grapple with anxiety, fear,
isolation, and depression, often without access to quality care and support.
The mental health crisis has worsened in the wake of COVID-19,leaving millions to deal with its lasting
impacts. These issues are pervasive, affecting communities in every corner of the world. One in four
individuals will experience a mental health condition at some point in their lives,with women being
diagnosed more frequently than men.
This World Mental Health Day, the World Health Organization (WHO) is uniting with partners to
highlight the vital connection between mental health and work. Safe, healthy working environments can act
as a protective factor for mental health. Unhealthy conditions including stigma, discrimination, and
exposure to risks like harassment and other poor working conditions, can pose significant risks, affecting
mental health, overall quality of life and consequently participation or productivity at work. With 60% of
the global population in work,urgent action is needed to ensure work prevents risks to mental health and
protects and supports mental health at work.
It is essential for governments, employers, the organizations which represent workers and employers, and
other stakeholders responsible for workers'health and safety to work together to improve mental health at
work. Action to address mental health at work should be done with the meaningful involvement of workers
and their representatives, and persons with lived experience of mental health conditions. By investing
efforts and resources in evidence-based approaches and interventions at work,we can ensure that everyone
has the opportunity to thrive at work and in life. Let's take action today for a healthier future.

The Tigard team is asking the Mayor to proclaim October 10th,2024 as World Mental Health Day.

While the mayor has previously proclaimed Mental Health Awareness month, a proclamation has not been
made before by the mayor for World Mental Health Day.
Public Involvement
World Mental Health Day is an opportunity to continue to raise awareness in the Tigard community about
the importance of mental health. This year's campaign theme is Mental Health at Work.

There is no fiscal impact from issuing this proclamation
ALTERNATIVES & RECOMMENDATION
The Mayor could choose not to proclaim World Mental Health Day but the recommendation of the team
is to issue the proclamation.

EXPLANATION OF ISSUE
The City of Tigard Finance Department has received the prestigious award for the 38th consecutive year
from the Government Finance Officers Association (GFOA) for Excellence in Financial Reporting for the
Fiscal Year 2022-2023.
The GFOA, founded 1906,represents public finance officials throughout the United States and Canada.
The association's more than 20,000 members are federal, state/provincial, and local finance officials deeply
involved in planning, financing, and implementing thousands of governmental operations in each of their
jurisdictions. The GFOA's mission is to advance excellence in public finance.
The GFOA established the Certificate of Achievement for Excellence in Financial Reporting program in
1945 to encourage and assist state and local governments to go beyond the minimum requirements of
generally accepted accounting principles to prepare annual comprehensive financial reports that evidence
the spirit of transparency and full disclosure and then to recognize individual governments that succeed in
achieving that goal.

next 3 to 5 year plan for the Chamber which will be celebrating its 75th Anniversary next year.
Leadership Tigard
Leadership Tigard launched this month with our annual SIMSOC event. We want to thank those who joined us for this
very important and impactful day(a few of you in this very room). We are looking forward to another wonderful year
of leadership education for our cohort this year.

• Our Government Affairs & Public Policy Committee has moved to an online format to be more accessible to a wider

This is the final month of the Tigard Farmers Market which runs through the last weekend of October every Sunday
9:00am—1:30pm at Universal Plaza in Downtown Tigard off of Burnham.We will be ending with our annual Dog

grooming needs.

collaboratively with JC to address this issue before any consideration of additional funding.This process should result in a safe exit
protocol,involving Tigard PD,to mitigate risk to our community if/when an unsafe individual is removed from a Tigard shelter. In
conclusion,we are making two specific asks of Council: 1)Abide by all predetermined grant criteria and do not award additional
funding to Just Compassion or any NPO application that does not meet the objective grant criteria.2)Create a proactive safe-exit
plan from all Tigard shelter programs(including Safe Parking),to be enacted if/when an individual is removed due to unsafe

community if/when an unsafe individual is removed from a Tigard shelter program and sent off into the
surrounding area.
Finally,we have suggested across multiple communications with the City that Council's goal to reduce
local Tigard homelessness cannot be achieved without using data to fully understand who is being served
and where they are coming from.
Just today,we received an email reply from Kim Ezell which shed further light on the topic of who is
being served by local homeless programming. It is now clear that City managers are well aware that the
services being implemented in Tigard are designed to serve ALL of Washington County and are not
specifically targeted to support locals experiencing houselessness.
Kim shared: "The County-led Supportive Housing Services Program is designed to reduce homelessness
across the County. We have to acknowledge that it's impossible for any single City within Washington
County to provide all types of services for our houseless population. By everyone working together to
provide a myriad of services for all of Washington County,we're able to reduce homelessness in every
city.
Why has this messaging around serving the broader community not been fully transparent?If the goal is
to host and fund programs in Tigard to reduce homelessness across the entire County,this should be
communicated transparently with all stakeholders and constituents.
In conclusion,we are making three specific requests:
1. Abide by all predetermined grant criteria and do not award additional funding to Just
Compassion or any NPO application that does not meet the objective grant criteria.
2. Create a proactive safe-exit plan from all Tigard shelter programs,to be enacted if/when an
individual is asked to leave due to unsafe behavior. This plan should directly involve Tigard

This correspondence is regarding the grant application being considered for Just Compassion's shelter
expansion. After reviewing the grant application, and the previous proposed agreement for Family
Promise, we want to highlight the differences. Additionally, when reading Family Promise's proposed
development agreement, we found a potential unrealized opportunity for Safe Parking. We invite the
Council and City to consider the points outlined below, and in the attached documents, while weighing
Just Compassion's grant application and the expansion of the Safe Parking program.
In the question and answer portion of the grant application presentation for Just Compassion, it was
asked whether there was precedent for utilizing this money in the way in which the application asks for
short-term emergency shelter housing. While it was asserted that this money has been used for another
shelter, Family Promise, this is not an apples-to-apples comparison. It's important to note that Family
Promise's shelter provides significantly different services compared to Just Compassion, and these
services stretch beyond the sole purpose of addressing homelessness.
Family Promise's attached proposed development assistance agreement outlines that their shelter is
intended to provide emergency beds for first responders and that shelter space prioritization is considered
for TTSD students in need ahead of those residing outside Tigard, or across the County. Family Promise
is designed to serve local residents. Just Compassion's services are intended to serve Washington
County, and prioritization for local Tigard residents is not a policy.
In response to our numerous inquiries, Just Compassion and City officials have stated that homeless
services cannot be prioritized for Tigard or any specific group of people. Additionally, we have been told
there is no way to track demographics for the individuals served in these emergency shelters, which could
help illuminate where they came from. However, Family Promise tracks the number of Tigard and Tualatin
residents it serves and emphasizes helping local residents. We recognize Just Compassion is a
low-barrier shelter, however, we see no reason that they are not able to track and report demographic
data to Tigard, to better understand how their services are working toward reducing local homelessness.
Finally, in the attached document outlining Family Promise's proposed agreement, it clearly states that
their parking lot will be made available for future shelter opportunities. It seems like this property may
have been overlooked for the Safe Parking program. Family Promise is in part, a City-funded property,
and the parking lot has space set aside for shelter programs. The location is a commercial area, which we
have asked be prioritized for shelter programming due to built-in increased oversight. The Family Promise
parking lot should be prioritized over residential neighborhoods for additional Safe Parking programs.
To conclude, Just Compassion's request for funding cannot be compared to the previous request for
Family Promise. Just Compassion is an emergency low-barrier shelter that mostly serves the greater
County. Family Promise provides comprehensive services, including space for Safe Parking, that primarily
benefit and target Tigard families. This is the type of programming Tigard constituents likely broadly
support. Beyond these differences, we want to reiterate a point from our previous communication that
Just Compassion's grant application does not meet the objective criteria for funding.
We thank you for your consideration of this additional information and ask that you reject the funding
request for Just Compassion's shelter expansion. Additionally, please consider Family Promise's parking
lot for the expansion of the Safe Parking program.

The Board of the Town Center Development Agency (TCDA) will consider a resolution authorizing the
City Attorney and Executive Director to negotiate and sign a Development Assistance agreement with
Family Promise of Tualatin Valley (FPTV). The agreement will set the terms for$1,000,000 in TIF funding
toward FPTV's purchase and improvement of the Quality Inn property in the Tigard Triangle for use as
transitional housing,with 70 rooms to serve family and adult-only households experiencing homelessness.
The funds will be used to acquire the property and for building renovations.

The project was discussed in executive sessions with the TCDA Board on February 14, 2023, and March 7,
2023.
Public Involvement
The Town Center Advisory Commission received a presentation on FPTV's development assistance
application at their February 8 meeting and deliberated and recommended the funding at their March 8
meeting.
Impacts (Community, Budget, Policies and Plans/Strategic Connection)
Family Promise of Tualatin Valley (FPTV) is an affiliate of the national Family Promise organization and
operates as a separate 501 c3 organization. FPTV was formed in 2017 and started serving clients in March
of 2019. Its mission is to "equip vulnerable families and individuals to end the cycle of homelessness
through a community-based response." It accomplishes this by providing emergency shelter, food,
clothing, and services including case management,housing navigation,mentoring, financial literacy
classes and job-readiness support to homeless and at-risk families.
The total purchase price of the property is $12.5 million. $10 million towards the purchase of the property
is funded through a state of Oregon Project Turnkey grant, administered by the Oregon Community
Foundation and $2.1 million from Washington County's Supportive Housing Services program. FPTV is
applying for$1 million from the Tigard Town Center Development Agency's Redevelopment assistance
program to assist with the acquisition and to fund necessary improvements to the property.
The development assistance addresses the local and regional emergency of houselessness and implements
several City and TCDA goals and policies:
•City Council 2021-2023 Goals, Goal 1: Implement an actionable,person-centric, and regional
response to homelessness and the outcome of"A community that offers safe housing options for
all."
•City of Tigard Strategic Plan 2020-2025, Objective 3.3: Understand the effects of development on
vulnerable Tigard residents and mitigate these impacts within projects and over time.
•Tigard Triangle Urban Renewal Plan, Objective 5.4 to assist in the development of affordable and
workforce housing.
•A New Tigard Triangle: Planning for Equitable Development, the implementation strategy for the
Tigard Triangle Urban Renewal Plan,prioritization of funding for affordable housing.
•The Town Center Advisory Commission adopted an area of emphasis for Affordable Housing and
Houselessness for 2023.
The Town Center Development Agency budget for FY 2022-23 includes $1 million in funding for the
Affordable Housing Development Fund to make grants and loans that support affordable housing.
The Development Assistance Agreement will state the TCDA's intentions to have FPTV ensure long-term
use of the property for sheltering people experiencing houselessness,provide for emergency shelter beds
for first responders;prioritize families in need who are in the Tigard-Tualatin school district; and make
available a portion of the property's parking lot for the City of Tigard to facilitate additional sheltering
opportunities.

EXPLANATION OF ISSUE
Washington County Board of Commissioners received a petition to vacate portions of the public utility
easements granted in Deed Document numbers 99057671 and 99051974, and a portion of the public slope
easement granted in Deed Document number 2018-068466. Exhibit B within the attachment depicts the
requested vacations.
The parcel of land encumbered by the public slope and utility easements is in the process of being
developed, and due to the proposed improvements, the existing public slope and utility easements that are
proposed to be vacated are no longer needed by the public.
The Engineering Division of Tigard's Public Works Department have reviewed and concur with
Washington County's Department of Land Use&Transportation Report on Vacation No. 580. To
summarize the report,it was found that the areas proposed for vacation are public slope and utility
easements that are not necessary for public use. In Document number 2018-068464,newer public utility
easements were granted so utilities adjacent to Roy Rogers Road can remain. This vacation will allow the
property owner to develop the site. The County also found that there are no adverse impacts to public
utility providers or emergency services as a result of this vacation.

REQUESTED ACTION:
Vacate the public slope and utility easements described in the attached Vacation Report, and request
that the Tigard City Council resolve or order concurrence with this vacation pursuant to ORS
368.361(3).
SUMMARY:
A petition was received by the Board to vacate portions of the public utility easements granted in Deed
Document numbers 99051974 and 99057671, and a portion of the public slope easement granted in
Deed Document number 2018-068466, all being situated in the southeast one-quarter of Section 7,
T2S, R1W,Willamette Meridian, City of Tigard, Washington County, Oregon, as described and shown in
the attached Vacation Report.
The parcel of land encumbered by the public slope and utility easements is in the process of being
developed, and, due to the proposed improvements,the existing public slope and utility easements
that are proposed to be vacated are no longer needed by the public. There will be no adverse impacts
to the public or to the abutting properties.
The vacation petition was signed by 100%of the abutting property owners. Department of Land Use&
Transportation staff has reviewed this request and has determined that the public slope and utility
easements proposed to be vacated are no longer necessary for public use. The proposed vacation is in
the public interest.
A Resolution and Order has been prepared granting the requested vacation and, when executed, will
complete Washington County's portion of the vacation proceedings. These easements are within the
city limits of Tigard. Pursuant to ORS 368.361(3),the City of Tigard, by resolution and order, must
concur in the findings of the county governing body to complete the vacation proceedings.

VACATION OF PORTIONS OF PUBLIC SLOPE AND UTILITY EASEMENTS
A request for vacation proceedings has been received by staff for the Board of County
Commissioners to vacate the public utility easement recorded as Parcel III in Document number
99057671, a portion of the public utility easement recorded as Parcel III in Document number
99051974, and a portion of the public slope easement recorded as Parcel 2 in Document
number 2018-068466, Washington County Book of Records, and more particularly described in
Exhibit A and shown on Exhibit B, attached hereto, and by this reference made a part hereof.
The owners of the property abutting the public easements to be vacated are:

CRITERIA FOR EVALUATION OF ROAD VACATION REQUEST
1) Conformance with the County's Comprehensive Plan
The public easements described herein and proposed to be vacated were granted in
Document numbers 99057671, 99051974, and 2018-068466. The site where these
public easements are located has been re-graded and is in the process of being
developed. Utility providers were contacted and have no objection to the vacation.
Existing utility infrastructure adjacent to SW Roy Rogers Road can remain in the more
recently granted public utility easements granted in Document number 2018-068464.
Vacating these public easements will remove unnecessary encumbrances on the affected
Parcel.
2) Use of the Easement
The areas proposed for vacation are public slope and utility easements that are
not necessary for public use. In Document number 2018-068464, newer public
utility easements were granted so utilities adjacent to SW Roy Rogers Road can
remain. Vacating these easements will eliminate encumbrances on the land and
will allow the property owner to develop the site.
3) Impact of Utilities and Emergency Services
There are no adverse impacts to public utility providers or emergency services as a result
of this proposed vacation.
4) Limits of Vacation and Evaluation of"Public Road" Status
The public easements, proposed to be vacated, are not needed for public use as a result
of the property being developed.
Based on the above statements, it is recommended that the Board of Commissioners approve
the vacation of the easements proposed herein, as it is in the public interest.

A RESOLUTION CONCURRING WITH WASHINGTON COUNTY FINDINGS REGARDING
VACATION OF PORTIONS OF THE PUBLIC SLOPE AND UTILITY EASEMENTS ALONG SW ROY
ROGERS ROAD
WHEREAS,Washington County Board of Commissioners Resolution and Order No.24-68(the Order)ordered
the vacation of portions of the public slope and utility easements along SW Roy Rogers Road,as granted in Plat
Document Nos. 99-057671, 99-051974,2018-068466, situated in the Southeast One-quarter of Section 7,T2S,
R1 W,Willamette Meridian,City of Tigard,Washington County,Oregon,as described and shown in the attached
Vacation Report from Washington County;and
WHEREAS, ORS 368.361(3) provides that a county body may vacate property that is under the jurisdiction of
the county,and that is entirely within the limits of a city,if the city concurs with the findings of the county;and
WHEREAS,the City of Tigard reviewed the Order and concurs with the findings of the County.
NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that:
SECTION 1: Based upon the above findings,which are incorporated herein by reference,the City Council
concurs with the findings of Washington County as specified in Washington County Board of
Commissioners Resolution and Order No. 24-68.
SECTION 2: A copy of this Resolution shall be provided to the Washington County Surveyor's Office.
SECTION 3: This resolution is effective immediately upon passage.

Re: City Manager Recruitment and Selection Process

As you know, City Manager Rymer has provided notice that he is retiring and his final day as
Tigard City Manager will be February 8, 2025. As a result,we will need to initiate a recruitment
and selection process to find Tigard's next City Manager. As the City Manager is a direct report
to Council,we will need to discuss the level of involvement that Council wants to have in each
phase of the process. Below are some of the steps that will be involved and some
recommendations around how Council might want to participate/direct the process. The outline
below is based on a recommendation by staff that an executive search firm will be contracted to
provide expertise, assistance, and access to a network of top potential candidates.
• Open Public Session Tuesday October 15, 2024 (20 minutes)—In this session, we will
briefly open the topic of the recruitment process for City Manager.
o Hiring standards and selection criteria: Review highlights of the City Manager class
specification including minimum qualifications and a brief overview of some of the
knowledge, skills, and abilities. Staff recommend use of the existing qualifications
and criteria, together with information gathered through the process as noted in
the draft scope of work attached.
o Hiring policy directives: Staff recommend the use of an executive search firm for
their expertise and assistance. Staff also recommend consideration of an interim
appointment beginning February 2025 until the start of a new City Manager.
o Process overview, possible phases of a recruitment and selection process:
• Development of a scope of work, see attached draft scope of work
• Sending out informal request for proposals (IRFP) with the final scope of
work
• Evaluating responses to the informal request for proposals
• Selecting and finalizing a contract with the successful search firm
o Public input: Open the hearing for input from the community about any of the
above.
o Close of public session: Council direct staff to proceed with the executive search
firm and process.
• Optional Discussion for either session or both— Council may want to discuss some of
their involvement open session.
o Council involvement: Council input will be needed for the various phases of the
recruitment and selection process. Council may want to assign one or two
Councilors to act as part of an initial City/Council Selection Team to enable a
more nimble and rapid preparation of initial phases such as finalizing the informal
request for proposal (IRFP) and evaluating responses to select a search firm.
Guidance about Council's desired role in the process will enable a more successful
process.
• Executive Session— following the public comment session, the Council in executive
session, can discuss in more detail and provide direction to staff regarding the following:
o Specific areas of focus Council will be looking for in the next City Manager, there
will be additional opportunities later, but some key areas early will help staff
complete the scope of work and think further about process design.
o Consideration of Council touch points in the process. How much involvement will
Council want at each phase of the process. For instance, will Council want to have
one on ones with the search firm consultant (or perhaps in pairs, etc.), areas where
the full Council wants to be involved, prior to the interview/selection from the
finalist candidate group, etc. Review of the scope of work could help determine
phases and level of involvement desired by Council.
o Staff would recommend a community component for the process, and while we
would want input from a search firm as to options, some direction to staff early
may help direct the scope of work development.
o Staff would also recommend that the search firm have expertise in successfully
filling other City Manager/County Administrator level positions,in addition to
experience working with Councils/Boards.
• Timeline expectations for the process will include two weeks to prepare a scope of
work and informal request of proposal (IRFP) and include Council feedback. Then two
weeks as a minimum for obtaining informal bids, it could take a month depending on
how busy the firms are at the time. Purchasing rules require a minimum of three informal
bids. Additional timeline aspects will be more detailed following the selection of a firm, as
we have included a timeline as part of the scope of work.
• Potential Components of a Process —these are noted on the draft scope of work
attached.

The following areas are to be performed by the Search Firm Consultant including, but not limited to:
1. Develop a timeline
a. Prepare a realistic timeline to accomplish each phase of the recruitment and selection process with
clarity between search firm/City roles and responsibilities at each phase. Recommendations can
include modification to what is proposed in the scope and changes to the order of the phases, etc.
2. Candidate profile development

3. Develop a selection and sourcing process
a. Aspects of the selection process could include a community component (including external city
partners), a city staff component, a Leadership Team component and a Council component. Staff
will work with the search firm to design a process to meet Council and community needs.
b. A candidate presentation component will need to be incorporated into the selection process.
c. Cultural competency questions will also need to be built into the process.
4. Develop an advertising outreach plan
a. Advertising campaign: complete an on-line outreach to a variety of sources.
b. Direct mail: distribute a mailer/emailer to prospective candidates.
c. (Social) Networking campaign: conduct an outreach to prospective candidates.
5. Evaluation/screening of candidates
a. Using a system based on the candidate profile, search firm will conduct an initial screening of
candidates.
b. Conduct screening interviews to confirm the qualifications and eligibility of finalist prior to
forwarding to the City.
c. Finalist list of approximately 8-12 top candidates sent for City/Council selection committee
consideration.
6. City/Council Interview and Selection Process
a. Search firm will assist in the logistics of the finalist selection process,including candidate
coordination, process fine tuning, advise to City/Council, etc.
b. Conduct Council interviews
c. Open house/meet-and-greets or alternative process with staff,leadership team, community
members
7. Complete Comprehensive Background
a. Conduct a full reference and background check as appropriate for a municipal administrator.
8. Finalize Offer and Hire (Search Firm may provide some assistance)
a. Negotiations of employment agreement including start date.
