SECTION III. BACKGROUND INFORMATION
Site Information:
The subject property is located north of SW Beef Bend Road, east of SW River Terrace Boulevard,
south of SW Bull Mountain Road,and west of SW Finis Lane. The site is zoned Residential C (RES-
C) and is within the River Terrace Plan District, as are surrounding properties to the north and east.
Additionally,the property is designated as Public Institution within the City of Tigard Comprehensive
Plan.The site abuts unincorporated Washington County rural agriculture land to the west and south
that is not within the Urban Growth Boundary (UGB). There are currently no existing structures on
the subject site. The northern edge of the site contains a stand of large mature trees, and there is
significant elevation gain (approximately 80 feet) from the south property line to the north property
line.
The applicant is requesting approval to locate a covered structure within the Art Rutkin Elementary
School;a 51,300 square foot elementary school development approved under Conditional Use Permit
CUP2014-00001 on an approximately 10.5-acre property known as Parcel 1 of Minor Land Partition
MLP2018-00004. The applicant is now applying separately for a minor modification of the existing
Conditional Use Permit for the purpose of adding an approximately 480 square foot covered structure
adjacent to elementary school's future community garden. This covered structure will be used by the
school to conduct science and agriculture classes.
SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS

18.765.060 Minor Modifications
A. Definition.A minor modification has the following characteristics:
L It has minimal impacts on surrounding properties,sensitive lands,or public facilities;
and
FINDING: The proposed covered structure will be located within the Art Rutkin Elementary
School development, adjacent to the school's community garden. The community garden is located
at the southeast corner of the subject site and is approximately 60 feet from the side property line and
will be more than 100 feet from the existing sensitive lands on the southeast corner of the subject site,
therefore the proposal has minimal impacts on surrounding properties and sensitive lands.There are
already adequate facilities in place to serve the Art Rutkin site and the proposed building, so the
impacts to public facilities by this proposal are expected to be minimal. The proposal meets the
definition of a minor modification.
2. It does not cause the development to go out of conformance with any applicable
standard or further out of conformance if already nonconforming, except where an
adjustment has been approved.

FINDING: The proposed modification meets all of the applicable development standards as
outlined in the findings below and therefore, does not cm-Ise the development to go further out of
conformance with the applicable standards.
18.350 Residential Zone Development Standards
18.350.040 Development Standards
A. Setbacks.
1. The minimum setback from any street property line is 15 feet.
2. The minimum setback from side and rear property lines is 20 feet.
FINDING: The proposed modifications to the Art Rutkin Elementary School site will
consist of an approximately 480 square foot covered structure. According to the applicant's
site plan,the covered structure is approximately 550 feet from the street property line on River
Terrace Boulevard,approximately 60 feet from the side property line,and approximately 200
feet from the rear property line. This standard is met.
B. Height.The maximum height is 45 feet
FINDING: The proposed covered structure has a height of 15 feet which is below the
maximum height
of 45 feet.This standard is met.
C. Lot coverage. The maximum lot coverage is 85 percent.
FINDING: The previously approved Conditional Use Permit indicated that 48 percent of
the overall site is developed,including all buildings and impervious surfaces. Considering the
covered structure will be sited within the existing developed area and is only 480 square feet,
it will not increase the overall lot coverage of the site beyond 85 percent This standard is met
D. Landscaping and screening.All required landscaping,including landscaping used
to meet screening or tree canopy standards,is subject to the general provisions of
Chapter 18.420, Landscaping and Screening.
1. A minimum of 15 percent of the site must be landscaped. Landscaping
standards are provided in Section 18.420.040.Any landscape area that meets the
L-2 standard may count toward meeting the minimum area standard.
FINDING: As demonstrated on the landscape and planting plans within the previously
approved Conditional Use Permit (Sheets L100 — L201); all areas of the school site not
occupied by buildings,parking lots,and drive aisles will be landscaped with a combination of
hardscape plazas, landscape areas, existing vegetation (at the north end of the site), and
vegetated storm-water facilities (at the south end of the site). Approximately 52 percent
(237,837 square feet) of the 10.5 acre site (457,380 square feet) will be landscaped(including
existing vegetation that will be preserved). The addition of the 480-square foot covered

structure will reduce the landscaping to 51 percent (237,357 square feet). Staff finds that with
the reduction of landscaping,the standard continues to be met.
18.350.050 Design Standards
D. Materials.
1. The following materials are prohibited as exterior finish materials:
a. Vinyl PVC siding,
b. T-111 plywood,
c. Exterior insulation finishing (EIFS),
d. Corrugated metal,
e. Plain concrete or concrete block,
f. Spandrel glass, or
g. Sheet pressboard.
2. Foundation material may be plain concrete or plain concrete block where
the foundation material is not revealed for more than 2 feet above grade at any
point.
FINDING: According to the applicant's plans, the exterior finish materials utilised for the
coveted structure will not consist of any of the prohibited materials. The foundation material
will not be revealed for more than 2 feet above grade at any point and will have 20-inch
diameter concrete backfill columns below grade.These standards are met.
D. Approval criteria. The approval authority will approve or approve with conditions a minor
modification application when all of the following criteria are met
1. The proposed modification qualifies as a minor modification as defined in Subsection
18.765.060.A;
FINDING: As demonstrated in the findings above,this proposal qualifies as a minor modification as
defined in CDC 18.765.060A.This criterion is met.
2. If the proposal involves the modification of a condition of approval, at least one of the
following criteria is met:
a. The condition cannot be implemented for reasons outside the control of the applicant
or property owner,
b. The condition is no longer needed or warranted because circumstances have
changed;or
c. A new or modified condition better accomplishes the purpose of the original
condition.
FINDING: The applicant is not proposing to modify a condition of approval.This criterion does not
apply.

CONCLUSION: This proposal qualifies as a minor modification to an existing development,as
defined in CDC 18.765.060.A, and as conditioned, is in compliance with all
applicable standards of this Title.
