EXPLANATION OF ISSUE
According to the U.S. Census Bureau's most recent survey of business owners, there are 2.6 million
black-owned businesses in this country,but gross receipts for all minority-owned firms are still well below
the average gross receipts for non-minority-owned firms. A huge problem is that despite a collective buying
power of$1.3 Trillion dollars,very little of that money stays in Black communities or is spent on
Black-owned businesses. This is despite a rise in black entrepreneurs in recent years. It is important to
highlight the vital role that these business play and acknowledge the unique challenges they face.
ACTION REQUESTED
Proclaim August as National Black Business Month to acknowledge and celebrate the contributions of
Black business owners and entrepreneurs in the Tigard community

EXPLANATION OF ISSUE
Immunizations play an important role in keeping families and communities healthy. Vaccinations are
important because they not only protect the person who is receiving the vaccine, but they also help to keep
diseases from spreading to others such as family,neighbors, classmates, coworkers, and other members of
the community. Immunization helps protect those who are the most vulnerable to illness, such as infants,
elders, and those with weakened immune systems.
ACTION REQUESTED
Proclaim August as National Immunization Awareness Month to raise awareness about the importance of
following immunization guidelines.

I am a lifelong Lutheran-born, baptized,confirmed, married as a Lutheran.While I admire the intent behind Christ the King safe
parking I have severe reservations.The church needs to be a supportive partner with the neighborhood.The church is nestled in a
suburban neighborhood with preschools,child care,apartments,and backyards right next to it or very near.Of course, not all
homeless people are drug addicts and I am happy to see the cars considered have been vetted. HOWEVER,the fact that the location
has been widely publicized,there is no 24 hour security,sanitary facilities on site are all open invitations for people to come and
pitch a tent, do drugs,commit crimes against neighbors,etc. Please consider that these programs are better placed on public
property or near businesses where they can be more easily monitored.The church is supported by taxpayer dollars in that they pay
no taxes and I think they have a special obligation to be good neighbors.Also there are deep,deep concerns about Just
Compassion's track record -and their finances. Please consider this as you make future decisions.

As taxpayers we have some concerns about the parking project headed by Just Compassion. I appreciate your time to listen to
residents and taxpayers of this city. If you think this proposal will really aid in reducing homelessness,then we appreciate your
hosting it on public property away from residential areas and schools. However,the thought of advancing a project like this forward
within residential areas or near schools is not what your constituents are wanting.And that is fair to feel this way. We have chosen
our neighborhood,our neighbors, have accepted the tax bill you assess us and faithfully pay it as well as faithfully contribute to the
livability of Tigard.We ask compassion and respect of you regarding our livability. Placing unknowns in our neighborhood and/or
near schools against our will would not be showing a "good neighbor" rule towards us. I also feel inviting a program like this into our
community is going to invite more homeless from other states or cities—not deter it. Portland is 12 times the size of Tigard and can
perhaps better facilitate a program like this.As we all know relaxing the hard drugs in the state only increased the problem and
brought in others from various states. If you want to maintain a reputation that Tigard is a great place to live and raise families,then
we ask that you not disrupt that reputation by approaching our neighborhoods with a program like this.We ask that you keep it on
public property monitored by police. For the sake of people enrolled in the program you should be seeking a place where they could
have their privacy while at the same time not affect the livability of our neighborhoods.Try your program and see if it is successful,
but please make the sites selected agreeable to all citizens.Thank you!

site of the Christ the King church is a wrong selection,and even today the Pastor is hosting homeless parking, in defiance of the
neighborhood and sound decision making. Please house them away from schools,churches,close neighbors,as there cannot be an

Thank you for considering my public comment. I work in the multifamily housing industry and work closely with the 3 metro counties
with the RLRA program and many other nonprofits. I agree that steps must be taken to help the unhoused and have compassion for
the unhoused. I'm deeply concerned with the amount of resources(both funds and the city's time)that have been allocated to the
safe park program.While I believe it can help people, I believe that the lack of defined metrics of success as well as the lack of
community involved planning have made this program untenable. Resources could be spent more efficiently to help more people. I
was especially disappointed with the initial claim from Just Compassion that this program helps local residents stay in their
community,only to hear that people are served by this program from anywhere-as far as New Mexico. If the program must go on, I
echo the sentiments of Bull Mountain Connect-please see attached document with specific asks to make this program work with
the citizens of Tigard. I care for this community and am very hopeful that it will be a safe place to raise my children.The actions this

It's been a real embarrassment what the City has allowed to happen at the library and other properties! We really need some
alternative viewpoints on City Council.The City of Portland has finally wised up about these liberal camping policies,and Tigard rolls
out the red carpet for this type of behavior! Why not take a cue from the City of Tualatin?Their Council,faced with the same State
mandates(which were recently challenged in the Supreme Court), reasonably made one single vacant lot available for houseless
camping, RIGHT NEXT DOOR TO THE POLICE STATION-A rational solution...

EXPLANATION OF ISSUE
The purpose of this action is to approve a contract amendment to the Pipeline Renewal and Replacement
Program Engineering Services contract.
ACTION REQUESTED
Staff recommends the Local Contract Review Board approve a contract amendment to Kennedy Jenks
Consultants,Inc. for the Pipeline Renewal and Replacement Program Engineering Services "Year 2"in the
amount of$699,668.00, two future amendments not to exceed $1,800,000.00, and direct the City Manager
to take the steps necessary to execute the amendments.
BACKGROUND INFORMATION
The Pipeline Renewal and Replacement Program (PRRP) was established in 2022 to proactively replace
aging water mains in an effort to improve water system resiliency, reduce the number of water main breaks,
and reduce ongoing maintenance costs. A desktop risk analysis of the water distribution system was
completed in 2023,identifying pipes with the highest breakage risk. The PRRP is currently in the final
design stages of the initial "Year 1"pipeline replacement project,which will replace approximately one mile
of pipe. The Year 1 project is scheduled to start construction in 2025. In 2026, approximately one mile of
pipe will be replaced. By 2027,it is anticipated that the city will have built up the resources and efficiencies
needed to replace or rehabilitate approximately two to three miles of pipe per year.
On January 24, 2022, the city issued a Qualifications Based Request for Proposal (QBS RFP) for
engineering,project management,bid assistance, and construction oversight services for the project.
Kennedy Jenks Consultants,Inc. scored as the top proposer, and on April 26, 2022, the Local Contract
Review Board awarded Kennedy Jenks Consultants, Inc. a contract for this work in the amount of
$907,242.00.The scope of the initial contract included a pipeline condition assessment and subsequent
pipeline replacement prioritization report, and design and construction administration services for the
initial Year 1 pipeline replacement project.
In accordance with the QBS RFP, the city may, at its discretion, award Kennedy Jenks Consultants,Inc. up
to three subsequent years for design,project management,bid assistance and construction oversight
services as the result of the initial term of the contract. "Year 2" of this project includes design services to
replace an additional one mile of water main, as well as an evaluation and subsequent technical report on
alternative and emerging pipeline rehabilitation technologies that may be used on future Pipeline Renewal
and Replacement Program projects for an estimated $669,668.00.
It is anticipated the city will award"Year 3" and "Year 4" under this contract for continued annual design,
project management,bid assistance and construction oversight services for an estimated total amount of
$1,800,000. All additional work under this contract is anticipated to not exceed$3,376,910. Each
subsequent year will be initiated through annual amendments specifying the year's projects.
Tigard's Public Contracting Rule 10.075C requires LCRB approval when the total of all amendments
exceeds twenty-five (25) percent of the original contract amount and when the amended contract amount
exceeds $150,000 if the board finds it to be in the public interest to do so.
ALTERNATIVES & RECOMMENDATION
The Local Contract Review Board may choose to not approve the contract amendment and issue a
solicitation for the remaining engineering and design work through Year 4 of the project. This would
require additional time spent by city staff to solicit the work and add inefficiencies and time for a new
consultant to become familiar with the previous work done.

EXPLANATION OF ISSUE
The purpose of this action is to approve the Professional Auditing Services contract.
ACTION REQUESTED
Staff recommends the Local Contract Review Board award the contract for professional auditing services
to Moss Adams LLC in the estimated amount of$750,000 and authorize the City Manager to take the steps
necessary to execute the contract.
BACKGROUND INFORMATION
Oregon Revised Statute 297.425 requires that every Oregon city publish a complete set of financial
statements presented in conformity with accounting principles generally accepted in the United States of
America (GAAP) and audited in accordance with generally accepted government auditing standards
(GAGAS) by a firm of municipal licensed certified public accountants. The city also annually applies for
the Government Finance Officers Association (GFOA) Certificate of Achievement for Excellence in
Financial Reporting with the auditor reviewed annual comprehensive financial reports (ACFR). The
Certificate program recognizes and supports excellence in financial reporting by state and local
governments. The GFOA award represents governments whose ACFR achieves the highest standards in
governmental accounting and financial reporting. The city has received the GFOA award for the previous
thirty-six years straight.
The city issued a Request for Proposal (RFP) for Professional Auditing Services on April 12, 2024,with the
notice published in the Daily Journal of Commerce. Upon Closing the city received two (2) proposals. The
proposers are as follows,with proposal score out of a possible 500:
•Moss Adams LLC (436)
•Aldrich CPA's &Advisors LLC (426)
An evaluation committee composed of staff from the finance department and two members of the Audit
Committee scored the proposals based on the following criteria, as outlined in the RFP:
•Firm Qualifications &Project Team (40% of total score)
•Project Understanding and Approach (30% of total score)
•Project Timeframe (10% of total score)
•Cost Proposal (20% of total score)
Upon review,including follow-up questions and reference checks, the evaluation committee found Moss
Adams LLC to be the top-ranking firm.As such, and in accordance with Tigard Public Contracting Rule
70.015.A.3.c, the City issued a Notice of Intent to Award and entered into negotiations with Moss Adams
LLC. The City and Moss Adams LLC were able to reach an agreed upon scope and price.
The fee for the audit engagement on our previous contract was $60,000—$70,000 per year. During that
time, the GASB issued multiple new accounting standards. GASB 87 and GASB 96 were the latest
standards implemented,which required additional disclosure and changes to financial presentation, as well
as the added accounts requiring auditing. Additionally, there are three new auditing standards that must be
implemented,requiring further testing. Additional hours will also be incurred to incorporate IT specialists
to test the ongoing Tyler implementation and conversion. This includes testing the configurations under
the new system,initial system access setup, and roles within the system, as well as the completeness and
accuracy of the data transferred to the new Tyler system.
As a result, fees have increased to incorporate the new standards and Tyler implementation fee
adjustments were also made to account for inflation since the last contract. The cost for the first year of the
new contract is $135,000,with a 5% annual increase over the possible five-year contract term. The year one
cost beyond the amount included in the FY 25 adopted budget. An additional amount will be requested
during the QI supplemental budget process.
ALTERNATIVES & RECOMMENDATION
The Local Contract Review Board may choose to not award this contract and direct staff to resolicit for
the work. This will delay the audit work and will likely cause the City to be unable to meet the December
31 deadline to file annual reports with the Secretary of State.

The purpose of this action is to approve the Pavement Management Rehabilitation Project contract.
ACTION REQUESTED
It is recommended that the Local Contract Review Board award the Pavement Management Rehabilitation
Project contract to Knife River Corp NW in the amount of$2,067,591.94 and direct the City Manager to
take the steps necessary to execute the contract.
BACKGROUND INFORMATION
The annual Pavement Management Program (PMP) protects the city's investment in street infrastructure.
The program typically includes a combination of minor maintenance projects (slurry seal applications) and
major maintenance and rehabilitation projects (pavement overlays). In a pavement overlay project, the
pavement on a street has deteriorated due to traffic usage and weather and is at the point where pavement
repairs and overlays are necessary to avoid further deterioration and return the street to a good condition.
Specific work under this contract will include the following types of activities:
•Removal of existing failing pavement,inspection and repair of subgrade (existing base rock) if
needed and inlay new pavement in those sections.
•Construction of asphaltic base for roadways
•Construction of aggregate base for roadways
•Asphalt concrete removal (grinding)
•Roadway excavation
•Full depth reclamation of roadways
•Application of sealant along pavement edges &joints
•Temporary signage,protection and traffic control
•Striping and pavement markings
•Construction of concrete curbs,ramps and sidewalks
Specific locations where this rehabilitation work will take place include:
•SW DURHAM ROAD: Carol Ann Court to 74th Ave
•SW HILLVIEW STREET: 104th Ave through SW Hillview St Cul-de-sac
•SW SUNRISE LANE SW: 150 Ave through End of Street

The City issued an Invitation to Bid for the project June 17, 2024,with notice published in the Daily
Journal of Commerce. The Engineer's estimate for the project was $2,359,644. Four (4) bids were received
and opened on Thursday,June 27, 2024, at 2:00 p.m.
•S2 Contractors $2,152,797.20
•Knife River Corp. NW $2,067,591.94
•TFT Construction, Inc. $2,163,958.60
•Kerr Contractors Oregon LLC. $2,465,417.50
The project team,including central contracting,has completed responsibility determination reviews of the
bids in accordance with ORS 279C.375, reviewed the bids for errors, and, after these reviews, determined
that Knife River Corp NW submitted the lowest responsible bid. Knife River Corp NW has no State of
Oregon Construction Board violations and is not on the Bureau of Labor and Industries ineligible list.
Accordingly,it is recommended the city award the PMP Pavement Rehabilitation contract to Knife River
Corp NW in the amount of$2,067,591.94.
ALTERNATIVES & RECOMMENDATION
The Local Contract Review Board may reject this contract award recommendation and direct staff to
rescope and resolicit for the work. This would likely result in a higher cost as other agencies begin to
absorb contractor capacity for their annual street infrastructure work.

WHEREAS, Ron and John have volunteered countless hours in creating an event that has become a
memorable, cherished, and signature special event for the entire community, even recording a
Talking Tigard Podcast with Kent Wyatt to talk about the event's entertainment, music&games to
be enjoyed by young and old alike; and
WHEREAS,when asked, Ron generously shared his time, knowledge, and experience in planning a
first-of-its-kind drone show for the community,illustrating his enduring commitment to bringing
together generations of Tigardians to celebrate the holiday in a cost-free, family-friendly atmosphere;
and
WHEREAS,in addition to Ron's long-standing commitment to volunteering,he owned Tigard
Music for over 45 years, creating strong bonds with the school district, teachers,parents, bands,

The purpose of this action is to approve the Photo Enforcement Systems &Related Services contract.
ACTION REQUESTED
Staff recommends the Local Contract Review Board award the contract for photo enforcement systems
and related services to Verra Mobility in the amount of$2,400,000.00, and authorize the City Manager to
take the steps necessary to execute the contract.
BACKGROUND INFORMATION
At the direction of City Council, over the past several years the Police Department exhaustively reviewed
and explored implementing, and subsequently administering, a photo enforcement program in Tigard. In
September 2018, after extensive review and discussion with Council regarding the program, the City issued
a Request for Proposal (RFP) and the LCRB awarded a contract to Conduent State&Local Solutions Inc.
Through this contract, the program was implemented with photo red light enforcement cameras at the
following locations:
•99W& SW Hall Boulevard, and
•99W& SW Durham Road
•99W& 72nd
The contract (including a one-year extension) for the implementation and first five years of the program
expires on October 31, 2024. After continued discussion with Council regarding the program, the Police
Department,under guidance from Council, determined it was in the best interest of the City to continue
the program and issue a new solicitation for photo enforcement systems and related services, for the next
five years. There is no change to the camera locations.
The City issued a Request for Proposal (RFP) for the project on March 22, 2024,with notice published in
the Daily Journal of Commerce. Upon closing, the city received five (5) proposals. The proposers are as
follows,with a proposal score out of a possible 300:
•American Traffic Solutions,Inc. dba Verra Mobility- 263
•Conduent State&Local Solutions, Inc. - 262
•Jenoptik Smart Mobility Solutions,LLC. - 197
•Novoa Global, Inc. - 251
•Altumint, Inc. - 227
An evaluation committee of staff from multiple departments scored the proposals based on the following
criteria, as outlined in the RFP:
•Knowledge, Experience, Qualifications, and Financial Stability of the Firm (20% of total score)
•Project Understanding and Approach (30% of total score)
•Technical Specifications of the System (30% of total score)
•Compensation Structures (20% of total score)
Upon review, the evaluation committee found Verra Mobility, Conduent State&Local Solutions, Inc., and
Novoa Global, Inc. to be the top-ranking firms and invited the firms for in-person presentations on May
29, 2024. During this process, an expanded selection committee evaluated the presentations and responses
to the City's questions. The interview scores out of 100 are as follows:
•American Traffic Solutions,Inc. dba Verra Mobility- 78.63
•Conduent State&Local Solutions, Inc. - 70.25
•Novoa Global, Inc. - 74
Verra Mobility received the highest score for both their proposal and presentation. Accordingly,Verra
Mobility received the selection committee's recommendation for contract award.
As such, and in accordance with ORS 279 and Tigard Public Contracting Rule 70.015.A.3.c, the City issued
a Notice of Intent to Award and entered into negotiations with Verra Mobility. The City and Verra
Mobility were able to reach an agreed upon scope and price. The total cost for a five (5) year contract is
estimated to be no more than $2,400,000.00.
ALTERNATIVES & RECOMMENDATION
The Local Contract Review Board may choose to not award this contract and direct staff to re-solicit for

Additional Fiscal Notes: The first year of this contract is $441,600 and is included in the Police Operations
FY25 budget. Future years of the contract will be included in the annual budgets. The contract will include
an annual escalator tied to the West Consumer Price Index, capped at 4%.
The current photo enforcement vendor's contract expires on October 31, 2024, and will only impact
FY25 for four months at the current monthly cost of$35,666.
The FY25 budget allocated for the photo enforcement contract is $441,250.The estimated revenue
related to traffic fines in FY 25 is $1.5 million.
We also estimate up to 3 months of no photo enforcement citations issued due to the time necessary to
switch vendor equipment.The revenue loss during this period is estimated between$225,000 - $375,000,
which was not factored into the $1.5 million estimated revenue.

This ordinance proposes to amend Tigard Municipal Code Chapter 7.80 to prohibit camping on hardscape

ACTION REQUESTED

BACKGROUND INFORMATION
Camping on the sidewalks around City Hall,the Library, and Public Works has restricted the accessibility
for community members attempting to utilize City buildings and services. In the interest of meeting the
needs of all community members, this ordinance would prohibit camping on all hardscape surfaces on City
properties.

WHEREAS, the Tigard City Council heard a presentation on the current state of the City's implementation of
time, place, manner regulations and directed staff to draft an ordinance prohibiting camping on hardscape
surfaces;and
WHEREAS,camping on hardscape areas of City campuses has restricted accessibility for community members
attempting to utilize City buildings and services;and
WHEREAS,the City of Tigard is committed to meeting the needs and interests of all community members.
NOW,THEREFORE,THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Tigard Municipal Code Section 7.80.010 is amended to read as follows (new text in underline,
deleted text in strikcthrough):
"Hardscape"means any horizontal surface composed of asphalt,concrete,cement,or brick.
SECTION 2: Tigard Municipal Code Section 7.80.030.0 is amended to read as follows (new text in
underline,deleted text in ctrikcthrough):
9. On any hardscape surface on City properties.
SECTION 3: This ordinance shall be effective 30 days after its passage by the council, signature by the
mayor, and posting by the city recorder

AN ORDINANCE AMENDING TIGARD MUNICIPAL CODE CHAPTER 7.80 TO PROHIBIT
CAMPING ON CERTAIN CITY PROPERTIES AND DECLARING AN EMERGENCY
WHEREAS,a person without available shelter is not currently prohibited from camping on the City Hall,Library,
or Public Works properties;and
WHEREAS,behaviors by some of the persons camping on Library property are in conflict with use policies and
not compatible with the Library being a welcoming place to all community members,especially children;and
WHEREAS,the City Hall property will be the location for a Safe Lot program;and
WHEREAS, for the protection of the participants of the Safe Lot program, the City wishes to establish a 350
foot buffer around the Safe Lot property;and
WHEREAS, the buffer will effectively prohibit camping on City Hall property and part of the Public Works
property;and
WHEREAS, to protect building infrastructure and landscaping, the City wishes to prohibit camping within 30
feet of a building.
NOW,THEREFORE,THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Tigard Municipal Code Section 7.80.010 is amended to read as follows (new text in underline,
deleted text in strikcthrough):
"Safe Lot" means the regulated, overnight camping in vehicles as part of an organized
program operated by a nonprofit dedicated to providing houseless services.
SECTION 2: Tigard Municipal Code Section 7.80.030.0 is amended to read as follows (new text in
underline,deleted text in strikethrough):
4. Within 500 feet from a shelter facility or a property where homeless services are
provided,or within 350 feet from a Safe Lot on City property.
10. On the Tigard Public Library property and City Hall property.
11. Within the bark dust area adjacent to the Public Works building.
SECTION 3: This ordinance being necessary for the preservation of the public peace, health, and life
safety, an emergency is declared to exist and this ordinance shall be effective July 29,2024.
