Except where nonconforming, residential uses are limited to mixed-use developments. A wide range of uses, including but not limited to adult entertainment, automotive equipment repair and storage, mini-warehouses, utilities, heliports, medical centers, major event entertainment, and gasoline stations,are allowed conditionally. APPLICABLE REVIEW CRITERIA: Tigard Community Development Code Chapter 18.765 and 18.410 SECTION IL DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. BACKGROUND INFORMATION Site Information: The subject-site is located at 12282 SW Scholls Ferry Road (WCTM 1S134BC, Tax Lot 300), south of SW Scholls Ferry Road, east of SW North Dakota Street, and west of SW 121•`Avenue. It is located in the Greenway Town Center, a 7.64-acre shopping center. The site is developed with three commercial buildings, landscaping, and associated parking. The site is zoned General Commercial (C-G), as are adjacent properties to the east and west. Adjacent properties to the south are zoned RES-E and RES-C. The site borders Beaverton city limits to the north. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.765 Modifications; 18.765.060 Minor Modifications A. Definition.A minor modification has the following characteristics: 1. It has minima(impacts on surrounding properties,sensitive lands,or public facilities;and FINDING:The applicant proposes a change of use to a use with a higher parking quantity requirement and does not propose any exterior or site modifications. The site does not contain any sensitive lands, thus there are no impacts on sensitive lands. Because there is no work proposed outside of the tenant space, there are no impacts on surrounding properties. The change of use will result in an increase of vehicular traffic that is negligible and overall poses minimal impacts on public facilities. 2. It does not cause the development to go out of conformance with any applicable standard or further out of conformance if already nonconforming, except where an adjustment has been approved. FINDING: The proposal does not cause the development to go out of conformance with any applicable standard or further out of conformance if already nonconforming because the applicant is proposing only a change of use, which primarily affects off-street parking regulations, that is the main focus of this review. The applicant proposes a change of use from a fast food eating and drinking establishment to a regular eating and drinking establishment, resulting in an increase in the minimum number of parking spaces required. The Greenway Town Center is a mixed-use,multi-tenant development and is subject to the required minimum vehicle parking formula outlined in TCDC 18.410.030.D. MMD2022-00049 Michi Japan 3 • D. Approval criteria. The approval authority will approve or approve with conditions a minor modification application when all of the following criteria are met: 1. The proposed modification qualifies as a minor modification as defined in Subsection 18.765.060.A; FINDING: As demonstrated in the findings above, this proposal qualifies as a minor modification as defined in CDC 18.765.060.A.This criterion is met. 2. If the proposal involves the modification of a condition of approval, at least one of the following criteria is met: a. The condition cannot be implemented for reasons outside the control of the applicant or property owner, b. The condition is no longer needed or warranted because circumstances have changed; or c. A new or modified condition better accomplishes the purpose of the original condition. FINDING: The applicant does not propose to modify a condition of approval. This standard does not apply. CONCLUSION: This proposal qualifies as a minor modification to an existing development, as defined in TCDC 18.765.060.A,and is in compliance with all applicable standards of this Title. SECTION V.
