DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. MMD2022-00030 NVision 1 • SECTION III. BACKGROUND INFORMATION Site Information: The subject site is located at 7000 SW Redwood Lane; east of SW 72'd Avenue, south of SW Redwood Lane,and west of SW Sequoia Parkway.The 4.76-acre site is developed with three nonresidential buildings, parking, landscaping, and other associated improvements. Adjacent properties to the north, south, and cast arc zoned Industrial- Park (I-P). Adjacent properties to the west are zoned Light Industrial (I-L). The site is part of a larger business complex, Pacific Corporate Center. The site was recently approved for site and landscaping modifications (MMD2022-00015). SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.765 Modifications: 18.765.060 Minor Modifications A. Definition.A minor modification has the following characteristics: 1. It has minimal impacts on surrounding properties, sensitive lands, or public facilities; and FINDING: The applicant proposes a change of use to an existing tenant space at 7000 SW Redwood Lane, Suite 100 from an office use to a medical office usc. This proposal does not include any exterior changes to the building or site and is primarily being reviewed due to the effect on off-street parking requirements. This will have no effect on surrounding properties or public facilities. The site does not contain any sensitive lands. Accordingly, staff finds the proposal will have minimal impacts on surrounding properties, sensitive lands, or public facilities. 2. It does not cause the development to go out of conformance with any applicable standard or further out of conformance if already nonconforming, except where an adjustment has been approved. FINDING: Because the proposed use requires the application of a higher parking quantity standard than the previous use, a review is required to ensure that the site as a whole continues to comply or does not go further out of conformance with the off-street vehicle parking quantity standards. The tables below calculates the minimum and maximum off-street parking spaces required for the site based on the multi- tenant formula in TCDC 18.410.030.D. According to the applicant's materials the site contains 295 parking spaces, and therefore satisfies the minimum parking requirement and brings the site into compliance with the maximum parking requirement. D. Approval criteria. The approval authority will approve or approve with conditions a minor modification application when all of the following criteria are met: 1. The proposed modification qualifies as a minor modification as defined in Subsection 18.765.060.A; FINDING: As demonstrated in the findings above, this proposal qualifies as a minor modification as defined in TCDC 18.765.060.A.This standard is met. 2. If the proposal involves the modification of a condition of approval, at least one of the following criteria is met: a. The condition cannot be implemented for reasons outside the control of the applicant or property owner; b. The condition is no longer needed or warranted because circumstances have changed; or c. A new or modified condition better accomplishes the purpose of the original condition. FINDING: The applicant is not proposing to modify a condition of approval. This standard does not apply. CONCLUSION: This proposal qualifies as a minor modification to an existing development, as defined in TCDC 18.765.060.A,and is in compliance with all applicable standards of this Title. SECTION V. (Kittelson) performed a trip generation study of the existing NVISION facility located at 9975 SW Nimbus Avenue in Beaverton, Oregon. The existing business is to be relocated to a building located at 7000 SW Redwood Lane in Tigard, Oregon.This memorandum presents the results of a trip generation analysis prepared to inform the Washington County Transportation Development Tax (TDT) and City of Tigard Transportation System Development Charges (TSDC) assessments associated with the proposed site in Tigard. NVISION Trip Generation Both the County TDT Ordinance and the City TSDC assessments are predicated on trip generation estimates developed using different editions of the nationally recognized Institute of Transportation Engineers' (ITE) Trip Generation Manual'. Based on our review, there is no land use category provided within past editions or the current Trip Generation Manual, 11th Edition (Reference 1) that is directly representative of the NVISION facility. The TDT and TSDC calculations provided by the City of Tigard'classified NVISION under ITE land use code 630 — Clinic. A clinic is described in the ITE Trip Generation Manual as "a facility that provides limited diagnostic and outpatient care but is unable to provide prolonged in-house medical and surgical care". NVISION is an eye specialist facility with general consultations and laser eye surgery. Given the lack of representative land uses in the Trip Generation Manual, the trip generation of the existing NVISION facility in Beaverton (to be relocated to the proposed site in Tigard) was measured to provide a better understanding of site trips to inform the TDT and TSDC calculations. All vehicle trips entering and existing the existing NVISION facility were counted for three consecutive midweek days in October 2022 between the hours of 7:00- 9:00 AM and 4:00—6:00 PM. The three-day average morning peak hour and evening peak hour trip counts were measured to be: • Average AM peak hour rate: 1.18 trips per 1,000 SF • Average PM peak hour rate: 0.91 trips per 1,000 SF The traffic count data is included as Attachment B. The City's TSDC trip rates are based on the average weekday PM peak hour rates while the County TDT is predicated on daily trip generation. Both fee programs allow for a trip credit for the existing building use. TDT and TSDC Assessment Table 1 provides a suggested calculation of the City TSDC assessment for the site under the former general office use (using Trip Generation Manual, 9th Edition) and the measured NVISION use. For TDT assessment purposes, the selection of land use categories is limited3. Given the measured NVISION peak hour trip generation is less than the general office trip rates for the same period and reviewing the land use options available per the TDT Procedures Manual, one could conclude that the daily trip rate of NVISION should also be less than or equal to that of a general office use and thus a general office use classification could be assumed for NVISION assessment purposes. 3 Per Section 3.17.050 of the Countywide Transportation Development Tax Procedures Manual:"In the event the Director determines that a particular use does not have a basis for TDT calculation stated in Appendix B the Director shall either: 1. Determine the TDT based on the use listed in Appendix B most similar in trip generation; or 2. At the election (and expense) of the applicant, consider an alternate TDT based on a traffic study to estimate the weekday average person trip generation of a same or similar use verified by a registered traffic engineer. In the event an alternate TDT is utilized, the Director may make such adjustments as deemed applicable in consideration of location,size and other appropriate factors."We recommend use of the General Office trip category as the land use listed in Appendix B most similar in trip generation based on the measured NVISION trip rates. 'Fees&Charges Schedule(Reference 3) As shown in Table 1, the suggested TDT and TSDC calculations for the proposed NVISION use are lower than the credits calculated for the former office use.Thus, no additional charges should be required for the proposed use (note that neither the City nor County offer refunds in the event that a new use generates fewer trips than a prior use). We trust that this memorandum adequately addresses the trip generation of the proposed NVISION facility and offers a reliable basis for assessing the TDT and TSDC charges for the site.
