As an employer, you must comply with the following: • Oregon's Withholding Tax Law: Employers must withhold income taxes from employee wages at the time employees are paid. You will be liable for the tax payments even if you don't actually withhold the tax from your employees. For more information, call the Department of Revenue at 503-378-4988. • Unemployment Insurance Tax: Employers are required to pay a tax for unemployment insurance purposes on the wages of all employees. For more information, call the Oregon Employment Department at 503-947-1488. • Oregon's Business Identification Number (BIN): is a combined number for both Oregon Withholding and Unemployment Insurance Tax. To file for a BIN, go online to the Oregon Business Registry. For questions, call 503-945-8091. • Workers Compensation Insurance: Employers are subject to the Oregon Workers Compensation Law, and must obtain Workers Compensation Insurance for their employees. If you fail to obtain Workers Compensation Insurance, you could be subject to penalties and be liable for all claim costs if one of your workers is injured on the job. For more information, call the Workers Compensation Division at the Department of Consumer and Business Services at 800-452-0288. • Tax Withholding: Employers must withhold Social Security Tax and Federal Income Tax from employee wages. You may be liable for the tax payment, even if you didn't actually withhold the tax. For a Federal EIN number, go online to www.irs.gov. Other Responsibilities of Homeowners: • Code Compliance: As the permit holder for a construction project, the homeowner is responsible for notifying building officials at the appropriate times, so that the required inspections can be performed. Homeowners are also responsible for resolving any failure to meet code requirements that may be found through inspections. • Property Damage and Liability Insurance: Homeowners acting as their own contractors should contact their insurance agent to ensure adequate insurance coverage for accidents and omissions, such as falling tools, paint overspray, water damage from pipe punctures, fire, or work that must be redone. Liability Insurance must be sufficient to cover injuries to persons on the job site who are not otherwise covered as employees by Workers Compensation Insurance. • Expertise: Homeowners should make sure they have the skills to act as their own general contractor, and the expertise required to coordinate the work of both rough-in and finish trades. Yes, because of our youngest child being as old as he is, we do not plan to ever rent the space out to a stranger. That being said,we did plan on and budget for using the fire suppressant sheetrock on the wall between the new room and the main house anyway because of the kitchenette. Also, extra soundproofing is always better, especially with a teenager. ;-) Thanks, Rachel Strong On Thu, Mar 30, 2023 at 5:53 PM Hope Pollard <hopep@tigard-or.gov>wrote: Hi Rachel, Thank you for the clarification! If you do not intend to use this as a separate rentable unit or ADU,then that is OK and you do not need a separate address. However, please note that if you do decide to rent it out as a separate unit at any point in the future, the building department will require you to add fire separation at that time (and it can be complicated to do later/after the fact). Please let me know how you would like to proceed. If not as a separate dwelling unit, I will have our team make note of that and continue processing without the second address. Thank you!! That's actually one of the questions we had. There was some uncertainty when I was there dropping off plans, with the separate bathroom and kitchenette area but also full access to the main house, of whether this counted as a true ADU, or some other kind of classification of remodel. Once the unit is finished, we have a friend who will be living there, but it's not going to be a rental per se, so we don't know if we actually need a separate address. We'll be sharing our laundry room, living room, and dining room of the main house, and all of the utilities will be shared (the electrical panel will still be in the new space--please ignore the electrical and plumbing pages, the contractors will be submitting their own permit applications), so it will be more of a roommate situation than landlord-tenant. We also want it available for the kids-- 16 and 4, which is another reason we're not going to be officially renting out the space -- to give them some autonomy when they become adults if needed, as a home office, or just as more space to entertain when our friend moves out, but it will never be used as an investment, like a true rental space would be. If it sits "empty," or used just as part of the main dwelling does it need a separate address? (You can understand the confusion.) If we need to get a separate address for it,that's fine, but, as I said before, there was some uncertainty when I dropped everything off, so it's a good thing you emailed. It looks like you did not apply for a separate address, and it's occasionally referenced as an ADU. Before we can continue processing, we will need you to work with Oscar, copied here,to get a new address. This is not optional if you're considering this a new/separate unit. 2 If you are considering this an ADU, you may also be eligible to apply for SDC exemptions. Please work with Danielle, copied here, if you would like to pursue that option. Let me know if you have any questions. Thank you!
