APPLICATION SUMMARY RECEIVED AUG 17 2022 FILE NAME: Eagle View Estates Lot 2 Attached ADU CASE NO.: Accessory Dwelling Unit (ADU) BUILY116 PROPOSAL: The applicant proposes to construct a new single detached house with one attached accessory dwelling unit (ADU).The single detached house will be 2,302 square feet and the attached ADU will be 2,301 square feet. The proposed dwelling and ADU will be located on Lot 2 of the proposed Eagle View Estates subdivision. Lot 2 in Eagle View Estates subdivision. BASE ZONE: R-4.5: Low-Density Residential APPLICABLE REVIEW CRITERIA: Community Development Code (CDC) Chapter 18.220 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has approved the above request, subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. ADU2022-00016 Eagle View Estates Lot 2 Attached ADU 1 CONDITIONS OF APPROVAL THE FOLLOWING CONDITIONS MUST BE SATISFIED: The applicant must prepare a cover letter and submit it, along with any supporting documents and/or plans that address the following requirements to the Community Development Department Attn: Sean Vermilya, 503-718-2421.The cover letter must clearly identify where in the submittal the required information is found: 1. Prior to issuance of any building permits, the applicant must demonstrate that the final plat for SUB2019-00002 has been approved by all relevant departments and recorded with Washington County. The applicant must submit a copy of the recorded subdivision map to the city to be incorporated into the record. SECTION III. BACKGROUND INFORMATION Site Information: The subject property (9214 SW Waverly Drive, WCTM 2S114 AC, tax lot to be determined) is located due west of the intersection of SW 92nd Avenue and SW Waverly Drive. The property is currently 1.31 acres (57,063.6 square feet) in size. The proposed dwelling and attached ADU are to be located on Lot 2 of the proposed Eagle View Estates Subdivision (Case File No. SUB2019- 00002). As proposed in SUB2019-00002, Lot 2 is an 8,400 -square-foot lot at the end of the proposed extension of SW Waverly Drive. Lot 2 is partially located within a steep slopes sensitive lands overlay. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS At the time of this decision, the Eagle View Estates Subdivision has not been platted; this decision pertains only to Lot 2 of the proposed subdivision and does not apply to the whole property as it exists today. 18.220 Accessory Dwelling Units 18.220.050 Standards A. Number of dwelling units. 1. A maximum of 2 accessory dwelling units are allowed per single detached house. 2. A maximum of 1 detached accessory dwelling unit is allowed per single detached house. A second accessory dwelling unit must be attached to the primary dwelling unit. FINDINGS: The applicant proposes one single detached house with one attached ADU.This criterion is met. B. Size. 2. The square footage of each attached accessory dwelling unit may not exceed the square footage of the primary dwelling unit. FINDINGS: The proposed primary dwelling unit is 2,302 square feet and the proposed attached ADU is 2,301 square feet. This criterion is met. C. Height. 2. A structure containing an attached accessory dwelling unit may not exceed the maximum height for a single detached house in the base zone. ADU2022-00016 Eagle View Estates Lot 2 Attached ADU 2 FINDINGS: The subject property is located in the R-4.5 zone. The maximum height for a single detached house in the R-4.5 zone is 30 feet. The proposed single detached house with attached ADU does not exceed the maximum height standard because it is 29 feet tall, which is shorter than 30 feet. This criterion is met. D. Setbacks.Accessory dwelling units must meet the setback standards for a single detached house in the base zone, with the exception that a detached accessory dwelling unit may be located within 5 feet of the rear property line if the accessory dwelling unit is 15 feet or less in height. FINDINGS: The subject property is located in the R-4.5 zone. This criterion is met. E. Lot coverage. Accessory dwelling units must meet the lot coverage standards for a single detached house in the base zone. FINDINGS: There are no lot coverage standards in the R-4.5 zone. This criterion does not apply. F. Entrances.Only one attached accessory dwelling unit may have an entrance on the facade facing the front property line. The entrance to a second attached accessory dwelling unit must be oriented to a side, street side, or rear lot line. FINDINGS: The applicant proposes only one attached ADU with a facade facing the front property line. This criterion is met. G. Home occupations. Type II Home Occupations are prohibited on a lot with two accessory dwelling units. FINDINGS: There are no existing or proposed home occupations on the subject property. This criterion is met. H. Accessory dwelling units in accessory structures.Accessory dwelling units may be added to existing accessory structures such as garages, subject to the maximum square footage and height restrictions for each, as measured using the method provided in Section 18.40.120. FINDINGS: The proposed accessory dwelling unit is not located within an accessory structure. This criterion does not apply. ADU2022-00016 Eagle View Estates Lot 2 Attached ADU 3 CONCLUSION: This proposal is to construct a single detached house with an attached accessory dwelling unit and is in compliance with the applicable requirements of this Title. The proposal is approved for the proposed Lot 2 of Eagle View Estates Subdivision (SUB2019-00002) and applies strictly to that lot within the proposed subdivision. The approval of this application has been conditioned on the successful recording of the final plat for the Eagle View Estates Subdivision. SECTION V.
