EXPLANATION OF ISSUE
The City of Tigard invites our volunteers to a celebratory lunch in Cook Park to thank them for their time
and dedication to our community.
•When: Saturday April 23 2022 11AM-1PM
•Where: Cook Park Shelter 2
•What: Drop by,meet other Tigard volunteers,have lunch, and join our garden"potting party" to
take home flowers as a thank you.
ACTION REQUESTED
The city's volunteers touch every division in the city.Teammates are asking City Council to recognize their
accomplishments with a Proclamation of Appreciation.
BACKGROUND INFORMATION
Dates of Previous and Potential Future Considerations
The City of Tigard has a long and fruitful relationship with our volunteers. This particular proclamation
and subsequent celebrations are hosted annually.
Public Involvement
Teammates have invited all city volunteers,Board and Committee members and City Council to a
luncheon at Cook Park on Saturday,April 23, from 11 a.m. to 1 p.m. at Cook Park Shelter 2. The
celebration connects Tigard volunteers with grateful city representatives and each other for a relaxed
luncheon, followed by a garden "potting party" to take home flowers as a thank you.
Impacts (Community, Budget, Policies and Plans/Strategic Connection)
There is no financial impact associated with issuing a proclamation.
ALTERNATIVES & RECOMMENDATION
Council could choose not to issue a proclamation, but City Teammates recommend its issuance.
ADDITIONAL RESOURCES
The National Volunteer Week theme for 2022 is "Volunteering Is Empathy In Action" and affirms the
strong connection between volunteerism and empathy. This profoundly human connection is at the heart
of healthier individuals and stronger communities.

The Tualatin Valley Fire &Rescue (TVF&R) State of the District is an annual presentation.

BACKGROUND INFORMATION
Tualatin Valley Fire &Rescue (TVF&R) presents their State of the District report to the Tigard City
Council annually. Chief Kenny Frentress will give an overview of where the fire district stands today and a
review of last year's incidents and major milestones. He has a slide presentation and there will be a brief
question and answer period afterwards.

EXPLANATION OF ISSUE
The Tigard Public Library Board will meet with the Tigard City Council for their annual joint meeting. They
will provide an update on the current projects of the library and provide information to the City Council on
overall library operations.

BACKGROUND INFORMATION
The Tigard City Council last met with the Tigard Public Library Board for a joint meeting on Library
operations on April 20, 2021.
Public Involvement
Library Board members are members of the public that attend monthly meetings and receive reports on
library operations and programs.

This report will inform the community on library services and programs since April 2021.

EXPLANATION OF ISSUE
The Capital Improvement Plan (CIP) establishes Tigard's budget and timeline for improvements to City
owned and operated public infrastructure over a 6-year period. A CIP project improves or adds value to
the City's infrastructure, typically costs $50,000 or more, and has a useful life or extends the useful life of
infrastructure for 5 years or more. Public facility systems addressed by the CIP include streets,parks,
sanitary sewers, stormwater and domestic water in addition to public buildings and facilities.
In most cases, CIP projects are implemented with oversight from the City's Engineering Division. City
Engineer Joe Wisniewski will provide a summary report to council,including the status of active projects
during this briefing.
The attached file will be shown as a presentation at the meeting. Copies of individual project status reports
for active CIP projects will be delivered to Council in the April 7, 2022 City Council Newsletter packet.

EXPLANATION OF ISSUE
For the past two years,the City Council,boards, and committees have met virtually due to the COVID-19
pandemic. As the City prepares for in-person and hybrid meetings, the purpose of this item is for the City
Council to discuss its expectations for its own meetings as well as for boards and committees. There are
many variables that need to be taken into consideration to ensure all meetings provide a high quality and
safe experience for the public and those directly involved in the meetings.This includes public meeting
State law requirements, City safety standards,meeting room capacity, technology, and teammate resources.
ACTION REQUESTED
1. Discuss City Council goals and priorities for City Council,board, and committee public meetings.
2. Affirm maintaining City safety standards while COVID-19 community transmission exists.
3. Provide additional guidance to the team that will be used to create a detailed plan for holding hybrid
meetings no earlier than June 1,2022.
BACKGROUND INFORMATION
In addition to City Council meetings, the City has at least a dozen boards and committees that meet at
various frequencies in multiple locations. Since the pandemic began in 2020, all meeting have been held
remotely. As a City,we have learned a great deal about how we can provide quality meetings remotely;
something we may have never considered in the past. In light of legal requirements and community
expectations,it is clear that Tigard must continue to embrace hybrid and virtual meetings as the future of
how we provide quality and accessible public meetings for the City Council, boards, and committees.
To facilitate the City Council's conversation, the City Attorney and City Manager recommend a two-step
process. The first step on April 19 is to determine the City Council's meeting goals and priorities by
discussing multiple questions listed below. From the input received, the team will return with a
recommendation on how to best move forward. In any event,we recommend starting hybrid meetings no
earlier than June 1 to ensure we are prepared to provide a quality and safe experience for all involved.
Public Meeting Goals and Priorities Questions
1. Do you have a strong preference that all Councilors should be present the same way, either all virtually
or all in-person?
2. Do you have a strong preference that all Tigard team members should be present the same way as
Councilors, either all virtually or all in-person?
a. Does it depend on the agenda item, such as quick vs long or simple vs complex?
b. Does it depend on the team member, such as city manager/city attorney, department head, or
others?
c. Does it depend on whether the presenter is from an outside organization?
3. Do you have a strong preference about regularly providing both virtual and in-person options? For
example, the City could make certain weeks be always in-person or always virtual.
4. Do you have a strong preference about allowing public comment at every meeting? The law requires
public meetings be available virtually to the greatest extent possible. For public participation,if written
testimony is allowed, email must be as well;if oral testimony is allowed,phone/virtual testimony must be
as well. This means it could be possible for the City to decide not to take public testimony at workshop
meetings, for example, and those could be all in-person,yet streamed online to meet the legal
requirements.
5. Do you have a strong preference that we keep the same meeting schedule? For example, should the
City look at having fewer meetings per month or changing the meeting start time to accommodate
in-person/virtual meetings?
To assist in the City Council's discussion, the following is provided so you are aware of the many variables
that need to be considered for providing quality meetings.A main priority for the team is to maintain City
safety standards for all public meetings. As long as there is community transmission of COVID-19,we
recommend maintaining six foot distancing for everyone who attends a meeting.This safety requirement
will limit the total number of people who are able to attend meetings in-person and limit the City meeting
rooms that are suitable for in-person/hybrid meetings. For the foreseeable future, the team recommends
maintaining safety standards be the top priority.
State Public Meeting Law Requirements:
•All public meetings required to allow the public to participate by phone/virtual to the extent
reasonably possible.
•If public testimony is taken in writing at an in-person meeting,it must be allowed to be submitted by
email as well.
•If public testimony is taken orally at an in-person meeting,it must be allowed to be received by
phone or virtually as well
•Public testimony is required for City Council,Planning Commission, and Budget Committee.
•Public testimony for other boards/committees is more discretionary (the team recommends all
meetings provide opportunities for public comment).
•In short,meetings with public testimony and participation must be either virtual only or hybrid, no
option for in-person only absent extenuating circumstances.
OSHA Requirements (covers teammates,Mayor, Councilors, and board/committee members):
•The City Council has opted to insure all volunteers,including themselves, under our Workers Comp
policy.
•They are treated like employees in respect to injuries,including COVID infection tied to the
workplace.
Meeting Room Capabilities:
•All meeting spaces are equipped with remote/hybrid meeting technology except Public Works
auditorium and Library community room.
•With City safety standards in place:
•Town Hall is the only meeting room large enough and equipped with the necessary
technology to accommodate in-person meetings and comply with safety standards
•In-person public participation would be significantly impacted if the professional team is also
in attendance rather than remote

EXPLANATION OF ISSUE
Following Council's discussion on April 5, 2022, this item proposes a resolution to formally adopt
Council's interpretation of Section 7 of the Tigard Charter.
After that decision, this item also seeks guidance regarding eligibility to run for a partial term of elected
office.
ACTION REQUESTED
This item requests two actions of Council this evening. First, staff requests Council consider the resolution
and,if Council finds it consistent with its previous interpretation of the Charter, approve the resolution.
The second item is related to the eligibility of a member to run for a partial term. For example,if a
member has served for 10 years on Council,is that member eligible to run for another term, knowing they
are only eligible to serve for 2 years of the 4-year term? Staff asks Council to affirm that the Attorney
General's opinion on this question is applicable in the context of the Tigard Charter as well.
BACKGROUND INFORMATION
Dates of Previous and Potential Future Considerations
Council's first briefing on this issue was on December 21,2021. On March 8,2022, Council received
related public comments. On April 5, 2022, Council deliberated and directed staff to prepare a resolution
to formally adopt its interpretation.
Public Involvement
Council has solicited public comment through an online portal for 12 weeks and has received 99 comments.
Impacts (Community, Budget, Policies and Plans/Strategic Connection)
Section 7 of the Tigard Charter states:
The elective officers of the City shall be a Mayor and four councilors who together shall constitute the City Council.At the
general election held in 1990, and every fourth year thereafter, a Mayor shall be elected for a term of fouryears. No councilor
shall serve the City as councilor for more than eight consecutive years, nor shall the Mayor serve as Mayor for more than eight
consecutive years. In no case shall any person serve on the City Council for more than twelve consecutive years. These limitations
do not apply to the filling of an unexpired term.
On April 5,2022, Council reached consensus on an interpretation of three questions. Specifically, 1) What
is the meaning of consecutive years referenced in the City Charter? 2) Should a break in service reset the
consecutive years calculation?If so, how long of a break is needed? 3) Should the statement about
consecutive years apply regardless of whether the unexpired term was filled by election or appointment?
Council determined that "consecutive years" referred to "successive calendar years." In order to reset
"consecutive years," a break in service is required of at least two years, or if the candidate is running for a
different Council position in a regular council election. Finally, the statement about filling an unexpired
term applies regardless of whether the vacancy is being filled by election or appointment.
The second item for Council discussion is the question of eligibility to run for a partial term of office. The
question presented at the last meeting was whether a Council member could run for reelection if the
member could not serve the full length of that term? For example,if a member had served for 10 years,
could the member run for reelection and serve 2 years of the 4-year term? A 2014 Attorney General
Opinion took a position on a similar question as applied to State Treasurer Ted Wheeler. Based on case
law and an interpretation of the constitutional language, the Attorney General concluded Treasurer
Wheeler would not be eligible to serve the full term based on constitutional term limits and therefore could
not run for reelection. A copy of that opinion is attached. Additionally, a memo is attached that
summarizes the opinion,the case law cited in the opinion, and relevant statutes and Charter language. The
action requested of Council is to affirm the applicability of the Attorney General Opinion to the Tigard
Charter language.
ALTERNATIVES & RECOMMENDATION
Council could amend this resolution if it believes it does not accurately reflect its interpretation of the
Charter.

WHEREAS, the Tigard Charter, Chapter III, Mayor and Council, Section 7, states, "No councilor shall serve
the City as councilor for more than eight consecutive years, nor shall the Mayor serve as Mayor for more
than eight consecutive years. In no case shall any person serve on the City Council for more than twelve
consecutive years.These limitations do not apply to the filling of an unexpired term; and
WHEREAS,under Oregon law,a city council is charged with interpreting ambiguities in its own charter;and
WHEREAS, the Council has received public testimony and evaluated the Charter language using principles
of statutory interpretation and reached consensus among participating members to resolve the ambiguity
over the meaning of"consecutive years;" and
WHEREAS, the Council also seeks to clarify what break in service is required to reset "consecutive years" and
that the limitations do not apply to the filling of an unexpired term,regardless of whether the unexpired term is
filled by appointment or election.
NOW,THEREFORE,BE IT RESOLVED by the Tigard City Council that:
SECTION 1: The Tigard City Council interprets the phrase "consecutive years" to mean "successive
calendar years."
SECTION 2: The Tigard City Council interprets the Charter to require a two-year break in service in order
to reset"consecutive years."

The question has been asked whether a sitting member of the Tigard City Council who has served for 10
consecutive years would be able to run for election and potentially serve two more years before reaching
the 12-year term limit imposed by City Charter? This memorandum sets out the applicable law and
Charter language.
Attorney General Opinion
In 2014, the Attorney General issued an opinion involving a similar question as applied to then-Treasurer
Ted Wheeler. Treasurer Wheeler had been elected to fill the remaining two years in Treasurer Ben
Westlund's term after Treasurer Westlund's death in office. Treasurer Wheeler was then reelected to a
full, 4-year term, and was seeking advice on his eligibility to run for another term. The state constitution
set an 8-year term limit on the office of state treasurer, so at the time Treasurer Wheeler was only able to
serve 2 years of the 4-year term.
The Attorney General concluded that because Treasurer Wheeler was not eligible to serve the full 4-years
of the term,he was prohibited from running for the office. 'We conclude that, because he would be
legally incapable of completing the four-year term of office provided in the constitution,Wheeler would
not qualify to run in 2016. He could not run that year with the understanding that he would only serve
two years of the four-year term." Attorney General Letter of Advice to Treasurer Ted Wheeler (OP-8288)
(August 11, 2014).
The opinion focused on the constitutional text, "shall hold* * * office0 for the term of four years," but
not"eligible" to hold office for more than eight years. Relying on the dictionary definition of"eligible,"
which means, "fit to be chosen* * *legally qualified to be chosen," the opinion reasoned that Wheeler
would be "unqualified to be elected for that term, because he could not serve the full four-year term
without exceeding the eight-year limit." Id.
Case Law
The Attorney General opinion also relied on the case McAlmond v. Myers, 262 Or 521 (1972). This case
was brought as a writ of mandamus alleging that the Secretary of State was compelled to put a candidate's
name on the ballot for Treasurer. The candidate was found to have violated election laws in her capacity
as state senator and the penalty for such violation was disqualification from serving in any office during
the term of the office for which the candidate was disqualified. In this case, there was a one-week period
in which the candidate's disqualification would have overlapped with her term as Treasurer. The
candidate argued that she could have waited a week to take the oath of office and the period of
disqualification did not prevent her from being elected.
The Oregon Supreme Court disagreed and concluded that the candidate's disqualification prevented her
name from appearing on the ballot. The court reasoned:
Placing a party's name on the ballot is a form of representation to the voters that,
insofar as can then be known, the candidate,if elected,will be able to qualify for the
Full term of the office.This is the import of that portion of a candidate's declaration
of candidacy wherein he states that he will qualify if elected.
Id. at 532 (capitalization in original).
State Statute
ORS 254.565 defines the duties of a city elections officer after an election and includes, "(2) After the
general election, shall prepare and deliver a certificate of election to each qualified candidate having the
most votes for election to a city office."
ORS 254.165(1) says:
If the filing officer determines that a candidate has died,withdrawn or become
disqualified, or that the candidate will not qualify in time for the office if elected, the
name of the candidate may not be printed on the ballots or,if ballots have already
been printed, the ballots must be reprinted without the name of the candidate before
the ballots are delivered to the electors. The name of a candidate nominated to fill a
vacancy in nomination or office must be printed on the ballots or,if the ballots have
already been printed, the county clerk shall cause the name to appear on the ballots
before the ballots are delivered to the electors. A filing officer, other than the
Secretary of State, shall notify the Secretary of State of any action taken under this
section.
Subsection (3)(E) defines "filing officer" as "city clerk, auditor or recorder,regarding a candidate for a
city office."
City Charter
Section 7 of the City's Charter says, "The elective officers of the City shall be a Mayor and four councilors
who together shall constitute the City Council. At the general election held in 1990, and every fourth year
thereafter, a Mayor shall be elected for a term of four years." Thus, the mayoral elections are in 2022 and
2026.
Section 12 addresses qualification of officers and says that the "Council shall be final judge
of the qualifications and election of its own members, subject,however, to review by a court
of competent jurisdiction."

The Secretary of State asks if the current State Treasurer, Ted Wheeler, would be eligible
to run for reelection in 2016 , or whether limitations imposed by the Oregon Constitution would
•
prohibit him from running . Below we set out the secretary ' s specific question and our short
answer followed by a discussion of the applicable law .
QUESTION
Is Treasurer Wheeler eligible to run for reelection in 2016 in light of Article VI , section
1 , of the Oregon Constitution, which provides that the term of office for State Treasurer is four
years , and that a person is not eligible to hold the office for more than eight years in a twelve -
•year period ?
SHORT ANSWER
No . Assuming Treasurer Wheeler completes the four- year term of office that he is
currently serving , he would not qualify to run for State Treasurer in 2016 , because he could not
hold the office for the full four- year term without violating the eight- year limitation of Article
VI , section 1 .
DISCUSSION
1 . Background
Wheeler has served as State Treasurer since March of 2010 , when he was first appointed by
Governor Kulongoski to fill the vacancy created by former Treasurer Westlund ' s death . Westlund
had been elected for a four- year term in November 2008 , but died on March 7 , 2010 . Wheeler was
then elected to the office of treasurer in the November 2010 general election to fill the remaining
two years of Westlund ' s four- year term . Then, in November 2012 , Wheeler was reelected to a
four- year term . He qualified for and assumed his present term of office in January 2013 .

Article VI , section 1 , of the Oregon Constitution creates the offices of State Treasurer and
Secretary of State . It also establishes the terms of office and limits the number of

may serve in those offices :
There shall be elected by the qualified electors of the State , at the times
and places of choosing Members of the Legislative Assembly , a Secretary and
Treasurer of State , who shall severally hold their offices for the term of four
years ; but no person shall be eligible to either of said offices more than Eight in
any period of Twelve years .
Article V , section 16 , of the Oregon Constitution governs the filling of vacancies in state
office :
when at any time a vacancy occurs in any * * * state office * * * the governor
shall fill such vacancy by appointment, which shall expire when a successor has
been elected and qualified . * * * * * [ T] he vacancy shall be filled at the next
general election, provided such vacancy occurs more than sixty - one ( 61 ) days
prior to such general election .
A statute pertaining to vacancies in elected offices likewise provides that an appointment
to fill a vacancy " shall expire when a successor to the office is elected and qualified . "
ORS 249 . 215 (2 ) . Under the terms of this statute , when Treasurer Wheeler was elected in 2010 ,
he was elected to fill "the remaining two years of [ Treasurer Westlund ' s ] term . " 1 "

2 . Time Included in Limit Calculation
The question presented by the Secretary of State requires us to first assess whether the
two years Treasurer Wheeler served in office following his election in November 2010 count
toward the eight- year limit established by Article VI , section 1 . We conclude that those two
years from January 2011 through January 2013 must be included in the calculation .
Under Article II , section 12 , of the Oregon Constitution, the time that Wheeler served as
the appointee from March 2010 , through January 2011 , is not included when applying the eight-
year limitation . ( " In all cases , in which it is provided that an office shall not be filled by the
same person, more than a certain number of years continuously, an appointment pro tempore
shall not be reckoned a part of that term . " ) See also 17 Op Atty Gen 639 ( 1936 ) (concluding that
the time that a person served as appointed State Treasurer was not included in calculations ) .
As noted above , both Article V , section 16 , and ORS 249 . 215 (2 ) , provide that a
temporary appointment expires when a successor is elected and qualified . Therefore , Wheeler ' s
appointment expired when he was elected and qualified in January, 2011 . 2/ Because the two
years that followed were not served pursuant to an appointment, and only appointments are
excluded from the calculation under Article II , section 12 , those two years of service as treasurer
count toward the eight- year limit in Article VI , section 1 .

3 . Qualification to Run for Reelection in 2016
Wheeler currently holds the treasurer ' s office for a four- year term, which began in
January 2013 and ends in January 2017 . In January 2017 , Wheeler will have held office for six
consecutive years . If he were elected in the November 2016 general election, his four- year term
of office would begin in January 2017 and end in January 2021 . In January 2019 , however, he
would have served eight consecutive years as elected treasurer, and he would no longer be
eligible to hold the office under Article VI , section 1 .
We next consider whether his ineligibility to serve as treasurer beyond January of 2019
would prohibit Wheeler from running for office in 2016 and leaving the office when he reaches
the eight- year limit . We conclude that, because he would be legally incapable of completing the

four- year term of office provided in the constitution, Wheeler would not qualify to run in 2016 .
He could not run that year with the understanding that he would only serve two years of the four-
year term .
Article VI , section 1 , states that the elected State Treasurer "shall hold * * * office [] for
the term of four years " but is not " eligible " to hold office for more than eight in twelveY ears .
(Emphasis added) . This provision was part of the original constitution adopted in 1857 and
effective in 1859 . A dictionary in use around that time defined " eligible " to mean " fit to be
chosen * * * legally qualified to be chosen . " Webster, AN AMERICAN DICTIONARY OF ENGLISH
LANGUAGE ( 1828 ) . Thus , under Article VI , section 1 , Wheeler would be required to run for a
four- year term of office , but he would be unqualified to be elected for that term , because he
could not serve the full four- year term without exceeding the eight- year limit .
Our conclusion is supported by an Oregon Supreme Court opinion holding that a
candidate for State Treasurer who was incapable of serving the full term did not qualify for the
office . In McAlmond v. Myers, 262 Or 521 , 500 P2d 457 ( 1972 ) , the candidate had violated a
state election law in an earlier election for state senator . In consequence , she was disqualified

from serving in another office during the term that she would have served as state senator . Her
senatorial term would have expired on January 8 , 1973 , and , if elected State Treasurer, her term
of office would have begun on January 1 , 1973 . She would have been disqualified from serving
as State Treasurer for one week of the four- year term .
The court concluded that the Secretary of State had a duty to withhold certification of a
candidate that he knew was "unqualified" or " ineligible " for office . The court explained that
candidates for State Treasurer were nominated by filing a nominating petition or declaration of
candidacy with the Secretary of State . Candidates had to state in those documents that they
would qualify if elected . The Secretary of State was authorized to verify the validity of those
statements . 3" The court opined that the Secretary of State ' s authority to verify the validity of the
statements in declarations and petitions "would be meaningless if it was not contemplated that he
would take action if facts became known to him which show that the candidate is unqualified . "

Then, as now, the Secretary of State had a duty to certify a petition of nomination to the
person receiving the highest number of votes in the primary . See ORS 254 . 555 ( 1 ) ( c ) ( Secretary
of State must certify nomination of primary winner) . The court reasoned that if the secretary
knew that the candidate was disqualified from being elected or serving as treasurer he had a duty
to omit her name from the certification of candidates in the general election . See also,
ORS254 . 165 (current statute providing that if filing officer determines that a candidate has
become disqualified or will not qualify in time for the office if elected they may not print the
name of the candidate on the ballot) .
The court reasoned that " [p ] lacing a party ' s name on the ballot is a form of representation
to the voters that, insofar as can then be known , the candidate , if elected , will be able to qualify
for the Full term of the office . " 262 Or at 532 ( capitalization in original) . The court also agreed
with a Pennsylvania decision holding that when a candidate asserted that he wasq ualified for
office , the candidate was asserting eligibility to fill the entire term of the office :
" it may be assumed that those who voted for him did so in the mistaken belief that
the candidate of their choice would be legally capable of holding the entire term
for which they were balloting . * * * * * . Its effect * * * [would be ] to bring
about the election of one who could not, by any act of his own, or in any possible
circumstances , remove the disqualification so as to completely fill the office for
which he was standing , and to which he had been elected * * * . "
262 Or at 532 - 533 (quoting Commonwealth ex rel Kelley v. Keiser, 340 Pa 59 , 16 A2d 307
( 1940 ) ) . If Wheeler were elected in 2016 , he would be ineligible to hold the office for the last
two years of the four- year term . For this reason, we conclude that the Secretary of State would
not be able to certify Wheeler as a candidate for treasurer, knowing he would be ineligible to
hold the full term of office .
CONCLUSION
For the reasons discussed above , we conclude that the two years Treasurer Wheeler served
after his election in November of 2010 must be included when applying the eight - year limit of
Article VI , section 1 . Assuming that Treasurer Wheeler completes his present four- year term of
office , we further conclude that he would notuali to run for State Treasurer in the 2016
q fy
election, because he would be incapable of fulfilling the full term of office without violating the
eight- year limitation of Article VI , section 1 , of the Oregon Constitution .
