Discussion • CONTINUING DISCUSSION ORDINANCES o Does the Committee want to retain a single reading of the ordinances, as currently prescribed by the Charter? • The group discussed and agreed to retain one reading, and through either council rules or an ordinance, allow councilors the choice to move for multiple readings. • PUBLIC IMPROVEMENTS o Should the Tigard City Charter include condemnation, given that it's addressed in state law? • The group discussed and agreed to remove language around condemnation and reference that the city will follow state law. o Should the Charter include requirements about improvements (local improvement districts)? • The group discussed and agreed to reference state law in the charter and remove the language around the section titled, "Improvements." o Should the Charter continue to include `Special Assessments'? These fees and levies are governed by code and this is an inherent power that the City has and does not need to proactively claim in a Charter. • The group discussed and agreed to clean up the language and maintain concept of special assessments in the charter. This area is thoroughly governed by state law and Tigard's local public contract rules. • The group discussed and agreed to remove bids entirely from charter, as this is heavily regulated in state law. • DEBT LIMIT o Does the Committee wish to adopt the Model LOC Charter language that has been recommended by City Bond Counsel? • The group discussed and agreed to include similar language found in the city of Beaverton's charter: "City indebtedness may not exceed the debt limits imposed by state law." • WILLAMETTE RIVER o Is this section still relevant and appropriate to the City Charter in 2023? • The group discussed and agreed to have this section removed from the charter. • OTHER o A request was made to have a conversation on city fees, such as setting limitations and requiring a public vote when raising fees. The group followed with discussion. o Staff will research how fees are discussed in peer charters and report back to the group for a longer discussion.
