Dear Ms. Scroggins,
The subject tax lots are located in the Triangle Mixed-Use (TMU) zone. The Tigard Community
Development Code (CDC)in 18.120.020.K defines the TMU zone as follows:"TMU:Triangle Mixed-
Use zone. The TMU zone applies to most land within the Tigard Triangle, a regional Town Center
bounded by Pacific Highway, Highway 217, and Interstate 5. The TMU zone is intended to be an
active,urban,multimodal,and mixed-use district that accommodates a variety of housing options and
uses, promotes pedestrian-oriented development, and limits new auto-oriented development. (Ord.
18-28 §1; Ord. 18-23 �2; Ord. 17-22 §2)". Adjacent lots to the north, south, and west are also zoned
TMU. Adjacent tax lots to the east,which are located on the other side of Interstate 5, are located in
the City of Lake Oswego, Oregon.
The subject tax lots are not part of a Planned Development, however they are located in the Tigard
Triangle Plan District. More information regarding the Tigard Triangle Plan District can be found in
CDC 18.660. The subject tax lots, and all tax lots in the City of Tigard, are regulated by the CDC. To
access the CDC, please navigate to the City of Tigard homepage and then select the "Codes" link in
the top right corner of the webpage.
Allowed uses in the TMU zone can be found in Table 18.660.4 of CDC 18.660.All use categories are
defined in CDC 18.60.
The subject parcels were developed under a Site Development Review(SDR96-00019).A copy of this
record (which includes approved plans) can be accessed online at http://publicrecords.tigard-or.Lov/
. Click the "Community Development (Building, Engineering & Planning) -Search" link, and then
search for case number SDR96-00019. Please review for any information on variances, special
permits/exceptions, ordinances, or conditions. Our online system works best in Firefox. I am also
sending you a spreadsheet with the permit history for the subject parcels. To the best of our
knowledge, there are no active code violations for the subject tax lots.
Without further analysis, it is uncertain whether any existing development on the property is in
compliance with the current City of Tigard CDC,or whether any legal nonconforming issues exist. If
an existing on-site structure is destroyed by any means,it may be reconstructed,as long as it complies
with all applicable standards in the Community Development Code of the City of Tigard.Additionally,
