Dear Ms. Cofano,
The Oak Street Apartments are located in both the Mixed-Use Employment 1 (MUE-1) zone and the
Mixed Use Residential-1 (MUR-1) zone. The Tigard Community Development Code (CDC) in
18.120.020.G defines the MUE-1 zone as follows: "MUE-1 and MUE-2: Mixed-Use Employment 1
and 2 zone. The MUE-1 and 2 zones are designed to apply to areas where employment uses such as
office, research and development, and light manufacturing are concentrated. Commercial and retail
support uses are allowed but are limited,and residential uses are allowed that are compatible with the
employment character of the area.Lincoln Center is an example of an area designated MUE-1,a high-
density mixed-use employment zone. The Nimbus area is an example of an area designated MUE-2,
requiring more moderate densities".
CDC 18.120.020J defines the MUR-1 zone as follows: "MUR-1 and MUR-2: Mixed-Use Residential
1 and 2 zone.The MUR-1 and MUR-2 zones are designed to apply to predominantly residential areas
where mixed-uses are allowed when compatible with the residential use. A high-density (MUR-1) and
moderate-density (MUR-2) designation is available within the MUR zone."
The subject tax lots are also located within the Washington Square Regional Center Plan District.
More information regarding the Washington Square Regional Center Plan District can be found in
Community Development Code (CDC) 18.670. The subject tax lots, and all tax lots in the City of
Tigard,are regulated by the CDC.To access the CDC,please navigate to the City of Tigard homepage
and then select the "Codes"link in the top right corner of the webpage.
Properties to the north,west,and south are zoned Mixed Use Employment-1 (MUE-1),and properties
to the north, east, and south are zoned Mixed Use Residential-1 (MUR-1) Zone. Please see the
attached zoning map.
The Oak Street Apartments are located within a Plan District (PD) overlay, and were approved
through a Planned Development Review, case file number PDR2016-00017. The subject tax lots are
also located within the FEMA flood zone, Goal 5 Safe Harbor zone,Tigard significant wetlands, a

Clean Water Services vegetated corridor, the Fanno Creek Floodway, and Goal 5 significant habitat
areas. More information on the mentioned sensitive lands can be found in CDC 18.510.
Allowed uses in the MUE-1 and MUR-1 zones can be found in Table 18.120.1 of CDC 18.120. All
use categories are defined in CDC 18.60.
The subject parcels were developed under a Planned Development Review(PDR2016-00017).A copy

then search for case number PDR2016-00017.Please review for any information on variances, special

knowledge, there are no active code violations for the subject tax lots.
Without further analysis, it is uncertain whether any existing development on the property is in
compliance with the current City of Tigard CDC,or whether any legal nonconforming issues exist. If
an existing on-site structure is destroyed by any means,it may be reconstructed,as long as it complies
with all applicable standards in the Community Development Code of the City of Tigard.Additionally,
it is the responsibility of the property owner(or any agent authorized to represent the property owner)
to obtain all necessary land use approvals and/or building permits for any reconstruction.
