The Owner will accept bids for the construction of the fTDI Chip Building remodel project located at 7130 SW Fir Loop in Tigard, Oregon on December 11, 2014. 2. The bid will be for all work as shown in Drawings and Specifications and related work required for project completion. 3. All bidders must examine the Drawings, read the Specifications, and visit the site of this project to fully investigate the extent and quality of the work required. Bidders shall be familiar with the location and access to construction site, availability of utilities, the condition of the site and any existing construction, and governing regulatory agencies and permit processes. 4. The successful bidder shall furnish the Owner with certificates of insurance in amounts listed below or other amounts as required by law, whichever is greater: Workmen's Compensation Insurance for at least$500,000 each occurrence and$500,000 total for Bodily Injury including Personal Injury. Property Damage for at least $100,000. Comprehensive Automobile Liability for at least $250,000 for each person, $500,000 each occurrence, and Property Damage for at least$100,000 for each accident. 5. Job No. 1209-31 Div. 00 00700--GENERAL CONDITIONS OF THE CONSTRUCTION AGREEMENT 1.1 GENERAL A. The Work includes all construction materials, labor, equipment, and services required by the Drawings, Specifications, and related Contract Documents. This includes labor, materials, etc. even if not explicitly required in the documents, as required to complete the project and provide project safety and security. B. The project work shall comply with all applicable federal, state, county and/or city regulations. All building permits and other permits shall be obtained as required before starting work. C. Substitution of any specified item is not permitted except through written request and written approval by the Architect. The Contractor's request must provide all specification data and certification that the substitution meets all requirements of the originally specified item. Any cost savings from an accepted substitution shall be shared equally by the contractor and the Owner. 2.1 OWNER'S RIGHTS AND RESPONSIBILITIES A. The Owner shall provide a survey of the project site to the Contractor. The accuracy of the survey is not guaranteed by the Owner and the Contractor is responsible for verifying actual site dimensions and field conditions. B. The Owner shall obtain and pay for all necessary approvals, easements and/or variances required for construction or preparation for construction. • C. If the Contractor fails to complete or correct any of the Work according to the Construction Documents the Owner may stop work until the work is completed or corrected. D. The Owner reserves the right to occupy portions of the building space as work proceeds. If such occupancy interferes with the work, a negotiated fee or credit will be provided to the Contractor by the Owner and the required date of completion will be adjusted accordingly. 3.1 CONTRACTOR RIGHTS AND RESPONSIBILITIES A. The Contractor shall have complete responsibility for, and control over, construction methods, techniques,procedures and project safety and security. B. Any stated observations of possible safety or security hazards offered by the Architect or Owner in no way relieves the Contractor of full responsibility for such conditions. C. The Contractor shall promptly pay for all labor, equipment, materials and services required to complete the Work as described in the Construction Agreement. D. The contractor shall pay for special permits, inspections, tests, certifications, etc. required in the course of construction. E. The Contractor shall be held responsible for all damages caused by his employees or subcontractors. The Contractor shall be held responsible for all errors, omissions, negligence, non-compliance with drawings and specifications, or uncorrected work by employees, suppliers, fabricators, and subcontractors. fTDI Chip Bldg. The Contractor shall hold harmless the Owner from and against all claims, damages, losses, expenses, legal fees or other costs resulting from the Contractor's performance of the Work of the Construction Agreement. G. The Contractor shall provide free access to the work by the Owner, Architect, and their representatives at all times. 3.2 SUBCONTRACTORS A. The Contractor's choice of subcontractors, suppliers, and fabricators shall be as approved by the Architect and Owner. B. The Contractor may not be required to use a specific subcontractor, fabricator, or supplier if there is an explicit reason not to that is confirmed by the Architect. 3.3 WORK BY OTHER CONTRACTORS A. The Contractor and all subcontractors shall work in full cooperation on the project. This includes reasonable provision for storage and protection of Owner's, Contractor's, or subcontractor's materials and equipment. 4.1 CHANGES A. Revisions, additions, or deletions to the Work under this agreement will be made by written order signed by Owner and Contractor. Such changes will not alter the remainder of this Agreement. If the • revisions, additions, or deletions to the work affect the time and cost of project delivery, the Agreement will be amended accordingly. 5.1 TIME A. If Work in this agreement is delayed by Owner-requested changes, delays in required approvals, labor disputes, fire, severe weather, or other conditions over which the Contractor has no control, the time for completion shall be extended accordingly and amended in writing in the Contract. 6.1 DISPUTES A. Claims or disputes between the Contractor and the Owner arising from this Agreement that are not settled through negotiation shall be offered for mediation according to the rules of the American Arbitration Association. Disagreements not settled by mediation shall be offered for arbitration as per the rules of the American Arbitration Association. Work shall not be halted or slowed by the Contractor during negotiation,mediation, or arbitration of such disputes. 7.1 PAYMENTS A. Payments will be made to the Contractor by the Owner according to the schedule in the Agreement. B. Payments may be withheld because of: Defective or non-conforming work not corrected. fTDI Chip Bldg. Failure to perform the Work according to the terms and conditions of this Agreement. Legal or other claims by third parties related to the work of this Agreement. C. Final payment shall be due when the Work is completed according to the Construction Documents and as stipulated in the Agreement between Owner and Contractor. 8.1 JURISDICTION A. This Addendum consists of two(2)pages and no(o)pages of architectural attachments. Drawings: ITEM NO: Dwg./Sht. NOTE: DESCRIPTION: 1. Sheet A2.2 CLARIFY Add to Floor Plan General Note #5: "All carpet will be provided by Owner, and installed by the Contractor.All other flooring shall be Contractor provided, Contractor Installed (CPCI). Provide new commercial quality sheet vinyl flooring goods in the Restrooms, Shower Room, Lab, and Break Room. Contractor shall thoroughly prepare sub floors and confirm there are absolutely no foreign materials on the floor prior to new floor installation in order to eliminate any telescoping through to the new floors. Manufacturer: Armstrong or approved. Color/style: to be determined. Provide finish flooring in the Entry Room too consisting of the following: 5o% of floor area shall be 18"x18" ceramic floor tile. It is likely the bulkhead above the glass partitions could consist of metal framing suspended from the structure above, but these conditions will not be confirmed until the demolition phase is complete. 4. 4,1,2/A312 CLARIFY The drawings do not specify the exposed cabinet face or counter/backsplash materials. Add note to the drawing 4/A3.2 that states: "All exposed cabinet faces shall consist of white oak veneer. All counter tops, self-edges, and back-splashes shall consist of plastic laminate.
