Sorry to be nitpicky but I just want to make absolutely sure we're okay with releasing permits.Was just rereading
everything to make sure I don't move forward until I'm supposed to, and noticed this other requirement that needs to
be met before issuing up to 50%of the permits:
the City Engineer has determined that the corresponding improvements are substantially complete to assure that the
health and safety of the citizens will not be endangered from inadequate public facilities
Are the improvements substantially complete/are we for sure good to move forward with up to 50%of permits?

The Subdivision Compliance Agreement allows for 50%of permits to be issued, but has a few terms associated with it.
One being acceptance of As-builts(Record Drawings).The project file has a draft set of As-builts, but I don't see final yet.
Excerpt from Subdivision Compliance Agreement:
(a) No building permits, or permits to connect to City utility services shall be issued for lots within Petitioner's
subdivision as described until: 1) the City Engineer has determined that the corresponding improvements are
substantially complete to assure that the health and safety of the citizens will not be endangered from inadequate
public facilities, and 2) Petitioner has provided to the City Engineer one check print of the as-built drawings,
prepared by a registered civil engineer, for review and approval, along with certification of substantial
completion, signed and stamped by Petitioner's engineer.
(b) Upon a determination by the City Engineer that the improvements are substantially complete and a check
print of the as-built drawings has been reviewed and approved, the Petitioner or individual lot owners within
the subdivision may receive building permits or utility service for not more than 50-percent of the platted lots
within the subdivision.
We will need the final as-builts to be submitted, reviewed, and accepted/approved by the City prior to releasing the
building permits.

Hi Hope. Tigard signed our plat a few days ago. It should record this week. As soon as it records,we
believe we are eligible to receive 50%of the building permits for our project, according to our signed
compliance agreement. The remaining 50%will be tied to condition 25 below, as I understand it. Of
course, Jennifer Doty in our office is just trying to get the above referenced building permits reviewed,
not approved.

Boris can correct me if this is wrong, but I believe it actually should have been Condition 25 that still
needs to be met (as follows). It's my understanding that Engineering still hasn't conditionally accepted
improvements for the development.
25. Prior to final plat approval, all improvements associated with public infrastructure including but
not limited to street improvement under the City of Tigard jurisdiction must be constructed, completed
and/or satisfied. The Applicant must obtain conditional acceptance from the City and provide a two-
year maintenance assurance for said improvements

I spoke with our Land Acquisition and Development Manager, Niki Munson, and it's our understanding
that all of the items listed under 23 and 32 have been met/submitted with one exception,the sidewalk
along the frontage of the model home. The sidewalks that were required during development (those not
in front of a future home) are in, but in other jurisdictions we typically wait until house construction to
install the sidewalks in front of the homes, and we're still waiting on our model home permit to be
issued. Would it be possible to delay the model home sidewalk requirement until issuance of these four
permits and allow them to continue to building review?

The subject applications are approved but cannot be released until the following conditions have been
met. Please coordinate with Boris, copied here,to meet these conditions.
23. Prior to final plat approval and permit issuance of the proposed sales office and model homes,
the applicant shall demonstrate that the following measures are in place:
a. Provision of adequate fire access and water supply, including fire hydrants, as determined by
the TVF&R.
b. Provision of safe and adequate pedestrian and vehicle access, including a sidewalk along the
frontage of each model home lot and curbs and the first lift of asphalt on all streets proposed to serve
each model home lot.
c. Installation of utilities within all streets proposed to serve each model home lot.
d. Provision of adequate parking.
32. Prior to final plat approval,the applicant must provide evidence that the Homeowners
Association (HOA) is formed and the Covenants,Conditions, and Restrictions(CC&R) document is in
place with language in regard to the maintenance of tracts and private accesses.
Note:the following Planning condition will also need to be met prior to building inspection(coordinate
with Jenny,copied here):
33. Prior to a final building inspection,the applicant shall call for a final planning inspection and
final urban forestry plans to ensure the project was completed according to the approved plan.
